Tuesday, December 10, 2013 – Daily News 5B Government sells remaining stake in GM DETROIT (AP) — The U.S. government ended up losing $10.5 billion on the General Motors bailout, but it says the alternative would have been far worse. The Treasury Department sold its final shares of the Detroit auto giant on Monday, recovering $39 billion of the $49.5 billion it spent to save the dying automaker at the height of the financial crisis five years ago. Without the bailout, the country would have lost more than a million jobs, and the economy could have slipped from recession into a depression, Treasury Secretary Jacob Lew said on a conference call with reporters. Now, the American auto industry is back, President Barack Obama said in a statement. ''Some of the most high-tech, fuel-efficient cars in the world are once again designed, engineered, and built right here in America — and the rest of the world is buying more of them than ever before,'' he said. The government received 912 million GM shares, or a 60.8 percent stake, in exchange for the bailout in 2008 and 2009. It began selling shares once GM went public again in November of 2010, and the pace picked up this year as the stock rose more than 40 percent. Last month, the government said it expected to sell its remaining 2 percent stake by the end of the year. Earlier Monday, Mark Reuss, GM's North American president, told reporters in Warren, Mich., that a government exit would boost sales, especially among pickup truck buyers. GM has said repeatedly that some potential customers have stayed away from its brands because they object to the government intervening in a private company's finances. Because of the bailout, GM had been tagged with the derisive nickname ''Government Motors.'' ''We will always be grateful for the second chance extended to us, and we are doing our best to make the most of it,'' GM Chairman and CEO Dan Akerson said in a statement. During the conference call, treasury officials shrugged off a question about whether GM should have been required to pay more because it has a large cash stockpile, saying that the bulk of the bailout money was converted to GM stock. Not doing the bailout would have cost the government more than it lost in missed tax revenue and payments for unemployment benefits and pensions, the officials said. The company now is sitting on $26.8 billion in cash and is considering restoration of a dividend. GM went through bankruptcy protection in 2009 and was cleansed of most of its huge debt, while stockholders lost their investments. Since leaving bankruptcy, GM has been profitable for 15 straight quarters, racking up almost $20 billion in net income on strong new products and rising sales in North America Naval academy chief discusses sexual assault case ANNAPOLIS, Md. (AP) — The U.S. Naval Academy superintendent said Monday that he decided to court-martial two midshipmen in a sexual assault case against a military judge's recommendation because it is his duty to make sure the charges are fully examined. Vice Adm. Michael Miller decided in October to court-martial Midshipman Eric Graham on a charge of abusive sexual contact and Midshipman Joshua Tate on a charge of aggravated sexual assault of a female midshipman during an off-campus party last year. He spoke of his decision for the first time publicly on Monday during a break at a meeting of the academy's Board of Visitors. ''I wanted to ensure that after all of the investment of the time here that we were able to say, yes, we looked at this in great detail and that either there was an offense or there was not, and the only way I could get to that was through a court-martial,'' Miller said when asked about his decision by The Associated Press. A military judge had recommended in a 171-page report that the cases not move forward. While the investigating officer found reasonable grounds to believe offenses may have been committed, he said heavy damage done to the alleged victim's testimony made it difficult ''if not impossible'' to prove the case beyond a reasonable doubt. Miller noted that the investigating officer did find reasonable grounds to believe an offense may have been committed by the two students. The superintendent said he believes it's important for students to feel comfortable that such allegations will be fully investigated. ''One of our constituencies, obviously, is the Brigade of Midshipmen, and so the idea that, you know, just because it is difficult in a trial by court-martial, well, that's why we have the trials,'' Miller said. ''The trials go through and they look to see the fair illumination of those type of details.'' He added the commander ''in a military unit is responsible for that good order and discipline.'' The case has received heightened attention at a time when Congress, the White House and the Pentagon are focusing on stamping out sexual assault in the military. Lawmakers are considering legislation that would remove commanders, including superintendents at the nation's military academies, from the process of deciding whether serious crimes such as sexual misconduct cases go to trial. Attorneys for the students have contended that political pressure has prompted the superintendent to court-martial the students, despite the investigating officer's recommendation not to move forward to trial after a hearing that ended in September. Miller said Monday that the investigating officer's report is legal advice, but that the ultimate decision rests with him as the superintendent. The alleged victim has said she was drinking and does not remember having sex with the men at the April 2012 party but heard about it later from others. Sanctuary sought for Iowa alligator WATERLOO, Iowa (AP) — Animal control officials in the Iowa city of Waterloo are seeking a new home for a baby alligator named Chompey. A resident of the eastern Iowa city of about 68,000 people bought the alligator after spotting an online advertisement, but he later learned state law does not allow people to keep alligators or other exotic animals, The Waterloo-Cedar Falls Courier reported Monday. The resident turned the gator in to animal control officials, who kept the creature in an aquarium while figuring out what to do with it. Then the gator started snapping and making noises. ''He was really kind of cute, but he was also kind of naughty,'' said Maria Tiller, Waterloo's code enforcement forewoman. ''I didn't want him in my office anymore.'' The alligator was moved to the Pawsitive Pet Care, a veterinary center, where staffed dubbed the animal ''Chompey.'' The alligator then was sent to a herpetologist in Des Moines, where the animal's being held in quarantine while staff seek a sanctuary in a warmer climate for Chompey. Josh Colvin, who heads animal control for Animal Rescue of Iowa, said alligator reports have dropped since the state ban on exotic animals was approved in 2007. Still, he said, people occasionally drop off gators. ''They just don't realize they are going to grow up and get big,'' Colvin said. ''The unfortunate part is that people don't think it through, and then animal control has to pick up the pieces.'' Iowa law also bans residents from owning lions, tigers, cougars, leopards, ocelots, elephants, bears, monkeys, crocodiles and some snakes. Exceptions can be made for zoos, circuses, fairs, animal shelters, veterinarians and researchers. and China. It also has invested $8.8 billion in U.S. facilities and has added about 3,000 workers, bringing U.S. employment to 80,000. GM shares rose 44 cents, or 1.1 percent, to $41.34 in afterhours trading following the announcement. They rose 1.8 percent in regular trading, at one point reaching $41.17, the highest level since GM's 2010 initial public offering. The auto bailout was part of the Troubled Asset Relief Program, with the bulk of the money going to financial institutions. Treasury said it spent $421.8 billion on bailouts and so far has recovered $432.7 billion, including the loss on GM. The Center for Automotive Research, an Ann Arbor, Mich., think tank, issued an updated report on Monday saying that if the government hadn't intervened and GM went out of business, nearly 1.9 million jobs would have been lost in 2009 and 2010. Federal and state governments also would have lost $39.4 billion in tax revenue and payments made for unemployment benefits and food stamps, the study said. But critics say the bailout put the government in a position to choose winners and losers when it should have stayed out of private business.
