Brief history: Defendant was driving her vehicle with a minor child when she ran into the back of another vehicle while under the influence of a controlled substance. Officers conducted a search of defendant's purse and located methamphetamine, syringes and prescription pills. Sentenced to 9 years 4 months State Prison. People vs. Scott William Festag, Transportation of a Controlled Substance; Receiving Stolen Property; Possession of a Controlled Substance, Possession of Firearm by a Felon. Brief history: An officer conducted a traffic stop on a vehicle driven by defendant. The officer conducted a consent search and located methadone pills and a hydrocodone pill inside the vehicle. An officer conducted a traffic stop on a vehicle driven by defendant. An officer's K9 alerted on the vehicle and a search was conducted. Inside the vehicle the officer located methamphetamine, bank cards, tax information, social security numbers and other miscellaneous items belonging to random people. Officers responded to a business regarding an alarm sounding and the defendant was seen standing nearby. The officer contacted defendant and located a handgun in his waistband as well as methamphetamine and syringes in his vehicle. Sentenced to 5 years State Prison. People vs. Ricky James Candler, Receiving Stolen Property with Special Allegation, Prior Strike; Post Release Community Supervision. Brief history: A deputy spotted defendant on the streets and knew he had a warrant out for his arrest. When the deputy attempted to contact the defendant he fled on foot. As the defendant was fleeing he dropped a backpack containing stolen property. Defendant was released from prison to post release community supervision. Defendant violated his terms of supervision when he was arrested for criminal violations. Sentenced to 4 years State Prison. People vs. Andrew Christopher Mitchell, Evading an Officer, Willful Disregard. Brief history: A deputy conducted a traffic stop on a vehicle driven by defendant. As the deputy approached the vehicle on foot the defendant sped away in his vehicle. A vehicle pursuit ensued during which the defendant drove at a high rate of speed, running stop lights and weaving in and out of traffic. Defendant eventually crashed his vehicle and took off on foot. The next day the officers were able to locate the defendant and get him into custody. Sentenced to 2 years State Prison People vs. Cliff Rocky Rhoads, Driving While Having a 0.08% or Higher Blood Alcohol-With Prior. Brief history: An officer conducted a traffic stop on a vehicle driven by defendant. Upon contacting the defendant the officer observed the odor of alcohol on defendant's breath. After failing a series of field sobriety tests defendant was taken into custody. Sentenced to 16 months State Prison. Recent County Jail Commitments: People vs. Aaron Matthew Perry, Post Release Community Supervision. Brief history: Defendant was released from prison to post release community supervision. Defendant violated his terms of supervision when he tested positive for methamphetamine and opiates. Sentenced to 180 days county jail. People vs. Sterling Joshua Glenn, DUI Causing Injury with Special Allegation, Great Bodily Injury. Brief history: Officers responded to the scene of a single vehicle accident. Upon arrival officers learned defendant crashed his vehicle into a tree causing injury to his passenger. Defendant failed a series of field sobriety tests and was taken into custody. Sentenced to 160 days county jail. People vs. Julian Farias Barragan, Cultivating Marijuana. Brief history: Agents served a search warrant on a property. Upon arrival, agents located defendant and several other individuals attempting to flee the area but were quickly apprehended. The property contained numerous growing marijuana plants. Sentenced to 120 days county jail. People vs. Jose Luis Ramos, Maintaining Place For Selling or Using Controlled Substance. Brief history: An officer conducted a traffic stop on a vehicle driven by defendant. Upon contacting the defendant the officer observed the odor of marijuana emitting from the vehicle. A search was conducted and officers located several bags of marijuana in the vehicle. Sentenced to 120 days county jail. People vs. Ashley Elizabeth Lakey, Second Degree Commercial Burglary. Brief history: Defendant entered a store and attempted to cash a fraudulent check. Sentenced to 120 days county jail. People vs. Katharine Ann Oliver, Possession of a Controlled Substance, Receiving Stolen Property; Failure to Appear on Own Recognizance. Brief history: A deputy conducted a traffic stop on a vehicle driven by defendant. During a search of the vehicle the deputy located methamphetamine and checks belonging to random people. Defendant was released from custody on her own recognizance and failed to appear in court as required. Sentenced to 90 days county jail. People vs. Albert Charles Kirkman, DUI Causing Injury. Brief history: Defendant was driving his vehicle while intoxicated and crashed into a light pole causing injuries to his passenger. Defendant attempted to flee the scene on foot but was apprehended after a brief chase. Sentenced to 90 days county jail. People vs. Beatrice Marie Serrato, Transportation of a Controlled Substance with Special Allegation Prior Felony. Brief history: Defendant was originally granted formal probation. Defendant violated her probation when she left the state without permission. Sentenced to 60 days county jail. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. People vs. Robert Warren Gurwell, Possession of a Controlled Substance. Brief history: A deputy conducted a traffic stop on a vehicle driven by defendant. During a search of the vehicle the deputy located marijuana and methamphetamine. Defendant sentenced to Prop. 36 probation. People vs. John Bruce Thornhill, Possession of a Controlled Substance. Brief history: Officers responded to a business after it was reported drug paraphernalia was found in defendant's work locker. Officer's conducted a search of the locker and located methamphetamine and a methamphetamine pipe. Defendant sentenced to Prop. 36 probation. Brief history: The 8 month old victim died as a result of injuries sustained while in the custody and care of defendant. Setting: October 16 at 8 a.m. in Department 3. People vs. Daniel Llamas & Isabelle Deanna Rios, Child Abuse with Special Allegation-Willful Harm or Injury Resulting in Death. Brief history: The 13-month-old victim died as a result of injuries sustained while in the custody and care of Llamas and Rios. PTC: October 21 at 1:15 p.m. in Department 3. People vs. Quentin Ray Bealer, Murder. Brief history: Defendant was arrested and charged with the murder of a 14-year-old victim who had been reported missing when she never returned home from school. Officers located the victim's body two days later. Preliminary Hearing: October 24 at 8:30 a.m. in Department 3. SF-area transit strike averted — at least for day OAKLAND (AP) — San Francisco Bay Area commuters faced another day of uncertainty Monday as a major regional transit agency and two of its largest unions held talks under the ever-present threat of a strike. ''I am so frustrated with the way they've been holding the riders hostage,'' said commuter Toba Villatore, 45, of San Francisco as she headed to work. ''I'm tired of staying up until midnight wondering if there's going to be a strike or not.'' Representatives of Bay Area Rapid Transit and the Amalgamated Transit Union Local 1555 and the Service Employees International Union Local 1021 resumed negotiations Monday afternoon only hours after tense negotiations ended around 3 a.m. The overnight talks came after the union backed off a threatened midnight strike deadline, giving management a 24-hour reprieve from what would have been the second strike in more than three months. Trains were running as usual Monday. Sticking points in the 6month-old negotiations include salaries and workers' contributions to their health and pension plans. BART General Manager Grace Crunican said Sunday that the ''last best and final offer'' presented to the unions then was $7 million higher than Friday's proposal. It includes an annual 3 percent raise over four years and requires workers to contribute 4 percent toward their pension and 9.5 percent toward medical benefits. Workers from the two unions, which represent more than 2,300 mechanics, custodians, station agents, train operators and clerical staff, now average about $71,000 in base salary and $11,000 in overtime annually, the transit agency said. BART workers currently pay $92 a month for health care and contribute nothing toward their pensions. Josie Mooney, a chief negotiator for SEIU, said before Monday discussions that the parties are about $16 million apart over four years. ''It doesn't make any sense to issue a last, best and final offer that they knew in advance that we would not be able to accept,'' Mooney said. ''Effectively, their offer is pretty much the same as it has been for the last 60 days.'' Crunican said the unions have two weeks from Sunday to accept the deal before it is taken off the table. ''It is time to bring this to a close. The Bay Area is tired of going to bed at night and not knowing if BART is going to be open or not,'' Crunican said.
