8B Daily News – Friday, May 27, 2011 COURT ROUND-UP The following defendants were sentenced in Tehama Coun- ty Superior Court, according to the Tehama County District Attorney’s Office: —————— Recent State Prison Commitments: • Rafael Rodriguez Delgado was sentenced to two years and eight months in state prison for carrying loaded handgun, not registered, possession of a controlled substance, failure to appear while on bail. An officer conducted a traffic stop on a vehicle in which Delgado was a passenger. During a search of the vehicle the officer located an unregistered handgun and methampheta- mine which was found in Delgado’s pocket. Delgado failed to appear in court as ordered in case number NCR80304. • Jeffrey Joe Scott, II, was sentenced to 32 months in state prison for petty theft with a prior, special allegation-prior strike. Victim reported her purse had been stolen out of her vehi- cle. Upon contacting the victim at the scene a deputy noticed a vehicle driving through the area. The deputy then conducted a traffic stop on the vehicle after the driver failed to stop at a stop sign. The deputy approached the vehicle and contacted Scott. While speaking with Scott the deputy observed a purse on the floorboard of the vehicle matching the description of the victim’s purse that had been reported stolen. Recent County Jail Commitments: • Damian Pride Stanford was sentenced to 365 days in Tehama County Jail for assault with a deadly weapon. Officers responded to a residence regarding a stabbing. Upon arrival officers were advised that there had been a party at the residence that night. Stanford had gotten into an argu- ment with other men and they began fighting. The victim intervened and attempted to break up the fight when Stanford pulled out a knife and stabbed him in the stomach. • Tracy Leeanne Pryor was sentenced to 210 days in Tehama County Jail for conspiracy to commit a crime. Tracy Pryor had conspired with Michael Pryor in an attempt to borrow money and post bail for Michael Pryor. Tracy Pryor and Michael Pryor had convinced a third party to testify at a bail hearing regarding the source of the bail money being legitimate. • Charles Ballesteros was sentenced to 180 days in Tehama County Jail for possession for sale of a controlled substance, special allegation-personally armed/firearm controlled sub- stance. While serving a search warrant at a residence agents observed Ballesteros flee from a camp trailer that was parked on the property. Agents conducted a search of the camp trailer and located a digital scale, packaging material, a handgun and several bags of methamphetamine. • Christina Marie Puryear was sentenced to 120 days in Tehama County Jail for possession of a controlled substance. Puryear was originally granted formal probation. Puryear violated her probation when she failed to report to probation and failed to complete a court ordered drug treatment program. • Rebecca Ann Weilmunster and Jeffrey Michael Gabel were sentenced to Tehama County Jail for two counts of forgery. Weilmunster, who was sentenced to 30 days in Tehama County Jail and adult felon drug court, had the addi- tional charge of maintaining place for selling or using con- trolled substance and Gabel, who was sentenced to 120 day in Tehama County Jail had the charge of possession for sale of a controlled substance. Officers conducted a search of Weilmunster and Gabel’s residence and located methamphetamine, digital scales, hypo- dermic syringes and smoking pipes. Weilmunster was origi- nally granted formal probation. She violated her probation upon her arrest in case number NCR80947. • Edward Reginald Thomas Jr., was sentenced to 90 days in Tehama County Jail for transportation of a controlled sub- stance, receiving stolen property. A deputy contacted Thomas after he was observed riding a bicycle without a light. The officer conducted a consent search of Thomas and located prescription pills prescribed to another individual. The officer then contacted the person whose name appeared on the prescription bottle and determined the pills had been stolen. • Jeramy Alexander Bowers was sentenced to 90 days in Tehama County Jail for sale of transportation of marijuana, maintaining place for selling or using controlled substance. Bowers was originally granted formal probation. He violat- ed his probation when he failed to keep in contact with his pro- bation officer. • Daniel Hamilton Graham was sentenced to 60 days in Tehama County Jail for food stamp fraud. Investigators contacted Graham regarding a possible wel- fare fraud case. After investigating the incident it was deter- mined the Graham had lived with another individual and failed to report it to the welfare department. The defendant received an overpayment of approximately $1,354. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney’s Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. • Sandra Lou Perez was sentenced to Prop. 36 probation for two counts of possession of a controlled substance, special allegation offense while on bail or O.R., transportation of a controlled substance. Perez was contacted by officers and taken into custody on an outstanding warrant. Inside Perez’s purse officers located methamphetamine. In a separate incident, an officer conduct- ed a traffic stop on a vehicle in which Perez was a passenger. After the officer was advised the driver was on parole he con- ducted a search of the vehicle. Inside Perez’s purse the officer located a syringe containing methamphetamine. At another incident, an officer observed a suspicious vehicle parked in an alleyway with several occupants inside. The officer contacted Perez and located a hypodermic syringe and methampheta- mine inside her purse. Upcoming Court Dates -Trials, Preliminary Hearings(PX) & Pre Trial Conferences(PTC): • Chrissy Ann Dunn will appear in court at 8 a.m. on June 21 in Department 3. She is facing the charges of lewd act upon a child, oral copulation of a person under 16. Officers received a report that Dunn was having sexual relations with a minor. An investigation into the incident was conducted in which officers determined that on numerous occasions Dunn had sexual encounters with the 14 year old victim.
