LEGAL NOTICE ORDINANCE NO. 1999 AN URGENCY ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF TEHAMA EXTENDING ORDINANCE NUMBER 1997 AND TEMPORARILY PROHIBITING THE ESTABLISHMENT OR EXPANSION OF POULTRY FARMS WHICH KEEP, FEED, OR MAINTAIN MORE THAN 3,000 CHICKENS, POULTRY, OR OTHER FOWL ON THE PREM- ISES IN ALL ZONING DISTRICTS WITHOUT A USE PERMIT THE BOARD OF SUPERVISORS OF THE COUNTY OF TEHAMA OR- DAINS AS FOLLOWS: SECTION 1. This ordi- nance extending an interim ur- gency ordinance is adopted pur- suant to California Constitution, article XI, section 7 and Govern- ment Code section 65858. SECTION 2. The Board of Supervisors of the County of Tehama, by four-fifths vote, hereby finds and declares the following: (A) Protection of the, health, safety, general welfare, and rural lifestyle of the Citizens of Tehama County requires maintaining agriculture as a pri- mary industry in Tehama County and ensuring overall compatibil- ity in land uses of properties. (B) The Prevention of Farm Animals Cruelty Act of 2008 (Proposition 2) amended Divi- sion 20 of The California Health and Safety Code, is a voter passed initiative the provisions of which take effect January 1, 2015. The Act imposes criminal penalties for confining certain types of animals by preventing such animals from being able to turn around fully, lie down, stand up, and extend their limbs fully while encaged. (C) The existing Tehama County Zoning Ordinance allows for the keeping and feeding of chickens, poultry, or other fowl in the amount of 100 such ani- mals per acre, in addition to brooding stock, on parcels less than five acres as a matter of right in many zoning districts, and without any discretionary review. (D) In part as a result of Proposition 2, the Tehama Coun- ty Planning and Building depart- ments have recently experi- enced a rise in applications for support buildings to house and maintain chickens for the pur- pose of commercial egg hatch- ing and sales on parcels of less than five acres. (E) Maintaining chickens, poultry, or other fowl in the quantities currently allowed as a matter of right in certain zones presents a risk of poten- tially significant environmental impacts which are not currently being analyzed or mitigated un- der the existing ordinance and poses an immediate risk to the health safety and general wel- fare of the citizens of Tehama County. (F) Large scale commercial operations involving the hatch- ing, breeding, or keeping of chickens, poultry, or other fowl, and buildings in support thereof, within certain zones may not be compatible with the uses of ad- jacent lands and poses an im- mediate risk to the health, safe- ty and general welfare of the citizens of Tehama County. (G) On January 6, 2015, the Board of Supervisors of the County of Tehama adopted Ordi- nance No. 1997 temporarily pro- hibiting the establishment or ex- pansion of poultry farms which keep, feed, or maintain more than 3,000 chickens, poultry, or other fowl on the premises in all zoning districts without a use permit, which will expire on Feb- ruary 20, 2015, unless further ex- tended as provided by law. SECTION 3. In order to protect the public health, safety, and welfare of the residents of the County of Tehama from a cur- rent and immediate threat, Ordi- nance No. 1997 is hereby extend- ed for ten (10) months and fif- teen (15) days in accordance with Government Code section 65858, subdivision (a). SECTION 4. Section 17.08.080 of the Tehama County Code, as added by Ordinance No. 1997, is hereby amended to read: 17.08.080 Interim Prohibition of Chicken, Poultry, Or Other Fowl Farms Without a Use Permit. (a) Pursuant to Govern- ment Code section 65858, and notwithstanding any other pro- vision of this Code, the estab- lishment, location, installation, expansion, modification, devel- opment, or construction of any farm devoted to the hatching, raising, butchering or marketing of chickens, poultry, other fowl, or the eggs thereof, which keep, feed, or maintain more than 3,000 such animals on the prem- ises, in an all zoning districts, without a use permit issued in accordance with Chapter 17.70, is hereby prohibited. (b) For purposes of this sec- tion "premises" shall mean a single, legal parcel of real prop- erty that may be separately sold in compliance with the Subdivi- sion Map Act (Division 2 (com- mencing with Section 66410) of Title 7 of the Government Code), provided that where contiguous legal parcels are under common ownership or control, such con- tiguous legal parcels shall be counted as a single "premises" for purposes of this chapter. (c) This section shall not prohibit completion of construc- tion of any building or structure for which a building permit was issued prior to the date of adop- tion of the Ordinance enacting this Section, provided that any modification or expansion of such building must comply with subdivision (a). (d) The Board of Supervi- sors hereby directs the Planning Department, in consultation with the County Counsel, Direc- tor of Environmental Health, and Agricultural Commissioner, to consider and study possible means of regulating the lands uses described in subdivision (a), including zoning regulations and other regulations. (e) This Section shall be in effect until the earlier of the following, and shall there- upon be repealed and of no fur- ther force or effect: (i) The completion of study, evaluation, considera- tion, and legislative action upon the proposed regulations refer- tion, legislative upon the proposed regulations refer- red to in Subdivision (c) of this Section, designated as such by the Board of Supervisors; or (ii) 1 0 months and 15 days from Febru- ary 20, 2015, unless this Ordi- nance is extended in the manner provided in Government Code section 65858. SECTION 5. This Ordinance is an urgency ordinance necessary for the immediate preservation of the public peace, health, and safety. Pursuant to Government Code section 25123, subdivision (d), this ordinance shall take ef- fect immediately upon adoption by four-fifths of the Board of Su- pervisors, and prior to the expi- ration of fifteen (15) days from the adoption thereof shall be published at least one time in the Red Bluff Daily News, a newspaper of general circula- tion in Tehama County.
