The impasse reached Monday in San Francisco hobbles Oracle Corp.'s attempt to extract hundreds of millions of dollars from Google on grounds that the Internet search leader pirat- ed parts of Android from Oracle's Java programming system. Although the jury decid- ed Android infringes on some of Java's copyrights, the five men and seven women on the panel were divided on whether Google's actions were per- missible under ''fair use'' protections of U.S. law. The Published Tuesday, May 8, 2012, in the Daily News, CHAT issues. fair-use provision allows excerpts of copyrighted work to appear in other cre- ative expressions, such as books, movies and comput- er software. With the fair-use ques- tion still dangling, Oracle now appears to have little hope of emerging from the trial with a windfall. Oracle, a business soft- ware maker, had been seek- ing up to $1 billion in dam- ages and a court order that might have forced Google to reprogram Android if a licensing agreement could- n't be worked out. William Alsup advised lawyers on both sides Mon- day that there is ''zero find- ing of copyright liability'' without a fair-use verdict. The jury also found that Android infringes on nine lines of Java coding, but that claim probably won't be worth more than $150,000 U.S. District Judge in damages, based on state- ments made earlier in the trial. When an Oracle lawyer suggested Monday that the infringement verdict on the nine lines could be worth substantially more, Alsup said the idea ''bor- ders on the ridiculous.'' The same jury will decide on damages later. After issuing its partial ver- dict on the copyright claims, the jury began listening to opening arguments in the next round of the trial, cov- ering Oracle's allegations that Android violates two Java patents. Those claims are believed to be worth considerably less than what Oracle might have gotten had it prevailed on all of its allegations of copyright infringement. ''At the end of the day, this looks like more of a vic- tory for Google than it does for Oracle,'' said software analyst Mark Driver of the levels of state and local govern- ment? (Continued from page 1A) Red Bluff Daily News: Why are you running for supervisor again? Burt Bundy: I'm running for supervisor because I feel I can make a difference. Agriculture is tied to water issues and all the residents of Tehama County need water as well as wildlife resources. We need to do everything we can to protect water for the residents of Tehama County. 6:34 Poll: Moto's suspension... Big deal for Giants (29%); They can overcome it (71%). Burt Bundy: have you been up to the past 20 years? Red Bluff Daily News: What Burt Bundy: I continued to farm and I managed a non-profit organi- zation. Burt Bundy: I've been involved in a lot of efforts here in Tehama County such as Farm Bureau, Mill Creek Conservancy, and Shasta Col- lege Ag Advisory Committee. Red Bluff Daily News: What is your opinion on the proposed work farm? Burt Bundy: I think we have a good county team working on devel- oping a solution for those low risk inmates that are being foisted off to us by the state. Burt Bundy: Their plan to create a work farm is a good idea, but I think we need to recognize that it is still a incarceration facility. Burt Bundy: We need to try to rehabilitate those inmates as best we can but it's not going to be easy. Burt Bundy: The idea that they can raise farm products for county use probably isn't feasible. If we can just teach them how to hold down a good job and provide a living for themselves, we'll be fortunate. Red Bluff Daily News: What can be done to help protect the Woodson Bridge State Recreation Area? the river to move back into an old channel at Kopta Slough is a great idea. Finding funding and state and federal support is the hard part. Red Bluff Daily News: What skills do you bring to the position of supervisor? Burt Bundy: I listen. On top of that I think my 12 years as a county supervisor give me some great back- ground for addressing the issues that we have before us. Gartner Inc. Investors seemed to agree. Google shares surged $10.58, or nearly 2 percent, to close Monday at $607.55, while Oracle shares fell 49 cents, or near- ly 2 percent, to finish at $27.92. Android now powers more than 300 million smartphones and tablet computers, with another 6 million people activating the software on a mobile device each week. Google has driven its adoption by giving the software away to manufacturers of phones and tablets — a strategy that would have squeezed its profit margins even more if Java's technology had to be licensed. Oracle's best hope now may be to persuade Alsup himself to issue a judgment concluding Android's reliance on Java isn't pro- tected by fair use. years agriculture has been the main- stay of the economy. We need to develop more jobs through industry and make Tehama County a more attractive place to live. Burt Bundy: I think in four years Tehama County will still be a rural county but hopefully we've made some progress in providing jobs and better services. Red Bluff Daily News: Do you have any ideas that could improve Tehama County tomorrow? Burt Bundy: In county govern- ment, tomorrow is pretty quick. Burt Bundy: The Tehama Coun- ty Public Works Department, through a federal grant, has made some great steps in making Los Molinos more attractive. Burt Bundy: I would also work with local businesses and the Los Molinos Chamber of Commerce to improve the local image. Burt Bundy: I've had a dream Red Bluff Daily News: What for several years to extend natural gas down Highway 99E to Los Molinos to help both businesses and low-income residents save money on their utilities. Red Bluff Daily News: (from DN reader Ann) Do you have any ideas how county departments can run more efficiently? Burt Bundy: We're fortunate that we have great employees and dedicated department heads. I think with the economic times we've got- ten away from the basics and need to look at providing those services, like road maintenance and public safety, first. Burt Bundy: If elected, I would try to encourage our staff to work more closely with citizens to get back to the basics again — roads and public safety. Red Bluff Daily News: What accomplishments do your hang your hat on from your first go-around as a supervisor? Red Bluff Daily News: We have time for just one or two more ques- tions...if you would like to submit one, now's the time. Burt Bundy: I think that three of the main things that I accomplished as a county supervisor, and I have to say it was a full board and not just myself, were the negotiations with Walmart to bring the Distribution Center to Tehama County... Burt Bundy: ... to initiate and develop the groundwater protection ordinance to prevent export of groundwater from Tehama County and to initiate and develop the Los Molinos Community Services Dis- trict to provide a clean, stable source of drinking water to the community. Red Bluff Daily News: Why should someone vote for you? Burt Bundy: I think I'll provide a better understanding of the issues in Tehama County, in the Fifth Dis- trict because I've lived here all my life.
