"The way the facts are and what's known, he has the lib- erty to play in the game," Har- baugh said. Santa Clara County prose- cutors have yet to file a crimi- nal complaint against McDon- ald, who was arrested during a party at his San Jose home at 2:48 a.m. Sunday after police discovered "visible injuries" on McDonald's fiancée. Harbaugh, general man- ager Trent Baalke and NFL commissioner Roger Goodell stated earlier in the week that McDonald's right to due pro- cess would be observed before any potential discipline. McDonald, the 49ers' start- ing left defensive tackle since 2011, practiced all week amid a cloud of uncertainty whether he would be allowed to play in the season opener against the host Cowboys. Unwilling to declare Mc- Donald's game-day status ear- lier in the week, Harbaugh again got asked Friday if he would play. "Yes. As it stands now, yes," Har- baugh replied. During that time, Tuck became known as a fierce pass rushing de- fensive end, getting 60½ sacks. Tuck was an All-Pro twice and led the Giants to two Super Bowl titles. But when the 31-year-old Tuck went into free agency in Febru- ary, the Giants were content to let Tuck go. He signed a two-year contract with the Oakland Raid- ers. It's a coincidence that Tuck's first game in his post-Giants ca- reer would be held at MetLife Sta- dium — also the home of the New York Jets. It represents a homecoming — of sorts — for Tuck, who still has a family home in New Jersey. "It's cool, but for me person- ally, it's not like we're playing the Giants," said Tuck, during a spir- ited 90-minute Raiders practice at Caven Point Cochrane Stadium. "It's going to be exciting for me, going back to MetLife Stadium," said Tuck, who had 11 sacks and 63 tackles for the Giants last sea- son. "It is what it is. Raiders coach Dennis Allen said that he was "very confident" and he has inspired players to play and compete hard, despite having obstacles from the start. The travel plans were a little different, but I wanted our guys to have a focus."
