Friday, February 3, 2012 – Daily News COURT ROUND-UP The following defendants were sen- tenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: —————— Recent State Prison Commitments • Ramon Ruiz Segura was sentenced to six years in state prison for transporta- tion of a controlled substance, special allegation-punishment by quantity. An officer conducted a traffic stop on a vehicle driven by Segura. The officer was advised defendant had a suspended license. The officer then conducted a search of the vehicle and located several pounds of heroin. • Gary Delmont Marley was sentenced to five years and four months in state prison for bring drugs into a jail; unlaw- ful driving or taking of a vehicle, grand theft of labor, possession of stolen prop- erty; failure to appear while on bail. (NCR80637)-An officer contacted Marley on the side of the road and received consent to search. Inside Mar- ley's pocket the officer located Hydro Morphone pills. Marley was arrested and taken into custody. As Marley was being booked an officer located several more pills hidden in another pocket. (NCR80706)- Marley stole a tow truck in Chico and drove it to a tow yard in Red Bluff where his vehicle, which had been impounded weeks before, was being stored. Marley loaded up his impounded vehicle onto the stolen tow truck and drove away. (NCR81085)- Marley was out on bail in NCR80637 and failed to appear in court as ordered. • Leonard Allen Smith was sentenced to five years in state prison for receiving stolen property, special allegation-prior felony. Smith was originally granted formal probation. He violated his probation when he failed to appear at probation for scheduled appointments, failed to appear for bi-weekly drug testing and failed to complete his drug and alcohol treatment program. • Sidhu Sanjeevinder Singh was sen- tenced to three years in state prison for driving with a .08 percent Blood Alcohol causing injury. Brief history: Singh was driving a semi truck on I-5 with a passenger when he failed to slow to a safe speed as he exited the off ramp. Singh rolled his semi truck onto its side and then slid into a ditch. The victim was found pinned under the passenger's seat and was taken to the hospital with injuries. • Jason Lee Horner was sentenced to two years in state prison for possession of a controlled substance, reckless dri- ving. An officer contacted defendant at a local gas station after he was observed violating several traffic laws. Horner failed the field sobriety tests and was taken into custody. During a pat down search the officer located several pre- scription pills in Horner's pocket. Recent County Jail Commitments • Antone Marty Durrer was sentenced to 360 days in Tehama County Jail for possession of a firearm by a felon with priors; failure to appear while on bail; carrying a dirk or dagger. A deputy conducted a traffic stop on a vehicle driven by Durrer. Inside the vehi- cle the deputy located a .22 caliber mag- azine. The passenger then gave consent for the deputy to search her residence where the deputy located a rifle belong- ing to Durrer. Durrer was released from custody on bail and failed to appear in court as ordered. Durrer was a passenger in a vehicle that was stopped for a traffic violation. The officer received consent to search and located a fixed blade knife under Durrer's jacket. • Keymia Devour Neal was sentenced to 270 days in Tehama County Jail for possession for sale of a controlled sub- stance. Officers responded to a local motel to conduct a welfare check. Upon contact- ing the occupants inside the room the officers noticed marijuana on a table. As the officers received consent from one of the occupants to search a backpack, Neal fled the room. Neal led the officers on a short chase before being apprehended. Inside the backpack officers located cocaine and ecstasy. • Angelita Virginia Serrano was sen- tenced to 270 days in Tehama County Jail for conspiracy to commit a crime. Serrano opened a fictitious business bank account and wrote out checks to her companions without having sufficient funds in the account to cover the checks. The total amount of checks written totaled over $9,000. • Catriona Mary Davis was sentenced to 180 days in Tehama County Jail for possession of a controlled substance. Davis was originally granted formal probation. She violated her probation when she failed to keep probation informed of her current contact informa- tion and failed to complete her drug treatment program • Ashley Nicole Worley was sentenced to 150 days in Tehama County Jail for possession of a controlled substance, bring drugs into a jail, giving false infor- mation to a police officer; failure to appear while on bail. Agents conducted a search of an area where they believed a wanted parolee may be staying. Inside a motor home investigators located Worley and a parolee along with methamphetamine. Worley was arrested and taken into cus- tody. While at the jail an officer located a glass smoking pipe on Worley's person. Worley failed to appear in court as ordered while out on bail. • James Henry Shriver was sentenced to 120 days in Tehama County Jail for possession of firearm by felon. A deputy responded to Shriver's resi- dence after it was reported he was shoot- ing a firearm from his property. The deputy was advised defendant is a con- victed felon and found him in possession of a firearm. • Jesse Jonathen Dugal was sentenced to 90 days in Tehama County Jail for cul- tivating marijuana. Agents served a search warrant at defendant's residence and located several marijuana plants inside the garage as well as processed marijuana inside the residence. • Trace Benefield was sentenced to 90 days in Tehama County Jail for posses- sion of concentrated cannabis. An agent posted an advertisement online offering to sell a vehicle and stat- ed he is "215 friendly". The agent received a response from Benefield and settled for cash and a pound of marijuana in exchange for the vehicle. Upon arriv- ing at the meeting place to make the transaction Benefield was arrested and taken into custody. • Lorraine Ann Blanton was sentenced to 90 days in Tehama County Jail for transportation of a controlled substance. A deputy noticed Blanton in the park- ing lot of local casino. The deputy made a consensual contact with Blanton and received consent to search her purse. Inside Blanton's purse the deputy located methamphetamine. • Phillip Duane Rushin was sentenced to 60 days in Tehama County Jail for cul- tivating marijuana. During the execution of a search war- rant agents located Rushin at the proper- ty as well as several marijuana plants growing throughout the property. Recent Proposition 36 Commit- ments Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attor- ney's Office contends that each criminal case is unique and that in certain, specif- ic, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. • Diane Lori Quigley was sentenced to Prop. 36 probation (NCR81787) and 60 days in Tehama County Jail (NCR82805) for possession of a controlled substance; possession of a controlled substance, petty theft. NCR81787-Officers responded to Quigley's motel room in regards to a bur- glary. After Quigley and her companion failed to let the officers in the room they obtained a search warrant and conducted a search. Inside the room officers located several items that had been reported stolen as well as a syringe containing Dilaudid which was found on Quigley's person. (NCR82805)-Officers contacted Quigley after it was reported she had stolen several items from a local business and attempted to leave the store without paying for the items. After receiving con- sent officers searched Quigley's purse and located syringes and oxycontin. Upcoming Court Dates -Trials, Pre- liminary Hearings(PX) & Pre Trial Conferences(PTC) • Theresa Marie Lewis aka: Theresa Marie Garcia Lewis will appear in court at 8 a.m. on Feb. 15 in Department 3. She is facing the charges of attempt: willful, deliberate, and premeditated murder, two counts; assault with a deadly weapon, two counts; child abuse(2 counts); Spe- cial Allegations PC1203.075(a)-Great Bodily Injury(Counts 1 & 2), PC12022(b)(1)-Use of Deadly Weapon (All Counts), PC12022.7(a)-Great Bodi- ly Injury (All Counts) Officers responded to defendant's res- idence after they received a report that the 13 year old victim had a cut on his neck. Upon arrival officers began inves- tigating the incident and learned the defendant had given the victim pills and slit his throat in a failed attempt to kill him.
