4B – Daily News – Friday, April 2, 2010 COURT ROUND-UP The following defendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attor- ney’s Office: —————— Recent State Prison Commit- ments: • Michael Rene Martinez was sentenced to 25 years, eight months in state prison for attempt: murder with a special allegation, personal and intentional discharge of a firearm causing great bodily injury; kidnapping with special allegation; assault with a semiau- tomatic firearm; false imprison- ment by violence; criminal threats. Martinez believed the victim, and perhaps others, had stolen his marijuana. Martinez tricked the victim into getting into his van. Once the victim was in the van, Martinez became argu- mentative and combative and demanded the return of his mari- juana. The victim denied that he had stolen or had Martinez’s mar- ijuana and demanded to be let out. Martinez refuses to stop the van. Martinez fired one shot into the van in victim’s direction. Victim again denied any knowledge about the defendant’s marijuana. Faced with further hostility from Martinez, the victim attempted to escape through the back window. As the victim was trying to leave the moving van, Martinez fired several more shots, hitting the vic- tim who was later located on the roadside. • James Gregory Garcia was sentenced to three years in state prison for evading an officer, will- ful disregard. Officers tried to make a traffic stop on a motorcycle driven by the Garcia. When Garcia failed to stop officers pursued him to speeds up to 125 miles per hour until Garcia crashed his motorcy- cle and was taken into custody by officers. • Omar Saligan was sentenced to three years in state prison for evading an officer, willful disre- gard. Officers tried to make a traffic stop on a vehicle driven by Saligan after he was observed traveling at a high rate of speed. As the officer exited his vehicle Saligan sped away. The officer pursued Saligan until he stopped his vehicle and fled on foot. Offi- cers chased Saligan and tased him when he tried to jump over a fence. As Saligan fell to the ground the electrical connection broke and the defendant jumped back up and fled again. Saligan was eventually found hiding in trash can and taken into custody. • Matthew Lyle Milliman was sentenced to two years in state prison for receiving stolen proper- ty. Milliman was originally grant- ed formal probation. Milliman violated his probation when he failed to report to probation after being released from custody. Mil- liman also submitted a urine sam- ple which tested positive for mari- juana. • Andrew Jon Blankenship was sentenced to two years in state prison for failure to update regis- tration annually. Blankenship is a registered sex offender who failed to update his annual registration within five days of his birthday. • Scott Trevor Heninger was sentenced to two years in state prison for possession of stolen property. Heninger was originally grant- ed formal probation. Heninger violated his probation when a pro- bation search of Heninger’s per- son revealed methamphetamine and a methamphetamine pipe. Recent County Jail Commit- ments: • Adrienne Jeannette Blake was sentenced to 365 days in Tehama County Jail for posses- sion of a controlled substance. Blake was originally granted formal probation. Blake violated her probation when she tested positive for methampheta- mine six times during her prenatal checkups at St. Elizabeth Hospi- tal. • Bent Kenneth Larsen was sentenced to 180 days in Tehama County Jail for grand theft of per- sonal property. Larsen stole a guitar from the apartment of a mentally disabled man he had just met. Larsen then pawned the guitar and used the money he received to buy methamphetamine. Cory Richard Graves was sen- tenced to 180 days in Tehama County Jail for possession of a stolen vehicle. Graves was originally granted formal probation. Graves violated his probation when he failed to appear for scheduled office visits and submit monthly reports to probation. • Barbara Jean Graves was sen- tenced to 180 days in Tehama County Jail for sale, transportation or offer to sell controlled sub- stance; sale of a controlled sub- stance. This case was part of the "Black Ice" drug buy program. During an undercover drug buy, Graves sold methamphetamine. The drug sale was monitored and recorded by T.I.D.E. agents. • Jonathan Prentice Brown was sentenced to 348 days in Tehama County Jail for possession of a controlled substance. Brown was originally granted formal probation. Brown violated his probation when he failed to complete drug and alcohol coun- seling as ordered. • Michael Ray West was sen- tenced to 180 days in Tehama County Jail for unlawful firearm activity Deputies were dispatched to a residence in Corning regarding a verbal disturbance. Upon arrival deputies were advised West had been standing in front of the vic- tim’s residence yelling obscenities and threatening everyone inside. West eventually fled the area after he was told someone had called 911. When deputies located West they searched his residence and located a shotgun in the bathroom. • John Crawford Farmer was sentenced to 182 days in Tehama County Jail for failure to file a change of address. Farmer is a registered sex offender who failed to update his registration when he moved out of state. • Thomas Leon High Jr. was sentenced to 120 days in Tehama County Jail for leaving the scene of an accident. The victim was a passenger in a vehicle driven by High. High was driving on Hogsback Road when he lost control of his vehicle and it rolled over. The victim was not wearing a seat belt and was thrown from the vehicle. High then ran to a nearby residence to get help. After notifying a woman at the residence of the accident, High fled and did not return to the scene. • Jessica Ann Segee was sen- tenced to 30 days in Tehama County Jail for possession for sale of a controlled substance. Segee was originally granted formal probation. Segee violated her probation when she submitted a urine sample that test- ed positive for methadone and marijuana. Recent Proposition 36 Com- mitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confine- ment time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non- drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney’s Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive crimi- nal record and/or a history of non- compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. • Terri Monroe Ison was sen- tence d to Prop. 36 probation for possession of a controlled sub- stance. Ison was originally granted for- mal probation. Ison violated his probation when he was terminated from the proposition 36 treatment program. Preliminary Hearings (PX) and Trials: • Susan Amelia Childs will appear in court at 9 a.m. on April 6 facing a charge of murder. Childs and victim were arguing inside their residence when Childs grabbed a knife and stabbed the victim in the lower abdominal region. Officers conducted a brief search of the area and located Childs hiding in the brush a short distance from the residence. Offi- cers were unable to revive the vic- tim who was pronounced dead at the scene.
