6B – Daily News – Wednesday, December 22, 2010 Court Round-Up The following defendants were sentenced in Tehama County Supe- rior Court, according to the Tehama County District Attorney’s Office: —————— Recent State Prison Commitments: • Mitchell Scott Allen was sentenced to four years in state prison for transportation of marijuana. Allen was originally granted formal probation. He violated his pro- bation when he was arrested for unlawfully causing a fire on inhabited property. • Raul Campos Rivas was sentenced to three years in state prison for possession of marijuana for sale, special allegation-armed with firearm. Deputies observed two vehicles traveling together west of Corning. As the deputies pulled in behind the vehicle driven by Rivas they noticed the vehicle began slowing down. Rivas then turned off all his vehicle lights and jumped out the driver’s side door in an attempt to escape. After a short foot chase a deputy was able to deploy his taser and get Rivas into custody. A search of Rivas’ vehicle revealed sever- al large duffle bags full of marijuana as well as a .357 caliber revolver. • Stephanie Marie Ables was sentenced to two years in state prison for possession for sale of a controlled substance. Ables was originally granted formal probation. She violated her probation when she was arrested for driving under the influence of alcohol. • James Matthew Lister was sentenced to two years in state prison for corporal injury to co-habitant. Deputies respond to a residence regarding a domestic disturbance. Upon arrival deputies were advised Lister and victim had been in an argument which resulted in Lister biting the victim on the nose. • Gilberto Espinoza Medina was sentenced to two years in state prison for perjury by declaration. Medina obtained employment at a local business using a false social security card and number. • Wayne Randall Quinn was sentenced to 16 months in state prison for driving under the influence of alcohol or drugs-three priors. Quinn was driving his vehicle when he lost control, rolled his vehi- cle and came to a stop after hitting a tree. Officers arrived on scene and contacted Quinn where they determined he was under the influence of alcohol. Recent County Jail Commitments: • Kenneth Douglas McDonald was sentenced to 365 days in Tehama County Jail for transportation of a controlled substance. McDonald was originally granted formal probation. He violated his probation when he failed to keep in contact with probation as ordered. • Christopher Lee Baker was sentenced to 180 days in Tehama County Jail for unlawful driving or taking of a vehicle. Officers respond to a local used car dealership regarding the theft of a vehicle. An investigation into the incident revealed Baker had stolen a vehicle from the car lot and later abandoned it east of town. • Kyle Micah Bailey was sentenced to 90 days in Tehama County Jail for possession of concentrated cannabis. A deputy conducted a traffic stop on a vehicle driven by Bailey. Upon contacting Bailey the deputy noticed the odor of marijuana com- ing from the vehicle. A search of the vehicle revealed a large amount of marijuana and concentrated cannabis. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non- drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney’s Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treat- ment, a state prison sentence should properly be imposed. • Louis William Buelna was sentenced to Prop. 36 probation for possession of a controlled substance. Buelna was contacted by an officer and arrested on outstanding warrants. The officer conducted a search of Buelna and located a small amount of methamphetamine in his shirt pocket. Upcoming Court Dates -Trials, Preliminary Hearings(PX) & Pre Trial Conferences(PTC): • Jeffrey S. Vanderveer will appear in court at 9 a.m. on Jan. 11 in Department 3. He is facing the charge of possession of matter depict- ing minor engaging in sexual conduct. Vanderveer was being investigated for filming girls at a local gym by mounting a camera under a desk. During the investigation Van- derveer’s computer was seized and investigators located several items of child pornography. • Joseph Dailey Froome and Daniel Miguel Ludwig will appear in court at 9 a.m. on March 15. Both men are facing the charges of culti- vating marijuana and possession of marijuana for sale. Froome is fac- ing the additional charge of eight counts of money laundering. Agents served a search warrant at the defendant’s warehouse off of Baker Road in Red Bluff. Inside they found over 400 marijuana plants. TIDE agents also located over 30 pounds of processed marijuana. Volunteer opportunities • The Guardian Angel Foun- dation is a non-profit organiza- tion that helps families in need through a referral process from different agencies in Tehama County. Volunteers are needed to help with the clean up and organization of donated items. Help is also needed to lift heavy objects and yard work. Informa- tion is available at 384-9857. • AARP/IRS, under their Tax- Aide Program is seeking local volunteers to assist Tehama and Glenn county residents with state and federal tax preparation. Bilingual volunteers are also needed. They accept and train volunteers between October and December. Volunteers are asked to give a minimum commitment of four hours per week between Feb. 1 and April 15. Expenses are reimbursed on a limited basis.
