THE PETITION FOR PROBATE re- quests that RONALD RAY GIBBENS be appointed as per- sonal representative to adminis- ter the estate of the decedent. The petition requests the decedent¹s will and codicils, if any, be admitted to probate. The will and any codicils are availa- ble for examination in the file kept by the court. The inde- pendent administration authori- ty will be granted unless an in- terested person files an objec- tion to the petition and shows good cause why the court should not grant the authority. Other Cali- fornia statutes and legal author- ity may affect your rights as a creditor. You may want to con- sult with an attorney knowl- edgeable in California law. The street address and oth- er common designation, if any, of the real property described above is purported to be: 18805 TABITHA CT, COTTONWOOD, CA 96022-8546 The undersigned Trustee disclaims any liability for any incorrectness of the street address and other com- mon designation, if any, shown herein. Said sale will be made without covenant or warranty, express or implied, regarding ti- tle, possession, or encumbran- ces, to pay the remaining princi- pal sum of the Note(s) secured by said Deed of Trust, with inter- est thereon, as provided in said Note(s), advances if any, under the terms of the Deed of Trust, estimated fees, charges and ex- penses of the Trustee and of the trusts created by said Deed of Trust. The total amount of the unpaid balance of the obliga- tions secured by the property to be sold and reasonable estimat- ed costs, expenses and advan- ces at the time of the initial pub- lication of this Notice of Trust- ee's Sale is estimated to be $346,410.25 (Estimated). The property offered for sale excludes all funds held on account by the property receiver, if applicable. If the Trustee is unable to con- vey title for any reason, the suc- cessful bidder's sole and exclu- sive remedy shall be the return of monies paid to the Trustee and the successful bidder shall have no further recourse. Notice to Potential Bidders If you are considering bidding on this property lien, you should under- stand that there are risks in- volved in bidding at a Trustee auction. You will be bidding on a lien, not on the property itself. Placing the highest bid at a Trustee auction does not auto- matically entitle you to free and clear ownership of the property. You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, be- fore you can receive clear title to the property. You are encour- aged to investigate the exis- tence, priority, and size of out- standing liens that may exist on this property by contacting the county recorder's office or a ti- tle insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same Lender may hold more than one mortgage or Deed of Trust on the property. Notice to Property Owner The sale date shown on this Notice of Sale may be post- poned one or more times by the Mortgagee, Beneficiary, Trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that in- formation about Trustee Sale postponements be made availa- ble to you and to the public, as a courtesy to those not present at the sale. The purpose of the proposed action is to improve upstream and downstream passage conditions for Chinook salmon, steelhead and other aquatic fish and wild- life species. The siphon and fish passage structures adjacent to diversion dams are concrete structures that currently inhibit the movement of salmon and steelhead into the upper water- shed. The proposed action has been developed in cooperation with the willing land/facility owners and involves the remov- al and replacement of the exist- ing siphon and fish passage structures along with several site improvements to meet the landowner's water and power needs. The project is located in sections 1-3, Township 25 North, Range 2 West MDBM, within the 7.5-minute USGS Los Molinos quadrangle. For the environ- mental analysis, the USFWS is seeking public input to assist them in identifying issues re- garding the proposed project.
