4B Daily News – Thursday, June 28, 2012 The following defendants were sen- tenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: —————— COURT ROUND-UP Recent State Prison Commitments • Frank Spike Roehrich was sentenced to four years in state prison for indecent exposure with prior sexual offense. Roehrich was observed to be nude and standing in the front doorway of his resi- dence while people were driving by. • Michael Wayne Collins was sentenced to three years and four months in state prison for possession of a controlled sub- stance, special allegation-prior felony. Collins was originally granted formal probation. He violated his probation when he was terminated from his drug and alco- hol treatment program, went out of coun- ty without permission and failed to keep in contact with probation. • Christine Renee Nicoll was sentenced to three years in state prison for corporal injury to spouse. Nicoll was originally granted formal probation. She violated her probation when she tested positive for methampheta- mine. • Kristie Diane Gonzalez was sentenced to 16 months in state prison for possession for sale of a controlled substance. Agents served a search warrant at Gon- sold it to an auto recycling business for cash. Inside the vehicle officers noticed the ignition had been punched and there was a forged bill of sale from the victim. Recent County Jail Commitments • Lamyai Sengxay & Eduardo Ramos 270 days in county jail for possession of marijuana for sale. Madrigal was released from custody on bail and failed to appear in court as ordered. • Gilbert Lee May was sentenced to eight years, four months in state prison for two counts of sale of a controlled sub- stance-methadone, sale of a controlled substance-hydrocodone and maintaining place for selling or using controlled sub- stance Agents served a search warrant at a res- idence and located both Sengxay and Galvez inside the home. During the search agents located several hundred marijuana plants, packaging material, a digital scale and several firearms. • Frederick Wayne Appleby was sen- tenced to 180 days in Tehama County Jail for post release community supervision. Appleby was released from prison on post release community supervision. Appleby violated the terms of supervision when he failed to enroll in drug treatment, failed to keep in contact with probation and was arrested out of county for trans- portation of marijuana. • Brooke Nicole Maciel was sentenced to 120 days in Tehama County Jail for grand theft firearm. Victim reported her purse containing credit cards and a handgun had been stolen from her vehicle. An investigation into the incident led deputies to the Maciel. It was determined Maciel had used the victim's credit card to make purchases. Maciel also stole the gun from the victim's purse which was later located in Maciel's bed- room. • Chad Randle Hembree was sentenced to 90 days in Tehama County Jail for pos- session of ammunition. Investigators had learned that Hembree vehicle driven by Samontry. The officer observed the odor of marijuana and con- ducted a search of the vehicle. Inside the trunk of the vehicle the officer locat- ed marijuana and cash. • TJ Michael Williams was sentenced to 270 days in county jail for possession of firearm by felon. An officer stopped a vehicle matching the description of one involved in bran- dishing a gun. During a search of the vehi- cle the officer located a loaded revolver under Williams' seat. • Roberto Arenas was sentenced to 60 das in county jail for possession of ammu- nition and failure to appear on wwn recog- nizance. observed to be in a disabled vehicle on the side of the highway. The deputy conducted a consent search of the vehicle and located a magazine containing rounds of ammuni- tion. The deputy was advised Arenas was a convicted felon and he was then taken into custody. Arenas was released from custody on his own recognizance and failed to appear in court as ordered. The drug sale was monitored and recorded by T.I.D.E. agents. • Corbette Frank Wilson was sentenced • Orville Daniel Mendenhall was sen- tenced to 85 days in Tehama County Jail for failure to appear on own recognizance. Mendenhall was released from custody to five years in state prison for assault with a deadly weapon, special allegation — prior felony and violation of Post Release Community Supervision. Wilson was angry with the victim and attempted to confront him at his residence but was unable to make contact. The vic- tim then went to Wilson's location to con- front him about the dispute at which point Wilson pulled out a knife and stabbed the victim in the face. Wilson was released from prison on post release community supervision. Wilson violated his terms of supervision based on the incident. • Janice Christine Lavelle was sen- tenced to three years in state prison for two counts of possession of marijuana for sale. Lavelle was originally granted formal probation. Lavelle violated her probation when officers conducted a probation search of her residence and located alco- hol. Lavelle also tested positive for mari- juana. • Robert Darrol Wilson was sentenced to 16 months in state prison for unlawful driving or taking of a vehicle. Wilson had stolen victim's pickup and defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defen- dant on probation and require drug treat- ment alone. Per the requirements of Propo- sition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defen- dant violates a non-drug related term of probation the court may then elect to sen- tence defendant to jail or prison. She violated her probation when she tested positive for methampheta- mine and marijuana. • Shawn Allen Draper was sentenced to 20 days in Tehama County Jail for attempted second degree burglary. Draper was originally granted formal probation. He violated his probation when he tested positive for methamphetamine. • Erin Elizabeth Parker was sentenced to 60 days in Tehama County Jail for aid by misrepresentation-over $400. Parker received cash aid from the coun- ty and failed to report that she was living with two other people at the time. • Jimmy Samontry was sentenced to Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combi- nation of drug treatment and jail time. Sellers was a passenger in a vehicle that several prescription was stopped for a traffic violation. During a search Sellers was found in possession of methamphetamine. Upon arrival officers began investigating the incident and learned Lewis had given the victim pills and slit his throat in a failed attempt to kill him. Lewis was arrested and taken into custody. • People vs. Laura Lynn East — four counts of child abuse. Sentencing: July 9 at 9 a.m. in Depart- July 2 at 1:15 p.m. in Department 2.
