Specifically, the Board will con- sider establishing a maximum fee per square foot of develop- ment as follows: A. residential development. B. commercial/industrial develop- ment. If adopted, the District's fee for each type of development shall be the lesser of: a) the maxi- mum justified amount pursuant to the Developer Fee Justifica- tion Study dated February 2012, b) the amount provided for pur- suant to agreement with a feed- er district, or c) the maximum amount authorized pursuant to Government Code Section 65995. The total fees levied within any area shall not exceed the maxi- mum amounts currently author- ized pursuant to Government Code Section 65995: A. $1.92 per square foot of $0.51 per square foot of residential development. B. commercial/industrial develop- ment. The proposed fee increase is au- thorized by Education Code Sec- tion 17620 and Government Code sections 65995 and 66001.
