The following defend- ants were sentenced in Tehama County Superior Court, according to the Te- hama County District At- torney's Office: RecentState/Local Prison Commitments: People vs. Ashley Eliza- beth Lakey, Grand Theft of Personal Property; Failure to Appear on Own Recog- nizance; Burglary. Brief history: In Febru- ary 2014, the defendant pled guilty to felony fail- ure to appear while on her own recognizance and was placed on formal proba- tion. The defendant ad- mitted her first violation of probation in June 2014 for failure to appear at probation, failure to sub- mit to drug testing, and using methamphetamine. The defendant admitted her second violation of probation in January 2015 for failure to obey all laws and possession of metham- phetamine and drug par- aphernalia. In April 2015, the defendant pled guilty to new felony charges of grand theft, failure to ap- pear while released on her own recognizance, bur- glary, and admitted her third violation of proba- tion. The defendant's pro- bation was reinstated and extended under the terms of the Adult Felon Drug Court (AFDC) program. In November 2015, the de- fendant failed to appear in AFDC court as ordered and her whereabouts re- mained unknown. Sentenced to a total of 4 years prison. People vs. Jacob McDan- iel, Unlawful Driving or Taking of a Vehicle. Brief history: On Jan- uary 1, police were dis- patched to the area of 2800 Main Street after re- ceiving a 911 call a woman was being chased by six men. When contacted by police, the woman claimed the defendant, her boy- friend, kidnapped her from Anderson and was driving a large box-van in the neighboring U-Haul parking lot. Officers went to the nearby business and observed a white box-van being driven around the parking lot by the defen- dant. Officers determined the van was previously re- ported stolen out of Sacra- mento. The defendant ad- mitted to purchasing the vehicle from an unknown subject in Sacramento for $250 and stated "I kind of knew it was stolen." Sentenced to 2 years lo- cal prison. People vs. Casey Van- gundy, Possession of Fire- arm by Felon. Brief history: In Febru- ary 2015, a sheriff's dep- uty initiated a traffic stop on defendant's vehicle for not having a front license plate. When contacted, the defendant was unco- operative and kept reach- ing for items in the front passenger seat. The de- fendant denied any con- traband being in the vehi- cle but refused to consent to a search of his vehicle or person. Based on defen- dant's suspicious actions and the presence of a po- lice scanner in the passen- ger seat, a K-9 unit arrived to assist. The deputy and his K-9 partner, Streiter, performed a free air sniff around the defendant's vehicle and alerted to the outside of defendant's ve- hicle. Streiter further pro- vided positive alerts to the toolbox in the back of de- fendant's truck, as well as the front driver's seat. A baggie of methamphet- amine and a glass smok- ing pipe were located in a canvas bag wedged in between the driver's seat and center console. A fur- ther search of the vehicle revealed a loaded .22 cal- iber Marlin long rifle and a box of 100 live .22 cali- ber rounds of ammunition. Sentenced to 3 years state prison. People vs. Andre Hay- wood Sr., Child Abuse. Brief history: In July 2015, deputies were called to assist with a welfare check on the defendant's children after receiving a report the nine-year-old victim had been abused by the defendant. When the victim was contacted, he confirmed the defendant had hit him, grabbed him by the neck, and struck him with a belt over the last few days. The victim had visible bruising on both sides of his neck and stated he was afraid to tell anyone because the defen- dant stated he would have his mother killed. When deputies attempted to question the defendant, he became angry and began to fight. The defendant head-butted and kicked the deputies and was able to break free from their grasp on two occasions before finally being taken into custody. Sentenced to 4 years, 8 months state prison. People vs. Mark Law- rence Brewer, Spousal Bat- tery; Evading with Willful Disregard. Brief history: On De- cember 27, 2014, the de- fendant showed up at his estranged wife's home in violation of the restrain- ing order. An argument ensued and the defendant left the residence. The de- fendant then returned to the residence and broke through the door with a hammer. The defendant then attacked his wife with the hammer, caus- ing injuries to her head and hand. When the wife's 74-year-old mother came out of her bedroom, the defendant attacked her with the hammer, caus- ing skull fractures, lacer- ations to her head and ear, and a puncture wound to her shoulder. When dep- uties arrived, they ob- served the injured victims lying on the kitchen floor and a hammer covered in blood and human hair, but the defendant was no- where to be found. A war- rant was subsequently is- sued for the defendant for his role in the attacks, but his whereabouts remained unknown until deputies located his vehicle in Cot- tonwood on January 7, 2015. When the defendant realized he had been spot- ted, he drove towards one of the officers, and tried to swerve at him while armed with a shotgun. The officer had to jump out of the way to avoid being hit, and the defendant drove away at speeds reaching 100 miles per hour. A pursuit involv- ing multiple law-enforce- ment agencies ensued for 22 minutes, and spanned over 18 miles and two counties before the defen- dant crashed into a tele- phone pole and was taken into custody. Sentenced to 18 years, 8 months state prison. Recent County Jail Commitments: People vs. Kerstie Marie Shults, Bring Contraband Into Jail; Carry Loaded Firearm in Vehicle. Brief history: While on felony probation the defen- dant was contacted during a traffic stop in which she was the passenger. During the vehicle search, officers located a baggie under the defendant's seat contain- ing methamphetamine, a spoon with residue and burn marks, cotton swabs and two syringes. While being booked at the jail, staff conducted a search of defendant and deter- mined she had a baggie of marijuana hidden on her person. Sentenced to a total of 5 years probation, 120 days jail, 80 hours of com- munity service, and sus- pended prison term of 3 years, 8 months. People vs. Wesley Wil- son, Assault with a Deadly Weapon. Brief history: The de- fendant is restrained from contacting his father, the victim, pursuant to a valid restraining order. The de- fendant showed up at the victim's home and stated he lived at the residence and ordered the victim to leave. The defendant then shoved a box of ice cream in the victim's face and punched him in the face. When the victim fell to the ground, the defen- dant retrieved a baseball bat and swung at him un- successfully two times be- fore finally hitting him in the ribs. When officers ar- rived, the victim was cov- ered in blood and choco- late ice cream. The victim was subsequently taken to the hospital where he was treated for cracked ribs. Sentenced to 5 years probation, 180 days jail, 80 hours of community service, and suspended prison term of 4 years. People vs. Shawn Elvis Hershel Stout, Failure to Appear on Own Recogni- zance. Brief history: The de- fendant was arrested on a felony charge of carry- ing a dirk or dagger and booked into the Tehama County Jail. The defen- dant was subsequently released from jail, on his own recognizance, with an order to return to court on December 1, 2015. The defendant failed to appear as ordered. Sentenced to 5 years probation, 120 days jail, and 80 hours of commu- nity service. People vs. Gregg Mor- gan, Possession of Fire- arm by Felon. Brief history: Deputies responded to the defen- dant's residence after re- ceiving a call of a distur- bance possibly involving the discharge of a firearm. When deputies contacted the defendant inside the residence, they observed a .22 Ruger 10-22 leaning in the doorway. Deputies also located 17 rounds of .22 ammunition. Follow- ing the defendant's arrest, he was transported to the jail. During booking, jail staff located 5.3 gross grams of marijuana hid- den in defendant's sock. Sentenced to 5 years probation, 180 days jail, 80 hours of community service, and suspended prison term of 3 years, 8 months. People vs. Katrina Cay Trachy, Burglary; Child Abuse. Brief history: Between 2010 and 2014, the de- fendant visited different area hospitals and used the victim's insurance in- formation to obtain pre- scriptions for painkillers. When contacted by law enforcement, the victim admitted she confessed she was an addict and had used the victim's insur- ance to get narcotics. In August 2015, law enforce- ment responded to a call of a three-year-old child wandering unsupervised in the roadway. When law enforcement arrived at the defendant's home to check on the wel- fare of her children, the door was open and unse- cured, numerous alcohol containers were strewn about the residence, and the defendant was passed out in a back bedroom in a pool of her own vomit. The defendant was ex- tremely intoxicated and unable to provide any in- formation regarding the whereabouts of her chil- dren. Sentenced to a total of 5 years probation, 210 days jail, and 80 hours of com- munity service. People vs. Paul Edward Johnson, Possession for Sale of a Controlled Sub- stance. Brief history: While ex- ecuting a search warrant at the defendant's travel trailer, agents observe 24.21 grams of heroin on a dresser and .43 grams of methamphetamine on a stand near the television. Packaging materials, drug paraphanelia, scales, and pay/owe sheets are also lo- cated inside the residence. The defendant is present during the search and ad- mits being a heroin addict and selling drugs from the residence on multiple oc- casions. Sentenced to 3 years probation and 120 days jail. Brief history: The De- fendant was arrested and charged with the murder of a 14 year old victim who had been reported missing when she never returned home from school. Officers located the victim's body two days later. Trial Vacated Setting of Motions: Feb- ruary 16, at 3:30 pm in De- partment 2 People vs. Travis John Kilburger, Solicitation of Murder (2 counts) Brief history: The De- fendant was in custody on domestic violence charges when he solicited another inmate to kill two individ- uals in exchange for cash and a vehicle. TBJ: Vacated. Defen- dant Plead guilty. SENTENCING: Febru- ary 18, at 1 pm in Depart- ment 3 People vs. Poly Duenas Sanchez, Lucio Nenecia Madera, Gabino Madera, Murder with Special Al- legation-Personal and In- tentional Discharge of a Firearm, GBI, Conspiracy to Commit a Crime with Special Allegation-Per- sonal and Intentional Dis- charge of a Firearm, GBI. Brief history: The Vic- tim had met up with the three Defendants regard- ing money that was alleg- edly owed to the victim. During this confrontation the victim was chased down and shot twice with a shotgun. The victim died as a result of his injuries. TBJ: March 2, at 1:30 pm (Department to be de- termined) People vs. Alan Duane Doulphus Jr., Chase Alan Doulphus: Murder, spe- cial allegation felony mur- der, personal and inten- tional, use of a firearm, assault with a firearm, false imprisonment by vi- olence, transportation of marijuana. Brief history: The de- fendants went to a res- idence that contained a marijuana grow. The de- fendants confronted the victim and two other men who were at the residence and ordered them to the ground at gunpoint. The defendants proceeded to tie up the victim and the two men with zip ties and duct tape. The victim was able to free himself and at- tempt to flee the residence but was shot several times by the armed defendants. The victim eventually suc- cumbed to his injuries. De- fendant's vehicle was lo- cated a short time later and a vehicle pursuit fol- lowed. Defendant's were eventually apprehended and taken into custody. Inside the vehicle officers located a large amount of marijuana. Motions In Limine: Feb- ruary 19, 2016 in Depart- ment 2 TBJ: February 24, at 1:30 pm (Department to be determined) People vs. John Noonkester, Willful, De- liberate and Premeditated Murder with Special Alle- gation, Personal and In- tentional Discharge of a Firearm, GBI (2 counts); Attempt: Willful, Delib- erate and Premeditated Murder with Special Al- legation, Personal and In- tentional Discharge of a Firearm, GBI. Brief history: The De- fendant is charged with shooting and killing his ex-wife and her father, and shooting a bystander. Arraignment on Infor- mation: February 22, at 1:15 pm in Department 3 People vs. William Fos- ter, Derek Hale, Garrett Lenardo, Zachary Thorn- ton and Robert Beau- grand, attempted murder Brief History: What be- gan as a marijuana deal resulted in kidnapping, robbery and one individ- ual with a gunshot wound. PTC: February 22, at 1:15 pm in Department 3 People vs. David Hast- ings, Grand Theft of Per- sonal Property; First De- gree Residential Burglary; Possession of Burglar's Tools; First Degree Resi- dential Burglary, 4 counts; Grand Theft of Personal Property, 3 counts; Grand Theft; Identity Theft, 2 counts; Possession of a Firearm by a Felon; Pos- session of Ammunition; Receiving Stolen Property, 9 counts; Petty Theft. Brief history: The vic- tim's vehicle was broken into and several personal items were stolen includ- ing a wallet. The following day, the victim's bank ac- count was missing $1,300. It was later found the De- fendant's cell phone bill had been paid with the exact same amount by the victim's checking ac- count. The Defendant de- nied. The victim's home was burglarized while on vacation. Neighbors had taken pictures of the vehi- cle and the driver that was at the home. While officers contacted the Defendant on other matters, they dis- covered several of the vic- tim's items within the De- fendant's vehicle. The De- fendant was the suspect in various burglaries within the area. Several items of stolen property were found on the Defendant's person while being contacted in regards to other cases. Sentencing Continued: February 29, at 10 am in Department 1 People vs. Roberta Draper, (12 counts) Cru- elty to an animal Brief history: The De- fendant is currently on probation for a prior cru- elty to animal case. One of the terms of her probation is that she is not to possess any animals. A probation search was conducted at her residence and law en- forcement located dogs, geese, guinea hens and turkeys. One of the dogs was deceased, while some of the other animals ap- peared to be malnour- ished, dehydrated, and in poor health. The Defen- dant admitted that all the animals found belonged to her.
