Wednesday, February 6, 2013 – Daily News 3B COURT ROUND-UP The following defendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: —————— Recent State Prison Commitments • Kevin John Johnston was sentenced to five years and eight months in state prison for possession for sale of a controlled substance with special allegation-prior felony; possession of firearm by a felon; post release community supervision; possession of a controlled substance. Officers conducted a search of Johnston's residence and located a hand gun, methamphetamine and a methamphetamine smoking pipe. Johnston was released from prison on post release community supervision. He violated his terms of supervision when he failed to appear in court as ordered and was terminated from his drug and alcohol treatment program. Johnston was originally granted formal probation. He violated his probation when he failed to appear in court as ordered and failed to complete his drug and alcohol treatment program. • Nathan Darrell Simmons was sentenced to five years and four months in state prison for possession of a billy club, possession of a controlled substance with special allegationprior strike. During a parole search of Simmons' residence officers located marijuana, syringes, methamphetamine and a billy club. • Jonathan Michael Stamper was sentenced to two years and eight months in state prison for first degree residential burglary; unlawful driving or taking of a vehicle. Stamper entered victim's residence and stole about $300 in change. He was observed dri- ving away in victim's vehicle without permission. The vehicle was later located parked in front of Stamper's residence. • Ericka Lynn Bennett was sentenced to two years and eight months in state prison for second degree commercial burglary; possession of a controlled substance. Bennett was originally granted formal probation. She violated her probation when she failed to contact probation, cut off her electronic monitoring device and absconded. • Jose Lopez Hernandez was sentenced to 16 months in state prison for grand theft-person. Hernandez and the victim had been in an argument. Hernandez grabbed the victim's purse as she was pulling away from him. The victim fell to the ground and Hernandez began choking her. Hernandez then dragged the victim across the ground before taking her purse and fleeing the scene. Recent County Jail Commitments • Adrian Contreras Rodriguez was sentenced to 365 days in Tehama County Jail for assault by means likely to produce great bodily injury with special allegation- prior strike; failure to appear while on bail. Rodriguez walked by the victim and punched him in the face. Rodriguez then proceeded to knock victim down, punch and kick him repeatedly. Rodriguez was released from custody on bail and failed to appear in court as ordered. • Whitney Nancy Howard was sentenced to 240 days in Tehama County Jail for DUI causing injury with special allegation-great bodily injury. Officers responded to the scene of a single vehicle accident. Upon arrival officers contacted the occupants of the vehicle and determined Howard was driving the vehicle while under the influence of alcohol. Howard rolled the vehicle causing injuries to the two passengers. • Cassandra Marie Anderson was sentenced to 180 days in Tehama County Jail for possession of a controlled substance; failure to appear on own recognizance; failure to appear while on bail. Anderson was originally granted formal probation on all cases. She violated her probation when she failed to contact probation upon her release from custody. • Eric Paul Mickelson was sentenced to 180 days in Tehama County Jail for vandalism over $400, corporal injury; receiving stolen property. Mickelson was originally granted formal probation. He violated his probation based upon the offense in NCR84696. (NCR84696)-Mickelson became angry, approached the victim and pushed her to the ground by her throat. Mickelson then proceeded to hit the victim on the head with a purse. Deputies served a search warrant at Mickelson's residence and located several stolen items. • Amber Rose Scott was sentenced to 90 days in Tehama County Jail for unlawful sexual intercourse. Scott had sexual relations with the 15 year old victim. • Blake Joshua Hammers was sentenced to 90 days in Tehama County Jail for receiving stolen property. Victim reported her home had been burglarized and a safe containing cash, handguns and prescription medications were taken. Officers responded to Hammers' residence and located two holsters belonging to the victim as well as a prescription pill bottle with the label removed. • Lesli Marie Johnson was sentenced to 90 days in Tehama County Jail for second degree robbery. Johnson was originally granted formal probation. She violated her probation when she was contacted by police after attempting to exit a store with stolen items. • Favio Alberto Gonzalez was sentenced to 90 days in Tehama County Jail for possession of marijuana for sale. Gonzalez was a passenger in a vehicle that was stopped for a traffic violation. During a search of the vehicle the officer located several pounds of marijuana. Upcoming Court Dates Trials, Preliminary Hearings(PX) and Pre Trial Conferences(PTC) • Gary Dean Belcher will appear in court at 1:15 p.m. on Feb. 4 in Dept. 3 for a pretrial conference. He is facing the charges of second degree robbery with special allegation-personal use of a firearm, second degree robbery with special allegation-personal use of a firearm, attempted second degree robbery with special allegation-personal use of a firearm. Belcher entered Bank of America in Corning and demanded money from the teller at gunpoint. The teller filled Belcher's bag with the money she had in her drawer. Belcher then fled the scene before officers arrived. During the course of this investigation officers learned Belcher was also responsible for the pervious robberies that occurred at the Subway restaurant in Corning and the attempted robbery at the Chevron gas station near Rolling Hills Casino. • Dustin Lee Hedrickwill appear in court at 8 a.m. on Feb. 5 in Dept. 2 for a pretrial conference. He is facing the charge of lewd act upon a child, child molesting. Hedrick was a 19-year-old Boy Scout troop leader and both minor victims were Boy Scouts. Hedrick went to a party at one of the victim's homes during which he committed lewd and lascivious acts upon the two victims. • Joseph Dailey Froome & Kellie Mae Froome will appear in court at 9 a.m. on Feb. 8 in Dept. 2 for a preliminary hearing. Joseph Froome is facing the charges of two counts of filing false tax return with special allegation-offense while on bail or O.R., two counts of perjury by declaration with special allegation-offense while on bail or O.R.; and two counts of return or information unfiled with special allegation-offense while on bail or O.R. Kellie Froome is facing the charges of two counts of filing false tax return, two counts of perjury by declaration; and two counts of return or information unfiled. Brief history: Agents from the Franchise Tax Board conducted and investigation into this incident and determined Froome's had a large sum of money that passed through their personal and business accounts but only a portion of that money was reported on their tax returns. • Joseph Dailey Froome & Daniel Miguel Ludwig will appear in court at 9 a.m. on Feb. 8 in Dept. 2 for a pretrial conference. Froome is facing the charges of cultivating marijuana; possession of marijuana for sale and eight counts of money laundering; Ludwigis facing the charges of cultivating marijuana and possession of marijuana for sale. Agents served a search warrant at Froome's warehouse off of Baker Road in Red Bluff. Inside they found over 400 marijuana plants. TIDE agents also located over 30 pounds of processed marijuana. Brown: Texas ads unlikely to sway Calif. companies AUSTIN, Texas (AP) — A radio ad designed to convince California companies to move to Texas has sparked a throwdown between the governors of the two states. Gov. Rick Perry launched a 30-second radio ad on Monday calling on California companies to consider moving to Texas. ''Building a business is tough, but I hear building a business in California is next to impossible,'' Perry says in the ad, which was paid for by a public-private marketing partnership called TexasOne. ''There are plenty of reasons Texas has been named the best state for doing business for eight years running.'' California Gov. Jerry Brown called the radio ads just ''a few tricks from a politician'' and will not have any substantive effect. The Sacramento Bee reported http://bit.ly/TBqA1x that Brown told reporters outside an event in Los Angeles the commercials are unlikely to make a difference because people invest in places where ''big things have occurred.'' The governor says everyone ''with half a brain'' is coming to California, home of Apple, Google and Hollywood studios. He says that includes the British, French, Russians and Chinese. ''So Texas,'' Brown said, ''come on over.'' Perry often brags about Texas' low taxes, industry-friendly regulations and strict limits on lawsuits.
