Nicoll was originally granted formal probation. He violated his probation when he was found in pos- session of marijuana as well as violating his DUI summary probation condi- tions. • Otto Chris Schultz Jr., was sentenced to two years in state prison for possession of a controlled substance. Schultz was originally granted formal probation. He violated his probation when he failed to keep in contact with probation and keep them informed of his current contact information. Diaz was out on parole when he absconded and removed his ankle bracelet that he was required to wear. Recent County Jail Commitments • Annie Laurie Fields was sentenced to two years in Tehama County Jail for sale of a controlled substance, possession for sale of a controlled sub- stance. Fields was originally granted formal probation. She violated her probation when she tested positive for methamphetamine. • Gerardo Ramirez was sentenced to 90 days in Tehama County Jail for welfare benefits and failed to report that he had received approximately $11,000 in an insurance settlement. This resulted in over $11,000 in food stamps that Ramirez was not entitled to. • William Gene Fox was sentenced to 90 days in Tehama County Jail for cultivating marijuana, possession of a firearm by a felon. Agents served a search warrant on Fox's property and located a large amount of marijuana along with guns and ammunition. Recent Proposition 36 Commitments Note: All cases where- in a defendant is sen- tenced per the terms of Proposition 36 are not at the request of the Tehama County District Attor- Per the requirements of Proposi- tion 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on proba- tion and require drug treatment alone. Per the requirements of Proposi- tion 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each crimi- nal case is unique and that in certain, specific, cases a defendant should be sen- tenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non- compliance with either previous grants of proba- tion or previous grants of drug treatment, a state prison sentence should properly be imposed. • Deborah Ann Bowen and George Wayne Sin- gleton were both sen- tenced to Prop. 36 Proba- tion for possession of a controlled substance. An officer conducted a traffic stop on a vehicle driven by Singleton. The officer conducted a search of the vehicle and located a bag containing metham- phetamine and hydrocodone pills. The officer also located a small amount of methampheta- mine in Bowen's purse. Upcoming Court Dates -Trials, Preliminary Hear- ings(PX) & Pre Trial Con- ferences(PTC): • Theresa Marie Lewis 3B aka: Theresa Marie Garcia Lewis appeared in court at 8 a.m. on Tuesday, Dec. 20, in Department 3for a entry of plea. She is facing the charges of two counts of attempt: willful, delib- erate, and premeditated murder; two counts of assault with a deadly weapon; two counts of child abuse-Special alle- gations- great bodily injury(Counts 1 & 2), use of deadly weapon (All Counts), great bodily injury (All Counts) Officers responded to Lewis' residence after they received a report that the 13-year-old victim had a cut on his neck. Upon arrival officers began investigating the incident and learned the defendant had given the victim pills and slit his throat in a failed attempt to kill him. Lewis was arrested and taken into custody. Fishing the Alabama Rig in California Question A recent inno- vation on the pro bass-fish- ing trail is something called the "Alabama Rig", which is similar to what is called an "Umbrella Rig" by salt- water anglers. The Alabama Rig consists of five or six lures [usually plastic grubs or small swimbaits] radiat- ing from a central attach- ment point by wires, imitat- ing a school of baitfish. It looks very similar to a "mobile" that you might suspend above a baby's crib. Since all the lures have hooks in them, would this rig be legal for inland/fresh- water fishing in California for bass or other species?" (Steve C., Chico) Answer With the amount of money available through tournament fishing these days, anglers are con- stantly looking for the next big thing to help them catch more and bigger bass. We have received a lot of ques- tions recently regarding the Alabama Rig and whether they are legal to use in Cali- fornia. Unfortunately, regu- lations in California differ from those in Alabama and this type of fishing tackle is not legal. According to competi- tive bass angler and Depart- ment of Fish and Game (DFG) Game Warden Tim Little, the traditional "Alabama Rig" (see photo at http://californiaout- doors.wordpress.com/) is not legal to use because it contains five separate lures each with a hook. California law allows for a maximum of three lures to be used on an individual line (whether the lure has a single hook as shown in your photograph or uses three hooks as allowed by law.) In California, "all fish may be taken only by angling with one closely attended rod and line or one hand line with not more than three hooks nor more than three artificial lures (each lure may have three hooks attached) attached thereto" (California Code of Regulations, section 2.00). To legally use the Alaba- ma Rig in California inland waters, the rig must be attached to one rod with one line and no more than three of the attached lures con- taining hooks. Those lures containing hooks may have no more than three hooks attached to each lure. The other two could have hook- less teasers. Some people locally have even developed a modified three wire rig (now called a Cali-rig), which is legal. What to do with pro- hibited aquarium sharks? Question I live in South- ern California and maintain private fish tanks for my clients. I have a client that has a 5,000 gallon shark tank with a black tip reef shark. After hearing about other Requiem Sharks being seized (CCR Title 14, section 671 (c)(6)(A)), my client would like to know what he can do to have per- mits or if this shark has been grandfathered in as he bought the shark in 2008 with verifying receipts. Please let me know what we can do regarding this matter. (Ryan C.) Answer Unfortunately, permits are not available to possess species listed in CCR Title 14, section 671 (Importation, Transporta- tion and Possession of Live Restricted Animals) for hobby (pet) purposes. To stay within the law, the only options are: (1) transfer the animal to another appropri- ately permitted facility, (2) transfer the animal out of the state, or (3) humanely destroy it (CCR Title 14, section 671.5). Handgun with a flash- light/laser-lite combo? Question If I am hunt- ing for big game with a rifle, is it legal to also carry a handgun equipped with a flashlight/laser-lite combo? The handgun would only be a sidearm for safety. (Yia L.) Answer Yes, it is legal as long as the handgun is not used to assist in the tak- ing of big game. Can a rifle hunter and an archery-only hunter hunt together? Question If I'm out hunting during general deer rifle season with a partner, and I have a regular deer tag and he has an archery-only (AO) tag, does that mean we cannot hunt together because I would be hunting with a rifle? It seems like technically we wouldn't be breaking the law but I'm not sure how a warden in the field would interpret this. (Roger A.) Answer The restriction only applies to archers who are taking deer during the archery season and in areas where the AO tag can legal- ly be used. As long as your individual method of take (firearm or archery) match- es the tag you carry, you can legally hunt together. However, if you choose to hunt in close proximity to your friend and are contact- ed by a game warden, you can expect that you will be asked several questions to ensure that the special priv- ileges granted to AO tag holders is not being com- promised.
