Newton entered a local business where he stole a bottle of alcohol from the shelf, placed it in his waist- band and left the store without pay- ing. The next day Newton entered the same business where he attempted to steal another bottle of alcohol. When the store employee confronted New- ton he denied stealing anything and attempted to leave. The store employ- ee tried to stop Newton at which point Newton removed the bottle of alcohol from his waistband and fled the store. • Levi Daniel Smith was sentenced to three years in state prison for assault by means likely to produce great bodily injury. Officers respond to the parking lot of a local bar where they observed Smith lying on the ground uncon- scious. Officers then contacted the victim in the incident and were advised that Smith and the victim got into an argument which escalated into Smith pulling out a knife and stabbing the victim. The victim then punched Smith in the face knocking him to the ground. • Hector E. Hernandez-Bonilla was sentenced to sixteen months in state prison for driving while having a 0.08 percent or higher blood alcohol. Officers were dispatched to a report of a vehicle in a ditch. As offi- cers were responding to the reported location they observed the vehicle in question approaching them on the roadway. The vehicle appeared to have grass underneath and dirt on the tires. When officers contacted Her- nandez-Bonilla they noticed an odor of alcohol on his breath. Upon ques- tioning defendant about the accident he stated his friend was driving the vehicle at the time and he was only there to pick up the vehicle. Recent County Jail Commitments: • Steve Curtis Vanlent was sen- tenced to 180 days in Tehama County Jail for two counts of receiving stolen property, motor vehicle. The victim reported his quad had been stolen from a locked storage container on his property. After inves- tigating the incident deputies were able to serve a search warrant at Van- lent's home where they contacted defendant. Vanlent stated he and a friend went to the property where they used a chain to open the storage door and steal the quad and a rifle that were located inside. Vanlent also admitted to stealing a pick-up truck which deputies were able to locate near Vanlent 's home. Sentenced to 180 days county jail. • Robert Anthony Sanchez was sentenced to 180 days in Tehama County Jail for forgery; possession of a controlled substance. Officers were dispatched to a local business and were advised Sanchez had attempted to cash a fraudulent money order. Officers then contacted Sanchez and arrested him on several warrants. Upon a search of his person officers located a hypodermic needle and small amount of methampheta- mine. • Jacob John Roleder was sen- tenced to 60 days in Tehama County Jail for corporal injury to spouse/cohabitant/child's parent. Roleder was originally granted for- mal probation. Roleder violated his probation when his urine sample test- ed positive for methamphetamine. • Kristine Wesson was sentenced to 90 days in Tehama County Jail for possession of marijuana for sale. Agents from the drug task force served a search warrant on Wesson's residence and located 46.7 grams of marijuana, digital scales, packaging material and 17.1 grams of cocaine. • Kelly Jean Ranberg was sen- tenced to 90 days in Tehama County Jail for sale or transportation of mari- juana; sale, transportation or offer to sell controlled substance. Ranberg was originally granted formal probation. Ranberg violated her probation when she was caught driving without a valid driver's license, failed to pay fines as ordered by the court and failed a drug test which she tested positive for metham- phetamine and opiates. Recent Proposition 36 Commit- ments: Note: All cases wherein a defen- dant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attor- ney's Office. Per the requirements of Proposition 36, a defendant who pos- sesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defen- dant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attor- ney's Office contends that each crim- inal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sen- tence should properly be imposed.
