Officers noticed Arnn and two other individuals walking on the railroad tracks carrying several bags and a weed-eater. When officers shone a light on the individuals they dropped everything they were carrying and ran. When Arnn was ques- tioned by officers he stated he stole several items from a stor- age shed at a local school and took the weed-eater from a fenced yard as he passed by. • Shawna Marie Murphy was sentenced to 30 days in Tehama County Jail for cultivating marijuana and child endangerment. Agents conducted a search of defendant's residence and seized 39 growing marijuana plants from an outdoor grow, 32 growing plants from an indoor grow, approximately 134 pounds of processed drying marijuana, scales and packaging material. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previ- ous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. • Robert Thomas Gilleon was sentenced to Prop. 36 proba- tion for possession of a controlled substance. Gilleon was a passenger in a vehicle stopped for a vehicle code violation. After smelling an odor of marijuana emitting from the vehicle officers searched the vehicle and found mar- ijuana, syringes and heroin. • Mark Edward Close was sentenced to Prop. 36 probation for transportation of marijuana. Deputies conducted a traffic stop on Close for a vehicle code violation. Upon contacting Close deputies could smell the odor of marijuana emitting from the vehicle. A consent search of the vehicle revealed three bags of marijuana weigh- ing 125 grams and one bag of marijuana weighing 124 grams. • Chad Leroy McCoy was sentenced to Prop. 36 probation for transportation of a controlled substance. Officers conducted a traffic stop on a vehicle driven by McCoy. Upon a search of the vehicle officers located 2.1 grams of methamphetamine. Preliminary Hearings (PX) and Trials: • Vaughn Noel Perkins will appear in court on March 16 and Benjamin James Doyle will appear in court on Feb. 23. Check with the court for time and location. Perkins is facing the charges of conspiracy to commit a crime, insurance fraud, two Counts of possession of an assault weapon, receiving stolen property, motor vehicle; possession of mari- juana for sale with special allegation armed with firearm, cultivating marijuana with special allegation armed with firearm. Doyle is facing the charges of conspiracy to commit a crime, insurance fraud, grand theft of personal property. Doyle has a custom built motorcycle that he and Perkins decided to report as being stolen to the insurance company. Doyle then receives $29,865 as a settlement amount for the loss of the motorcycle. The insurance company later received information that the motorcycle had not been stolen and Doyle and Perkins were conducting fraud. Agents then conducted a search of Perkins residence and located several firearms, bags of marijuana as well as parts of the motorcycle involved in the insurance fraud investigation. • Steven Donald Kuss and Paul James Wright will appear in court on Feb. 23. They will be facing the charges of two counts of assault with a deadly weapon with means to pro- duce great bodily injury with special allegation. Kuss and Wright encountered the two victims while walk- ing alongside opposite sides of the street on New Years Eve. An argument ensued and the victims approach Kuss and Wright. The victims end up getting beat with a chain and stabbed several times in the abdominal area and hands. • Dylan Franklin Shires will appear in court on March 30 for the charges of battery with serious bodily injury with spe- cial allegation; assault by means likely to produce great bod- ily injury with special allegation. Shires is currently in the Tehama County Jail on murder charges. Shires was housed in the same cell as the victim. Shires received a call to make the victim "roll up". When the victim declined, Shires began to punch him knocking him to the ground. While on the ground the victims head was stomped on with Shires' foot several times.
