BySamHananel The Associated Press WASHINGTON The chief judge of a federal appeals court announced Friday that he's stepping down from his post and apolo- gized for sending an inap- propriate email to an attor- ney who had argued cases before him. Judge Randall Rader of the U.S. Court of Appeals for the Federal Circuit said in a letter to colleagues that he was "inexcusably care- less" for sending the email praising the lawyer's skills and urging him to share it with others. Rader said he will con- tinue to serve as a judge on the appeals court, which specializes in hearing pat- ent cases. He will be suc- ceeded as chief by Judge Sharon Prost effective May 30. "I have come to realize that I have engaged in con- duct that crossed lines es- tablished for the purpose of maintaining a judicial pro- cess whose integrity must remain beyond question," Rader wrote in the letter posted on the court's web- site. The letter is addressed to the court's 17 other judges. Earlier this month, Rader recused himself from two cases in which the at- torney, Edward Reines, had appeared before the court on behalf of computer giant Microsoft Corp. and medi- cal device maker Medtronic Inc. The Wall Street Jour- nal reported Thursday that Rader had sent a "laudatory email" to Reines and en- couraged him to show the message to others. While Rader acknowledged send- ing the email, he did not name the recipient. Reines did not respond to a request for comment. Such messages would not be considered appro- priate under ethical rules, said Stephen Gillers, a law professor at New York Uni- versity and an expert on le- gal ethics. JUDICIARY Appeals court judge facing ethics questions resigns By Donna Cassata The Associated Press WASHINGTON Secretary of State John Kerry will testify before Congress next month about the deadly attack in Benghazi, Libya, a one-and- done appearance that the State Department insists is enough to answer questions and means he could avoid the newly formed select commit- tee. In a letter to the House Oversight chairman, the department said Friday that Kerry could appear on June 12 or June 20 to discuss the Obama ad- ministration's cooperation with the panel in provid- ing emails and other docu- ments related to the Sept. 11, 2012, attack that killed U.S. Ambassador Chris Stevens and three other Americans. The department said that appearance "would re- move any need for the sec- retary to appear before the select committee to answer additional questions." In response, Frederick Hill, a spokesman for the Oversight Committee, said Chairman Darrell Issa had accepted Kerry's offer to appear June 12. The committee had is- sued two subpoenas for Kerry's testimony, an un- usual step for a Cabinet member that had clearly annoyed the State Depart- ment. The department said diplomatic responsibilities tied to Ukrainian elections, NATO meetings in Brus- sels and a presidential trip to Poland prevented Kerry from testifying on May 29, the date of a committee subpoena.
