BLM seeks members for resource council The Bureau of Land Management is seeking northwest California residents interested in natural resource conservation to fill two seats on its North- west California Resource Advisory Council. Both vacancies are in membership category one that includes commercial recreation interests, off- highway vehicle users, federal grazing permit hold- ers, timber industry representatives, energy and mineral industry representatives and people inter- ested in transportation and rights of way across public lands. Vacancies are for terms that expire in September 2010 and September 2011. Those selected will be eligible to seek appointment to full three-year terms. Nominations should be sent to Bureau of Land Management, 2950 Riverside Drive, Susanville, CA 96130, attention: RAC vacancies, and must be received by Thursday, April 8. Nominations can be submitted by groups or individuals. They must include a completed nomi- nation form and a letter of support for the applicant. Forms are available by calling 530 252-5332, or by email at jfontana@blm.gov. The 12-member council works closely with BLM managers in Arcata, Redding and Ukiah, advising on the full range of the agency’s natural resource management responsibilities. Members represent public land interests and meet quarterly. Court Round-Up The following defendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney’s Office: —————— Recent State Prison Commitments: • Curtis Lyndon Arnold was sentenced to 10 years in state prison for sale of a controlled substance with special allega- tion prior strike and two prior felonies. This case was part of the "Black Ice" drug buy program. During an undercover drug buy, Arnold delivered 0.3 grams of methamphetamine to a confidential informant. The drug sale was monitored and recorded by T.I.D.E. agents. • Honey Rose Nichols was sentenced to five years in state prison for two counts of transportation of a controlled sub- stance with special allegation prior felony. Nichols was a passenger in a vehicle stopped for a vehi- cle code violation. When contacted by officers Nichols gave two fictitious names. After officers obtained her real identi- ty they were advised she had a warrant out for her arrest. Upon a search of Nichols’ person officers located 2.2 grams of methamphetamine. • Jason Allen Pope was sentenced to three years in state prison for evading an officer, willful disregard. Officers drove passed a vehicle and recognized the driver as being a wanted parolee. Officers then attempted to catch up with the vehicle when it sped away with speeds up to 60 miles per hour in a residential area. The officers pursued the vehicle until it crashed into a fence. Pope then fled the vehi- cle on foot and, after a short chase, was caught by officers. • Anthony Ramon Delgado was sentenced to three years in state prison for receiving stolen property. The victim reported he had left his jacket with the keys to his vehicle on a bench in the lobby of a local business. The victim then left for a brief moment and upon returning he noticed the jacket and his vehicle were missing. The vehicle was later found abandoned outside of town. After an inves- tigation into the incident officers were able to obtain a search warrant for Delgado’s residence where they located several items belonging to the victim. • Christopher Steven Pemberton was sentenced to two years in state prison for evading a peace officer with wanton disregard for safety. CHP received a report of a vehicle traveling on Interstate 5 at a high rate of speed and passing vehicles on the right shoulder. When officers located Pemberton’s vehicle they attempted to make a traffic stop when Pemberton accelerat- ed to speeds around 120 miles per hour. Pemberton eventu- ally pulled over and got out of his vehicle and attempted to flee. After refusing to follow commands an officer deployed his taser and shot at Pemberton twice before being able to get him under control and into custody. • Nathan David Espling and Nathaniel Lee Armus were sentenced to two years each in state prison for second degree robbery. Espling and Armus entered a local gas station with their faces concealed. Armus demanded money from the clerk but when the clerk failed to comply Armus attacked him caus- ing the victim to fall to the floor. Espling kicked the victim several times while he was down. When the victim returned to his feet he again struggled with Armus until he was able to remove the mask that was concealing Armus’ face. Both Espling and Armus fled the store. Recent County Jail Commitments: • Michael Dennis O’Brien was sentenced to 180 days in Tehama County Jail for petty theft with a prior. Officers were dispatched to a Corning business regarding a shoplifting that had just occurred. Upon arrival officers contacted an employee who stated O’Brien had placed sev- eral items in a bag and exited the store without paying. When contacted, defendant stated he did pay for the items but later admitted to stealing them after he was unable to provide a receipt. • William Paul Mueller was sentenced to 180 days in Tehama County Jail for receiving stolen property: motor vehicle. Victim reports his quad had been stolen from a locked storage container on his property. During the course of investigation officers contacted Mueller who stated he went with a friend to the victim’s property knowing his friend was going to steal the quad. Mueller assisted in the theft and transported the quad to his residence. • Rochelle Leann Bell was sentenced to 120 days in Tehama County Jail for perjury by false affirmation for aid. Bell was receiving cash aid and food stamps while failing to report all of her household income. This resulted in an overpayment of $1,990. All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. Per the require- ments of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Propo- sition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney’s Office contends that each criminal case is unique and that in certain, specif- ic, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. Recent Proposition 36 Commitments: Note: • Mitchell Scott Allen was sentenced to Prop. 36 proba- tion for transportation of marijuana. Deputies issued a traffic stop on a vehicle driven by defendant. Upon contacting defendant deputies could smell the odor of marijuana coming from inside the vehicle. Deputies then obtained consent to search the vehicle where they located three bags of marijuana weighing 45 grams.
