8A – Daily News – Friday, February 4, 2011 COURT ROUND-UP The following defen- dants were sentenced in Tehama County Superi- or Court, according to the Tehama County Dis- trict Attorney’s Office: —————— Recent State Prison Commitments: • Ronald Calvin But- ler Jr., was sentenced to six years in state prison for possession for sale of a controlled sub- stance-special allega- tion-prior strike. An officer conducted a traffic stop on a vehi- cle driven by Butler. The officer was then advised Butler was on parole and conducted a search of the vehicle and located metham- phetamine. • Adam Woods was sentenced to four years, eight months in state prison for resisting executive officer-evad- ing an officer, willful disregard, transporta- tion of marijuana. An officer made con- tact with Woods after noticing he was parked near an area known for dumping trash. Upon contacting Woods the officer noticed the odor of marijuana. Woods appeared to become ner- vous and failed to com- ply with the officer’s orders. Woods then charged the officer in an attempt to get back to his vehicle. The officer began struggling with Woods until Woods was able to get in his vehicle and flee the scene. Woods was later located with the use of a canine. During a search of the vehicle officers located bags of marijuana hid- den in the trunk. • Bartolo Lorenzo Atrisco was sentenced to four years, eight months in state prison for possession for sale of a controlled sub- stance, transportation of a controlled substance, transportation of mari- juana. An officer conducted a traffic stop on a vehi- cle driven by Atrisco. The officer had reason to believe there may be drugs inside the vehicle and used a canine to conduct a search of the vehicle. The search revealed methampheta- mine, marijuana, digital scales, packaging mate- rial and methampheta- mine smoking pipes. • Jorge Ruiz Sanchez was sentenced to four years in state prison for first degree residential burglary. Deputies responded to a residence regarding a possible burglary when they were advised by witnesses that they observed Sanchez run out of a residence with items in his hand. The witnesses were able to chase after Sanchez and detain him until deputies arrived. During a search of Sanchez a deputy was able to locate several stolen items from the residence. • Rene Gonzalez-Cer- vantes was sentenced to two years, eight months in state prison for receiving stolen proper- ty, motor vehicle, fail- ure to appear while on bail Deputies responded to a business regarding a possible burglary. Upon arrival deputies were advised an ATV was seen at the location and then left at a high rate of speed. The deputies then conducted an area check where they locat- ed an ATV matching the description parked in front of a residence. The deputies were advised the ATV had been reported stolen. Gonza- lez- Cervantes and other occupants were located inside the residence along with possible items from previous burglaries. Gonzalez- Cervantes failed to appear in court as ordered. • Xavier Cleveland Jones was sentenced to two years in state prison for grand Theft. Jones entered a local business and attempted to buy items with his credit card which totaled $2,273.25. When the card was denied Jones supposed- ly contacted the credit card company who was then able to walk the clerk through the trans- action process until it was approved. An inves- tigation into the inci- dent revealed that the transaction had been forced and it was initial- ly denied because the account was frozen due to it being overdrawn by $11,000. • Jason Edward Dal- ton was sentenced to two years in state prison for corporal injury to spouse/cohabitant/child ’s parent, attempt: resist, obstruct, delay of peace officer. Officers respond to a residence regarding a disturbance between Dalton and victim. Upon arrival officers were advised Dalton and victim had been in an argument which resulted in Dalton using his head to hit the vic- tim in the nose before leaving the scene. Dal- ton was originally granted formal proba- tion. He violated his probation when he failed to obey all laws as ordered. • Thomas Matthew Garry was sentenced to two years in state prison for transportation of marijuana, resist, obstruct, delay of peace Officer or EMT. An officer conducted a traffic stop on a vehi- cle driven by Garry. The officer was advised Garry’s drivers license was suspended. A search of the vehicle revealed marijuana and methamphetamine smoking pipes along with another bag of marijuana found hidden in Garry’s sock. Garry fled the scene on foot after being advised he was under arrest but soon after surrendered and was taken into cus- tody. • Gregorio Fernandez was sentenced to 90 days in Tehama County Jail for possession of a controlled substance and Pablo Camacho Ramos was sentenced to two years in state prison for possession for sale of a controlled sub- stance. Agents served a search warrant at a resi- dence occupied by Fer- nandez and Ramos. Inside the residence agents located metham- phetamine. Recent County Jail Commitments: • Deena Elyse Clark was sentenced to 90 days in Tehama County Jail for petty theft with a prior. Clark was observed by a store security offi- cer grabbing items from a shelf and placing them in her purse. Clark then attempted to leave the store without paying for the items when she was detained by the security officer. • James Andy Mor- phis Stone was sen- tenced to 60 days in Tehama County Jail for possession for sale of a controlled substance. Stone was originally granted formal proba- tion. Stone violated his probation when he failed to keep in contact with probation and failed to attend classes as ordered by the court. • Christina Lyn Bilodeau was sentenced to 60 days in Tehama County Jail for receiv- ing stolen property, motor vehicle, failure to appear while on bail- special allegation- offense while on bail or O.R. Bilodeau was origi- nally granted formal probation. She violated her probation when she failed to appear in court as ordered. Bilodeau failed to appear in court as ordered. • Chadwick Edward Carson was sentenced to 60 days in Tehama County Jail for cultivat- ing marijuana. Carson was original- ly granted formal proba- tion. He violated his probation when he test- ed positive for marijua- na. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. Per the requirements of Proposition 36, a defen- dant who possesses drugs cannot be sen- tenced to confinement time in jail or prison. Instead, the court must place defendant on pro- bation and require drug treatment alone. Per the requirements of Propo- sition 36, only upon a third drug related proba- tion violation may the court impose confine- ment time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney’s Office contends that each criminal case is unique and that in cer- tain, specific, cases a defendant should be sentenced to a combina- tion of drug treatment and jail time. We fur- ther contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treat- ment, a state prison sen- tence should properly be imposed. • Caleb Robert Hat- field was sentenced to Prop. 36 probation for transportation of mari- juana, possession of a controlled substance. A deputy received consent to search the hotel room in which Hatfield had been stay- ing. During the search the deputy located a hypodermic syringe along with Norco pills. A deputy conducted a traffic stop on a vehicle being driven by Hat- field. During a consent search of the vehicle the deputy located marijua- na. • Joshua Greg Wiede- mann was sentenced to Prop. 36 probation for transportation of a con- trolled substance. An officer conducted a traffic stop on a vehi- cle driven by Wiede- mann. A search of the vehicle revealed hypodermic syringes and methamphetamine. • Michael Wayne Collins was sentenced to Prop. 36 probation for possession of a con- trolled substance,-spe- cial allegation-prior felony. During a parole search of Collins’ resi- dence agents located methamphetamine. • Joanna Michelle East was sentenced to Prop. 36 probation for transportation of a con- trolled substance, trans- portation of a controlled substance. A deputy conducted a traffic stop on a vehicle where East was a pas- senger. East was arrest- ed after the deputy con- firmed she had two felony warrants.
