Section 1.04.210 of the Tehama County Code is hereby repealed. SECTION 2. Section 1.04.210 is hereby added to the Tehama County Code to read: 1.04.210 Fire chief or fire official or fire warden . "Fire chief" or "fire official" or "fire warden" shall mean the person appoint- ed as the county fire chief by the Board of Supervisors. SECTION 3. Section 9.12.050 of the Tehama County Code is hereby repealed. SECTION 4. Section 9.12.050 is hereby added to the Tehama County Code to read: 9.12.030 Scope . These regula- tions do not apply to areas with- in the city limits of Red Bluff, Corning, and the City of Tehama or within the boundaries of the Capay fire protection district. Affected activities include all burning of any flammable mate- rial which requires an LE-62A residential burn permit - B URN PILE. These regulations do not apply to agricultural burning which requires an LE-5 burn per- mit or other specially permitted burning unless banned under Section 9.12.060. SECTION 5. Section 9.12.050 of the Tehama County Code is hereby repealed. SECTION 6. Section 9.12.050 is hereby added to the Tehama County Code to read: 9.12.050 Period of annual burn ban. A. All residential debris burning shall be banned during the period including June 1st to the end of the declared fire sea- son each year in all areas of Tehama County with the excep- tion of the following: All residen- tial debris burning within the communities of Mineral, Childs Meadows, Deer Creek and Mill Creek shall be banned during the period including July 1st to the end of the declared fire sea- son each year. B. Notwithstanding subdi- vision (A), the county fire chief may permit residential debris burning within all or any part of the county prior to the end of the declared fire season in any year, upon finding that such burning will not endanger the public health, safety, or welfare. Such action shall be proclaimed twenty-four (24) hours in ad- vance by press release and posted on the County website, and may be rescinded by the fire chief in the same manner. Any residential debris burning conducted during such period shall require an LE-62A residen- tial burn permit - BURN PILE, is- sued to the responsible person. SECTION 7. Section 9.12.070 of the Tehama County Code is hereby repealed. SECTION 8. Section 9.12.070 is hereby added to the Tehama County Code to read: 9.12.070 Periods of allowable residential debris burning . Resi- dential debris burning is al- lowed without permit during the period after the end of declared fire season, until May 1st. During the month of May, and during any portion of the declared fire season in which residential de- bris burning is permitted by the Fire Chief pursuant to Section 9.12.050, subdivision (B), resi- dential debris burning is al- lowed with an LE-62A residential burn permit - BURN PILE, issued to the responsible person. Resi- dential debris burning is al- lowed within the communities of Mineral, Childs Meadows, Deer Creek and Mill Creek dur- ing the months of May and June with an LE-62A residential burn permit - BURN PILE, issued to the responsible person. SECTION 9. This ordinance shall take effect thirty (30) days from the date of its adoption, and pri- or to the expiration of fifteen (15) days from the adoption thereof shall be published at least one time in the Red Bluff Daily News, a newspaper of gen- eral circulation in Tehama Coun- ty.
