ByJudyLin TheAssociatedPress SACRAMENTO Califor- nia regulators on Friday restored ambitious rules to cut transportation fuel emissions 10 percent within 5 years. The rules further strengthen California's toughest-in-the-nation car- bon emissions standards, but oil producers warn the changes could drive up costs for consumers at the gas pump. The California Air Re- sources Board voted 9-0 to re-adopt its low-carbon fuel standard. The regu- lations have been on hold since 2009 because of a court fight. The board says the change would cost a typical commuter $20 to $24 extra in 2017, increasing to $52 to $56 annually in 2020. The rules require produc- ers to cut the carbon con- tent of fuels 10 percent by 2020 to help the state meet its emission-reductions goals. Environmentalists and some business groups say the plan will encourage greater use of cleaner biofu- els and electric vehicles. Oil producers say it's unwork- able and too costly. "The transportation sec- tor is and will remain the largest source of green- house gases in the state of California but we've made some serious strides and we need to continue to build on those actions," Mary Nich- ols, chairwoman of the board, said before the vote. The move to restore the program is not related to Volkswagen drawing inter- national attention for vio- lating separate federal and state rules that regulate emissions from vehicles. The passage was a boost for Gov. Jerry Brown, who has vowed to intensify his fight against climate change after the oil lobby helped kill a Democratic legislative proposal earlier this month to slash state- wide petroleum use by half in 15 years. Unlike other rules the state has adopted requir- ing cleaner-burning fuel or more fuel-efficient vehi- cles, the standard, first pro- posed in a 2007 executive order from then-Gov. Ar- nold Schwarzenegger, calls for counting all the pollu- tion required to deliver gas- oline, diesel or alternative fuels to in-state consum- ers — from drilling a new oil well or planting corn to delivering it to gas stations. In addition to tailpipe emissions, it includes fac- tors such as whether an ethanol factory uses coal or natural gas to power pro- duction or an oil rig uses diesel fuel to drill. Oil producers say the standard will impact con- sumers in the state with some of the highest gas prices in the nation as the companies try to comply with the mandate or face being shut out of the mar- ket. Supporters say industry can afford to make it work. They believe the program will encourage greater use of cleaner biofuels and elec- tric vehicles, which can be cheaper to operate than those powered by gasoline or diesel. The Western States Pe- troleum Association, which represents oil companies, said there is not enough low-carbon biofuel to allow refiners to comply with the regulations. All fuels are measured against a baseline pollu- tion standard. If a fuel falls above or below the baseline, it generates a credit or defi- cit that other producers can buy and sell to meet the tar- get. Two Ne- vada counties and some mining companies want a court to block new restric- tions on mining, energy development and grazing that are meant to protect a declining bird species across millions of acres of the American West. The case appears to be the first challenge to the Interior Department's declaration this week that it can protect the greater sage grouse without hob- bling the region's economy. The lawsuit filed in U.S. District Court targets newly signed federal land- use plans covering por- tions of Nevada, Montana, Idaho, California, Utah and Oregon. It has impli- cations across the bird's 11-state range. To help the grouse, Inte- rior officials want to with- draw 10 million acres from future mining claims, pro- hibit oil and gas drilling near breeding grounds and impose new reviews on grazing permits. Those steps to limit dis- turbance of the sagebrush expanses where the bird is found were a key factor in the Interior Department's decision not to grant En- dangered Species Act pro- tection to the species. But critics from the min- ing, oil and gas industries contendthattherestrictions imposedinplaceofathreat- ened or endangered find- ing for the bird are equally onerous. The Nevada lawsuit, filed Wednesday in Reno, warns of the "total de- struction of certain busi- nesses" if the land-use plans are allowed to stand.
