ByMichaelR.Blood The Associated Press LOS ANGELES ACalifornia panel tasked with attempt- ing to eradicate racial pro- filing by police held its first meeting Friday, with the nation stunned by the po- lice shootings of two black men in Minnesota and Lou- isiana, followed by the Dal- las attack that killed five of- ficers. An emotional Attor- ney General Kamala Har- ris urged the group to seek truth about a difficult prob- lem at a time of turmoil. The Racial and Identity Profiling Advisory Board was created by the Legisla- ture last year to address the frequent complaint that po- lice too often target people based on the color of their skin. The career prosecutor, who is black and Indian, credited police for their commitment to a danger- ous job serving the pub- lic. But she added that she didn't know a black man among her relatives and friends who has not been subjected to profiling or un- reasonable treatment. "This has to be a moment when we speak the truth, and in speaking the truth, heal," Harris said. "We know the pain that folks are feeling, the pain of those families, in Ba- ton Rouge and Minneapo- lis and Dallas, and all over our country," she added. The fatal police shoot- ings of black men in Min- nesota and Louisiana set off protests around the coun- try, including in Oakland, California, where about 2,000 people blocked a highway and smashed win- dows, leading to seven ar- rests, authorities said. The panel's job will in- clude helping the state Jus- tice Department establish a system to collect data from police on how they conduct traffic and pedestrian stops, then analyzing that infor- mation and making recom- mendations. Its first step is to consider what information should be collected, which could range from details of traf- fic stops to documenting the work experience of of- ficers involved. Some board members noted that it would take goodwill from police and those they serve to make progress. "If both sides don't come together, we are not going to accomplish a lot," said Gardena Police Chief Ed- ward Medrano, represent- ing the California Police Chiefs Association. Harris says bias in the criminal justice system is destructive to the trust needed between police and communities. She told reporters that the violence of recent days is "really highlighting something that we have to deal with in our country." CALIFORNIA Pa ne l ta ke s up c om pl ex t as k: e nd r ac ia l pr o fi li ng By Sudhin Thanawala The Associated Press SAN FRANCISCO Federal officials are under no ob- ligation to reinstate Na- tive American tribe mem- bers who may have been wrongly expelled in cases where the tribe has final say over enrollment de- cisions, a federal appeals court said Friday. The 9th U.S. Circuit Court of Appeals upheld a decision by the federal Bu- reau of Indian Affairs not to overrule a California casino-owning tribe's ex- pulsion of more than 150 members. The court agreed with the federal agency that tribal law gave the San Di- ego County-based Pala Band of Mission Indians ultimate authority over en- rollment decisions. "In reaching our deci- sion, we recognize with re- gret that plaintiffs will suf- fer severe and significant consequences from losing their membership in the Pala Band," Judge Milan Smith wrote for the three- judge panel. But he went on to say that the federal government does not interfere in tribal enrollment decisions "in the absence of specific author- ity to do so." The Pala's executive com- mittee decided several years ago that the members' an- cestral bloodlines disquali- fied them from enrollment. The members accused tribal officials of trying to increase their share of prof- its from the Pala Casino Spa Resort. "It's like an atomic bomb's been dropped," said Tracy Emblem, an attorney for expelled Pala members who said she is looking into a possible appeal. Similar membership purges have affected hun- dreds of people in tribes around the country. They are particularly numer- ous in California, where many tribes reconstituted over the last several de- cades and then entered the casino business, ac- cording to advocates. Ex- pelled tribal members can lose thousands of dollars in monthly stipends and other benefits. The Pala dispute centers on whether a revered tribal elder who has since died, Margarita Britten, was half Pala or a full-blooded Pala. If she was half Indian, as the tribe has ruled, that means her descendants with less than 1/16th of Pala blood are not entitled to tribal membership.
