Thefollowingdefendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: RecentState/Local Prison Commitments: People vs. Joshua William Webb, Assault by Means Likely to Produce Great Bodily Injury, Battery Upon a Peace Officer and Designated Persons (2 counts)-Battery. Brief history: Defendant was originally granted f o r m a l p r o b a t i o n . Defendant violated his probation when he was arrested for driving under the influence, driving on a suspended license and resisting arrest. Sentenced to 2 years State Prison. Recent County Jail Commitments: People vs. Viviana S o l o r i o F a r i a s , Embezzlement by Public or Private Officer. Brief history: Defendant was an employee at a local business and was caught giv ing unauthorized discounts to certain individuals. Sentenced to 180 days county jail. People vs. Kenneth Eugene Malloy, Corporal Injury to Cohabitant with Special Allegation Use of Deadly Weapon. Brief history: Defendant and victim had been in an argument when the defendant began stomping on the victim's head. The defendant also grabbed a knife and poked the victim in the arm. Sentenced to 180 days county jail. People vs. Katherine Elizabeth Colston, Sale of a Controlled Substance (2 counts), Maintaining Place For Selling or Using Controlled Substance, Transportation of a Controlled Substance; Possession For Sale of a Controlled Substance, Maintaining Place For Selling or Using Controlled Substance. Brief history: During undercover drug buys the defendant sold m e t h a m p h e t a m i n e . The drug sales were monitored and recorded by T.I.D.E. agents. Agents conducted a search warrant at defendant's residence and located methamphetamine and packaging material. Sentenced to 120 days county jail. People vs. Amanda Lee Valentine, Resisting Executive Officer. Brief history: Officers received a report of a vehicle driving erratically. When officers responded to the location they located the vehicle abandoned with a flat tire. Officers were advised defendant wa s the reg istered owner of the vehicle and subsequently contacted her at her residence. Upon contacting the defendant she appeared to be under the influence of alcohol. D e f e n d a n t b e c a m e combative with officers and punched one of them in the face. Defendant was arrested and taken into custody. Sentenced to 120 days county jail. People vs. Donald N i c h o l a s W h a t l e y, Violation of Parole. Brief history: Defendant was released from prison and placed on parole. Defendant violated the terms of his parole when he failed to keep his GPS monitoring device charged and allowed it to become disabled. Sentenced to 90 days county jail. People vs. Hanoa Kaonohiokala Nahinu, Failure to Appear on Own Recognizance. Brief history: Defendant was released from custody and failed to appear in court as ordered. Sentenced to 90 days county jail. People vs. Ja son Matthew Ramey, Failure to Appear While on Bail. Brief history: Defendant was released from custody on bail and failed to appear in court as ordered. Sentenced to 90 days county jail. People vs. Rosie Marie Lander, Bring Contraband into the Jail. Brief history: Officers contacted defendant and found her in possession of methamphetamine. Defendant was arrested and taken into custody. While at the jail officers f o u n d a d d i t i o n a l methamphetamine in defendant's possession. Sentenced to 90 days county jail. People vs. Erik Ras Searcy, Failure to Appear on Own Recognizance. Brief history: Defendant was released from custody on his own recognizance and failed to appear in court as ordered. Sentenced to 60 days county jail. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probat ion v iolat ion may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. People vs. Ryan Allen Blankenship, Possession of a Controlled Substance. Brief history: A deputy observed the defendant outside of a business in the early morning hours. The deputy made contact with the defendant and conducted a consent search of his person. Inside defendant's pocket the deputy located m e t h a m p h e t a m i n e , marijuana and prescription pills. Defendant sentenced to Prop. 36 probation. People vs. Hanoa Kaonohiokala Nahinu, Possession of a Controlled Substance. Brief history: An officer contacted defendant after he was observed riding a bicycle at night without proper lighting. The officer conducted a search of defendant and found him in possession of methamphetamine. Defendant sentenced to Prop. 36 probation. People vs. Claudia M a r q u e z R a m o s , Transportation of a Controlled Substance; Possession of a Controlled Substance. Brief history: Defendant was originally granted f o r m a l p r o b a t i o n . Defendant violated her probation when she was found in possession of methamphetamine. O f f ic er s c ont a c t e d defendant and arrested her on outstanding warrants. Officers conducted a search of defendant's person and located methamphetamine. Defendant sentenced to Prop. 36 probation. Upcoming Court Dates -Trials, Preliminary Hearings (PX) & Pre Trial Conferences (PTC): People vs. Christopher Hougland, Murder with Special Allegation Use of Deadly Weapon, Assault With a Deadly Weapon with Special Allegation — Great Bodily Injury. Brief history: Officers responded to a residence regarding a disturbance. Upon arrival officers located the victim who appeared to have several stab wounds and was bleed in g prof usely. The victim eventually succumbed to his injuries and was pronounced dead at the scene. The defendant was arrested and taken into custody. PTC: June 27, at 11 a.m. in Department 2. TBJ: July 9, at 1:30 p.m. (Department to be determined) People vs. Roger Sandy Bounnhaseng, Alan Duane Doulphus Jr., Chase Alan Doulphus: Murder, special allegation felony murder, personal and intentional, use of a firearm, assault with a firearm, false i m p r i s o n m e n t b y violence, transportation of marijuana. Brief history: The defendants went to a residence that contained a marijuana grow. The defendants confronted the victim and two other men who were at the residence and ordered them to the ground at gunpoint. The defendants proceeded to tie up the victim and the two men with zip ties and duct tape. The victim was able to free himself and attempt to flee the residence but was shot several times by the armed defendants. The victim eventually succumbed to his injuries. Defendant's vehicle was located a short time later and a vehicle pursuit followed. Defendant's were eventually apprehended and taken into custody. Inside the vehicle officers located a large amount of marijuana. People vs. Quentin Ray Bealer, Murder. Brief history: Defendant was arrested and charged with the murder of a 14 year old victim who had been reported missing when she never returned home from school. Officers located the victim's body two days later. Motions: July 7, at 8 a.m. in Department 3. People vs. Jessie Lee Robison, Murder with Special Allegations Use of Deadly Weapon, Prior Felony, Prior Strike, Prior Serious Felony. Brief history: Defendant and victim had been f ighting when the defendant pulled out a knife and stabbed the victim. The victim later died as a result of his injuries. Setting: July 8, at 8 a.m. in Department 3. People vs. Tyler Allen Bu r r one , Veh ic u la r Manslaughter, Involuntary Manslaughter. Brief history: Defendant was driving his vehicle down the highway and failed to notice that the victim's vehicle had stopped in front of him and was attempting to make a left turn. Defendant rear ended the victim's vehicle and forced it into the path of an oncoming semi truck. The five year old victim inside the vehicle received fatal injuries as a result of the crash and the child's mother was seriously injured. Setting: Aug. 6, at 9 a.m. in Department 4 People vs. Brandon Ericson Branscombe, Murder, Assault on a Child Causing Death. Brief history: The 8 month old victim died as a result of injuries sustained while in the custody and care of defendant. PTC: Aug. 29, at 11 a.m. in Department 2.
