At that time, all bids will be publicly opened, exam- ined and declared for construc- tion of: CITY OF TEHAMA 5TH STREET AND GYLE ROAD REHABILITATION 2.00 GENERAL WORK DESCRIP- TION The work to be done under this Contract consists of the grind- ing and disposal of existing HMA, removal of existing road- way culverts, placement of HMA, HMA driveway transitions, pavement striping and mark- ings, and the installation of roadway culverts, ditch grading, roadway signs, guardrail, and related items, complete. This project is located off the National Highway System (NHS). The DBE goal for this project is 5.7% No pre-bid meeting is scheduled for this project. The Engineer's Estimate for this project is approximately $902,500.00 Work shall be completed within 75 WORKING DAYS after receipt of a Notice to Proceed from the Owner. The Contrac- tor must be properly licensed as a contractor from contract award through contract accept- ance. A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, sub- ject to the requirements of Sec- tion 4104 of the Public Contract Code, or engage in the perform- ance of any contract for public work, as defined in Division 2, Part 7, Chapter 1 of the Labor Code, unless currently regis- tered and qualified to perform public work pursuant to Section 1725.5 of the Labor Code. It is not a violation of Section 1771.1 for an unregistered contractor to submit a bid that is author- ized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, pro- vided the contractor is regis- tered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. 4.00 BID RIGGING The U.S. Department of Trans- portation (DOT) provides a toll- free hotline to report bid rigging activities. Use the hotline to re- port bid rigging, bidder collu- sion, and other fraudulent activ- ities. The hotline number is (800) 424-9071. The service is available 24 hours 7 days a week and is confidential and anonymous. The hotline is part of the DOT's effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. 5.00 BID SUBMITTAL REQUIRE- MENTS Bids are re quired for the entire k d ib d h i d q work described herein and no bid will be accepted unless it is made on forms furnished by the City of Tehama. To ensure con- sideration, the Bid must be en- closed in a sealed envelope, clearly marked BID which also bears the name of the project and the date and time set for opening of Bids. Each Bid must be accompanied by cash, certi- fied or cashier's check, or bidde- r's bond made payable to the City of Tehama for an amount equal to ten percent (10%) of the amount bid, such guaranty to be forfeited should the bidder to whom the Contract is award- ed fail to execute the Contract. No Bid will be accepted from a Contractor who is not currently licensed in accordance with the provisions of Chapter 9, Division III of the Business and Profes- sions Code. Subcontractors shall also be licensed as re- quired by said code. The Contractor shall review, complete, and submit with the bid all certifications and disclo- sures provided in Appendix A. The Contractor shall complete and submit with the bid either the Construction Contract DBE Commitment (Exhibit 15-G) form or DBE Information – Good Faith Efforts (Exhibit 15-H) form in ac- cordance with the provisions provided in the Supplemental General Conditions. Exhibit 15-G and 15-H have been provided in Appendix B. 6.00 PREVAILING WAGES Pursuant to Section 1773 of the Labor Code of the State of Cali- fornia, the general prevailing wage rates in the county, or counties, in which the work is to be done have been determined by the Director of the California Department of Industrial Rela- tions. These wages are set forth in the General Prevailing Wage Rates for this project, available at the City of Tehama address and available from the Califor- nia Department of Industrial Re- lations' Internet web site at http ://www.dir.ca.gov/DLSR/PWD. Future effective general prevail- ing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are refer- enced but not printed in the general prevailing wage rates. h d l i i g p g g The Federal minimum wage rates for this project as prede- termined by the United States Secretary of Labor are available at http://www.dot.ca.gov/hq/es c/oe/federal-wages. Addenda to modify the Federal minimum wage rates, if necessary, will be issued to holders of these con- tract documents. Attention is directed to the Fed- eral minimum wage rate re- quirements. If there is a differ- ence between the minimum wage rates predetermined by the Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of In- dustrial Relations for similar classifications of labor, the Con- tractor and subcontractors shall pay not less than the higher wage rate. The Department will not accept lower State wage rates not specifically included in the Federal minimum wage de- terminations. This includes "helper" (or other classifica- tions based on hours of experi- ence) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise availa- ble for use by the Contractor and subcontractors, the Con- tractor and subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the duties of the employees in question. 7.00 APPRENTICESHIP STAND- ARDS In accordance with the provi- sions of Part 7, Chapter 1, Article 2, Section 1777.5 of the Labor Code of the State of California, the prime contractor shall be re- sponsible for fully complying with the provisions of this Sec- tion, as well as any regulations adopted by the Director of In- dustrial Relations, for all apprenticeable crafts or trades, and shall also assure compli- ance by his or her sub- contractors with respect to such apprenticeable crafts or trades. 8.00 INSURANCE AND BONDS RE- QUIRED The successful bidder to whom the Contract is awarded will be re quired to furnish appropriate i ifi q pp p insurance certificates as re- quired by Section 4.00 of the General Conditions and the Spe- cial Conditions. He or she shall also furnish a Payment Bond in an amount equal to the total Contract amount and a Faithful Performance Bond in the amount equal to the total Con- tract amount, with a corporate surety approved by the City of Tehama. 9.00 PAYMENT OF RETENTION AND SUBSTITUTION OF SECURI- TIES Five percent (5%) will be with- held from each progress pay- ment made to the Contractor for work performed and will be held until completion of the work, its acceptance and the expiration of the period provided by law for filing of liens by laborers or materialmen. In accordance with the provisions of Public Contract Code Section 22300, se- curities may be substituted for any monies which the City may withhold pursuant to the terms of the Contract to insure per- formance. 10.00 BIDDER'S INFORMATION Contract Documents, including Plans and Specifications, are available for inspection at the Valley Contractors Exchange at 951 E. 8th Street, Chico, Califor- nia and Shasta Builders Ex- change at 2990 Innsbruck Drive, Redding, California.
