US Marines posed with Nazi symbol in Afghanistan SAN DIEGO (AP) — The Marine Corps on Thursday once again did damage control after a photograph surfaced of a sniper team in Afghanistan posing in front of a flag with a logo resembling that of the notorious Nazi SS — a special unit that murdered millions of Jews, gypsies and others. The Corps said in a statement that using the symbol was not acceptable. However, it was a naove mistake made by Marines who believed the SS symbol was meant to represent sniper scouts and never intended to associate themselves with a racist organization, said Maj. Gabrielle Chapin, a spokeswoman at Camp Pendleton. The Marines in the image will not be disci- plined because investigators determined there was no malicious intent, Chapin said. Instead, the Corps used the incident as a training tool to talk to troops about what sym- bols are acceptable after it became aware of the photograph last November. The image has since surfaced on an Internet blog. ''I don't believe that the Marines involved would have ever used any type of symbol asso- ciated the Nazi Germany military criminal organization that committed mass atrocities in WWII,'' Chapin said. ''It's not within who we are as Marines.'' It was the second time this year the Marine Corps has had to do damage control for actions of its troops. It's also investigating a separate group of Marines recorded on video urinating on the dead bodies of Taliban fighters. Mikey Weinstein of the Military Religious Freedom Foundation in Washington said he has been flooded with calls from former Marines offended by the photo and from one member of his organization who is an Auschwitz concentration camp survivor. ''This is a complete and total outrage,'' he said. Weinstein said his organization was send- ing a letter seeking a full investigation to the head of the Marine Corps and Defense Secre- Friday, February 10, 2012 – Daily News LEGAL NOTICE tary Leon Panetta. ''First we have Marines peeing on dead bodies and now this,'' Weinstein said. The Marines in the photograph are no longer with the unit. Chapin said she did not know if they are still in the Corps. In the photo taken in September 2010 in the Afghanistan town of Sangin, the Marine Corps unit is posing with guns in front of an Ameri- can flag and a large blue flag with what appear to be the letters ''SS'' in the shape of jagged lightning bolts. The SS, or Schutzstaffel, was the police and military force of the Nazi Party, which was dis- tinct from the general army. Members pledged an oath of loyalty to Adolph Hitler. SS units were held responsible for many war crimes and played an integral role in the extermination of millions of Jews along with gypsies and other people who were deemed undesirable. The SS was declared to be a crim- inal organization at the Nuremberg war crime trials. Kodak to stop making cameras, frames ROCHESTER, N.Y. (AP) — Picture it: Save for a few disposable point-and-shoots, Kodak is exiting the camera business. Eastman Kodak Co. said Thursday that it will stop mak- ing digital cameras, pocket video cameras and digital pic- ture frames in a move that marks the end of an era for the beleaguered 132-year-old com- pany. Founded by George East- man in 1880, Kodak was known all over the world for iconic cameras such as the Brownie and the Instamatic. For the last few decades, how- ever, the Rochester, New York- based company has struggled. It was battered by Japanese competition in the 1980s, and failed to keep pace with the shift from film to digital tech- nology. The company sought bank- ruptcy protection from creditors last month in a case that covers $6.7 billion in debt. It has a year to devise a restructuring plan. Citigroup Inc. was approved to lend the company $650 million to continue operating. Exiting the digital camera business is especially poignant for Kodak. In 1975, using an electronic sensor invented six years earlier at Bell Labs, a Kodak engineer named Steven Sasson created the world's first digital camera. It was an eight- pound, toaster-size device that captured low-resolution black- and-white images. Reached at home Thursday, Sasson told The Associated Press that seeing Kodak exit the business is ''a bit sad'' but part of a transition facing all companies that use evolving technology. ''The average person proba- bly owns more digital cameras than they realize,'' he said. ''It's just the reality that digital imaging is a part of our lives and you can capture images in a lot of different ways. There's a lot of choices people have, cellphones being one of them.'' Through the 1990s, Kodak spent some $4 billion develop- ing the photo technology inside most of today's cellphones and digital devices. But fearing that it might cannibalize its cellu- loid film business, Kodak wait- ed until 2001 to bring its own digital cameras to the con- sumer market. By then, it faced strong competitors like Sony Corp. and Canon. These days, digital camera sales are suffering as con- sumers increasingly take pho- tos on smartphones such as the iPhone. Certain smartphone makers such as LG, Nokia, Motorola and Samsung have agreed to pay Kodak to license its digital camera technology, while companies like Apple are fighting its patent claims. Before Thursday's announcement, Kodak had already been trying to shrink its product line and sell in fewer retail venues, but as sales declines worsened, the compa- ny saw no way to make the business profitable. ''We made the logical con- clusion that there was no clear path to profitability and we have to focus on generating profits at this point,'' said Kodak spokesman Chris Veronda. Kodak said getting out the digital camera business by June should help cut losses by about $100 million a year as it strug- gles to emerge from Chapter 11 bankruptcy. The company's digital cam- era line was part of a rapidly shrinking division that accounted for about a quarter of Kodak's revenue in the three-month period through September. For the nine months through September, total company sales plunged 18 percent to $4.3 bil- lion and it lost $647 million. Kodak sees home photo printers, high-speed commer- cial inkjet presses, workflow software and packaging as the core of its future business. Since 2005, the company has poured hundreds of millions of dollars into new lines of inkjet printers. Once the digital cam- era business is phased out, Kodak said its consumer busi- ness will focus on printing. It will seek a company to license its EasyShare digital camera brand. Kodak said it's working with retailers to ensure an orderly transition. The compa- ny will continue to honor prod- uct warranties and provide technical support for the dis- continued products. The company didn't say how many jobs would be elim- inated as a result of the deci- sion, but did say that it expects to take a charge of $30 million related to separation costs. Kodak owns patents that cover a number of basic func- tions in many smartphone cam- eras, and the bankruptcy judge has given the company until June 30 to come up with a pro- cedure to sell them. The company picked up $27 million in patent-licensing fees in the first half of 2011. It made about $1.9 billion from those fees in the previous three years combined. But no buyers have emerged since Kodak started shopping them around in July. Tribe suing beer companies for alcohol problems LINCOLN, Neb. (AP) — An American Indian tribe sued some of the world's largest beer makers Thursday, claiming they knowingly contributed to devastating alcohol-related problems on South Dakota's Pine Ridge Indian Reservation. The Oglala Sioux Tribe of South Dakota said it is demanding $500 million in damages for the cost of health care, social services and child rehabilita- tion caused by chronic alcoholism on the reserva- tion, which encompasses some of the nation's most impoverished counties. The lawsuit filed in U.S. District Court of Nebraska also targets four beer stores in White- clay, a Nebraska town near the reservation's border that, despite having only about a dozen residents, sold nearly 5 million cans of beer in 2010. Tribal leaders and activists blame the Whiteclay businesses for chronic alcohol abuse and bootleg- ging on the Pine Ridge reservation, where all alco- hol is banned. They say most of the stores' cus- tomers come from the reservation, which spans southwest South Dakota and dips into Nebraska. ''You cannot sell 4.9 million 12-ounce cans of beer and wash your hands like Pontius Pilate, and say we've got nothing to do with it being smug- gled,'' said Tom White, the tribe's Omaha-based attorney. Owners of the four beer stores in Whiteclay were unavailable or declined comment Thursday when contacted by The Associated Press. A spokeswoman for Anheuser-Busch InBev World- wide said she was not yet aware of the lawsuit, and the other four companies being sued — SAB Miller, Molson Coors Brewing Company, MIller- Coors LLC and Pabst Brewing Company — did not immediately return messages. The lawsuit alleges that the beer makers and stores sold to Pine Ridge residents knowing they would smuggle the alcohol into the reservation to drink or resell. The beer makers supplied the stores with ''volumes of beer far in excess of an amount that could be sold in compliance with the laws of the state of Nebraska'' and the tribe, tribal officials allege in the lawsuit. The vast majority of Whiteclay's beer store cus- tomers have no legal place to consume alcohol since it's banned on Pine Ridge, which is just north, state law prohibits drinking outside the stores and the nearest town that allows alcohol is more than 20 miles south, said Mark Vasina, pres- ident of the group Nebraskans for Peace. The Connecticut-sized reservation has strug- gled with alcoholism and poverty for generations, despite an alcohol ban in place since 1832. Pine Ridge legalized alcohol in 1970 but restored the ban two months later, and an attempt to allow it in 2004 died after a public outcry. The reservation spans impoverished areas, including Shannon County, S.D., which U.S. cen- sus statistics place as the third-poorest in the nation. It has a median household income of $27,300 and nearly half of the population falls below federal poverty standards. Tribal President John Yellow Bird Steele said the tribe council authorized the lawsuit in an effort to protect the reservation's youth. ''Like American parents everywhere, we will do everything lawful we can to protect the health, welfare and future of our children,'' he said. The tribe views the lawsuit as a last resort after numerous failed attempts to curb the abuse through protests and public pressure on lawmak- ers, White added. He said the tribal council voted unanimously about four months ago to hire his law firm. One in four children born on the reservation suffer from fetal alcohol syndrome or fetal alcohol spectrum disorder, and the average life expectancy is estimated between 45 and 52 years — the short- est in North America except for Haiti, according to the lawsuit. The average American life expectancy is 77.5 years. ''The illegal sale and trade in alcohol in White- clay is open, notorious and well documented by news reports, legislative hearings, movies, public protests and law enforcement activities,'' the law- suit states. '' All of the above have resulted in the publication of the facts of the illegal trade in alco- hol and its devastating effects on the Lakota peo- ple, especially its children, both born and unborn.'' Nebraska lawmakers have struggled for years to curb the problem, and are considering legislation this year that would allow the state to limit the types of alcohol sold in areas like Whiteclay. The measure would require local authorities to ask the state to designate the area an ''alcohol impact zone.'' The state liquor commission could then limit the hours alcohol sellers are open, ban the sale of certain products or impose other restrictions.
