In a decision handed down Dec. 22, the appeals court agreed with Roth's contention there was insufficient evidence to support the convictions. Roth was arrested April 13, 2010 at the Quartzsite Town Council meeting, while waiting for the council to return from an executive session. The appeals court said that, while others in the audience were offended or became agi- tated by Roth's words, the meeting was not disrupted. Roth was convicted on two counts of disorderly conduct in October 2010 in La Paz County Superior Court. He was sentenced to one year on probation. As for Roth's claim his First Amendment rights were violated, the court said that, given they had ruled there was insufficient evidence to uphold a convic- tion, they would not rule on this claim.
