The fire was quickly con- tained with damage from the fire confined to just the room of origin and contents, said Red Bluff Fire Division Chief Mat- thew Shobash. Initial reports on the scanner indicated the fire started in the living room of the house. Some of the occupants were home at the time the fire started, but all the people inside were able to get out OK, Shobash said. Councilmen Suren Patel and Rob Schmid voted no due to con- cerns over not having direct vot- ing rights on the board. The governing body will be Te- hama County Flood Control and Water Conservation District, while the city will take on an ad- visory role in an 11-member com- mission made up of various agen- cies within the county. The plan will be developed with public input and the pro- cess will be guided by a board of directors, a Groundwater Com- mission and a Technical Advi- sory Committee, said Ryan Teu- bert, manager of the district. The city held a special public meeting Sept. 29 to discuss this proposal by the county. A deci- sion was not made because the vote fell to a 2-2 tie with Coun- cilman Gary Jones absent. RED BLUFF City accepts county proposal on groundwater RED BLUFF The Tehama County Superior Court Wednesday overturned the conviction of Larry Pohlschneider in a child molestation case dating back to 2000. Attorneys for Pohlschnei- der, 46, and the Tehama County District Attorney's Office agreed that his 2000 conviction should be vacated and the charges dis- missed due to the ineffective as- sistance of Pohlschneider's trial counsel. Albert Harris has pleaded guilty to molesting the victims and been imprisoned. Pohlschneider had served 15 years of a 24-year sentence at the California Institution for Men in Chino. A hearing is set for Nov. 12 to determine whether Pohlschnei- der is factually innocent of the charges in the case, said Assis- tant District Attorney Matt Rog- ers. If the court rules him fac- tually innocent, Pohlschnei- der would be eligible to receive funds from the state for the wrongful conviction. Pohlschneider is a client of Santa Clara University School of Law's Northern California Innocence Project. According to a press release issued by the project, Assistant Legal Di- rector Maitreya Badami com- mended the District Attorney's Office for its willingness to look at the case with fresh eyes when presented with evidence from project's investigation. The charges were dismissed based on flawed medical evi- dence and Pohlschneider's attor- ney's failure to investigate and challenge that evidence, the re- lease said. Rogers said Wednesday's rul- ing does not prove Pohlschnei- der is innocent. "The distance between 'yes, he received ineffective counsel' and 'is he factually innocent of the charges' can be great," Rog- ers said. Judge Matt McGlynn presided over Wednesday's hearing and is scheduled to preside over the Nov. 12 hearing. The court ordered Pohlschnei- der's release, and his discharge from Tehama County Jail was expected imminently, the re- lease said. He was not listed as an inmate on the jail's website Thursday afternoon. If the court determines Pohlschneider is not factually innocent of the original charges, it is unlikely he would be tried again due to the age of the case, Rogers said. That has been consistent for the last 20 years of data, which tells me we have a generational prob- lem in Tehama County. The event is a way to say this is not OK in Tehama County. If the community does not stand up in a meaning- ful way, this will continue for an- other 20 years."
