California now joins a growing list of states that treat public business on pri- vate accounts as public re- cords. The ruling came in a law- suit against the city of San Jose. San Jose City Attor- ney Richard Doyle said he was not surprised by the de- cision and did not plan to challenge it. But he said it raised prac- tical challenges for cities and counties. "The question is how do we access those communi- cations on personal devices without the government being overly intrusive," he said. "I don't expect and in- tend to have people turn over their phones." The use of private email accounts by public officials has faced scrutiny in recent years, with accusations that some were using them as a way to avoid disclosure. Jerry Brown, Lt. Gov. Gavin Newsom and other top elected officials in Cali- fornia acknowledged using personal email accounts to conduct government busi- ness. Newsom's office has pre- viously said his personal emails are also searched when considering Public Records Act requests. The state Supreme Court ruling would apply to those officials as well as lower level city, county and state officials and public employ- ees. It does not apply to the state Legislature, which has its own public records pol- icy. "This ruling is a model for giving government transparency laws mean- ing in the digital age," said Matthew Cagle, an attorney at the American Civil Liber- ties Union of Northern Cal- ifornia, which filed a brief in the case. Many state courts and at- torneys general have con- cluded that official com- munications on personal devices are subject to pub- lic disclosure. And at the federal level, an appeals court ruled last year that work-related emails from a private ac- count used by the White House's top science adviser were subject to disclosure under federal open records laws. Opponents have raised privacy concerns and said public officials sometimes need confidentiality to dis- cuss unpopular views. They have also argued that sifting through em- ployees' private accounts and devices in response to requests for records would be expensive and burden- some. San Jose said in court documents that forcing em- ployees to turn over their passwords to inspect com- munications on private de- vices would be akin to mak- ing them hand over their house keys. CALIFORNIA Court:Officials'emailsonprivateaccountsarepublic By Sophia Bollag The Associated Press SACRAMENTO A Cali- fornia State University, Fresno employee was paid an estimated $22,000 for time he was playing on- line games and watching YouTube videos at work, according to a state au- ditor's report released Thursday. The case was one of 10 highlighted in the report on investigations into im- proper activities by state employees during the sec- ond half of last year. The state employees, who were investigated after whistle- blower tips, cost the state nearly $40,000 through misuse of state resources, improper payments and other issues, according to the report. The report also identi- fied instances where state employees improperly dis- closed confidential infor- mation and kept an "inde- fensible" do-not-hire list. Investigators found the Fresno State employee used his work computer to visit nearly 50,000 web pages related to online videos and games over the course of a year. The state auditor's report esti- mated he may have spent 85 hours a month — about half of a typical 160-hour work month — visiting these sites. The employee told a Fresno State investigator that he watched YouTube videos and played online games during "downtime" or after he finished as- signed tasks early. The university recom- mended the employee's supervisor give the em- ployee more work, tell him to limit his Internet use and supervise him more closely. The university did not recommend firing the employee, according to the report. A Fresno State spokes- man did not immediately respond to a request for comment. In another case, two tax technicians at the State Board of Equal- ization improperly re- ferred people to a retired agency employee for pri- vate tax preparation ser- vices. They also gave con- fidential information such as Social Security num- bers and personal phone numbers to that retired employee and others, ac- cording to the report. Both technicians have since left the agency.
