J������ 5, 2011 La Paz County, AZ- In November of 2006 the citizens of Arizona made their voices heard by passing Proposition 201, The Smoke-Free Arizona Act A.R.S. § 36- 601.01 and four years later it is still going strong. La Paz County Health Department would like to remind businesses of some of the basic requirements needed remain in compliance with the act. “In 2006, when Arizona voters voted on this law and it first went into effect, Arizona Department of Health Services and coun- ty Health Departments worked together to provide businesses with the tools they needed to implement the new law. Our ini- tial efforts were focused more on education and helping businesses make the change but now, four years later, we are focusing on the enforcement portion of the law,” ex- plained Marion Shontz, Health Director for La Paz County Health Department. The act went into effect on May 1, 2007 and prohibits smoking in most indoor pub- lic places including (but not limited to): • Restaurants, bars, gaming facilities such as bingo halls (tribal casinos exempt), billiard or pool halls, bowling centers, public buildings, grocery stores or any food establishment • Lobbies, elevators, restrooms, reception areas, hallways and any other common- use areas in public and private buildings, condominiums and other multiple-unit residential facilities • Indoor sports arenas, gymnasiums and auditoriums • Health care facilities, hospitals, health care clinics, doctor’s offices and child day care facilities • Company vehicles ���.D�����M��������.��� Smoke-Free Arizona Act Reminder Businesses are also required to comply with the Smoke-Free Arizona Act by: 1. Remove all indoor ashtrays and smoking receptacles and move all outdoor ashtrays and smoking receptacles at least 20 feet away from entrances 2. Post the required “No Smoking” signs at every entrance into your establishment, available free of charge online at smoke- freearizona.org 3. Post the required “No Smoking” signs on all company vehicles 4. Educate all existing and prospective em- ployees about the act 5. Prohibit anyone including employees, vendors, and customers from smoking in- side and within 20 feet of all entrances into your place of business 6. Politely inform violators smoking inside or within 20 feet of an entrance to extin- guish it or to go outside and at least 20 feet away from the entrance to smoke Tribes and Sovereign Nations are exempt from the Smoke-Free Arizona Act. Local Health Departments are contracted with Arizona Department of Health Ser- vices (ADHS) to enforce the Smoke-Free Arizona Act on a local level and to pro- vide education and technical assistance to businesses. The La Paz County Public Health Education and Prevention Program (PHEPP), a division of La Paz County Health Department, is offering to busi- nesses technical assistance in compliance. “It is the sole responsibility of building owners and employers to follow all state and federal laws; this is just one of them. Businesses not in compliance with the Smoke-Free Arizona Act are issued a No- tice of Violation and may be assessed a fine. The Health Department does not generate revenue from the collection of fines from the Smoke-Free Arizona Act. All fines as- sessed from the act are sent to the state to be put back in the education and enforce- ment of the law. To help residents and business owners understand the Smoke-Free Arizona Act, ADHS launched an information line and Website. More information can be found at http://www.smokefreearizona.org.
