The City Council of the City of Red Bluff approves the report for the Downtown Red Bluff Parking and Business Improve- ment Area submitted by Down- town Red Bluff Business Associ- ation and adopts the following resolution of intention: 1. It is the intention of the City Council to retain the same boundaries of the parking and business improvement area and the same benefit zones within the area as were in place during the previous fiscal year. 2. It is the intention of the City Council to levy and collect assessments within the existing parking and business improve- ment area for the fiscal year. There shall be no change in the dollar amount of assessments from the previous fiscal year. 3. The improvements and activities authorized by Ordi- nance No. 869 and Resolution No. 16-1995 are as follows: Improvements: Seasonal and other decorations; decorative street lighting; beautification plantings; parking facilities; benches; fountains; outside mu- sic; and trash receptacles. Activities: The promotion of public events which benefit businesses in the Area and which take place on or in public places within the Area, including festivals, parades, fairs and con- certs; the furnishing of music in any public place within the Area; activities which benefit businesses located and operat- ing within the Area; the promo- tion of tourism within the Area. No substantial changes are pro- posed to be made to the im- provements and activities. 4. The name of the Park- ing and Business Improvement Area is the Downtown Red Bluff Parking and Business Improve- ment Area. The location of the Area is a portion of the City of Red Bluff as set forth in Sched- ule A of this resolution attached hereto and by such reference made a part hereof. The loca- tion of the "benefit zones" with- in the Area is also shown in Schedule A. 5. A copy of the annual re- port filed with the Clerk of the City by the Downtown Red Bluff Business Association and is available for review at City Hall. This report sets forth a full and detailed description of the im- provements and activities to be provided for the fiscal year, any proposed boundary changes of the Area and any proposed zone changes within the Area and the proposed assessments to be levied upon the businesses within the Area for the fiscal year. 6. At the public hearing, the City Council shall hear and consider all protests against the levying of assessments within the area. A protest may be made orally or in writing by any interested person. Any protest pertaining to the regularity or sufficiency of the proceedings shall be in writing and shall clearly set forth the irregularity or defect to which the objection is made. Every written protest shall be filed with the clerk at or before the time fixed for the public hearing. The City Council may waive any irregularity in the form or content of any written protest and at the public hear- ing may correct minor defects in the proceedings. A written pro- test may be withdrawn in writ- ing at any time before the con- clusion of the public hearing. Each written protest shall con- tain a description of the busi- ness in which the person sub- scribing the protest is interest- ed sufficient to identify the busi- ness and, if a person subscrib- ing is not shown on the official records of the city the ing records of the city as the owner of the business, the protest shall contain or be accompanied by written evidence that the person subscribing is the owner of the business. A written protest, which does not comply with this section, shall not be counted in determining a majority protest. The time and place for the public hearing to be held by the City Council on the levy of the proposed assessment for the fiscal year shall be January 5, 2016 at 7 p.m. at the City Council Chambers, 555 Washing- ton Street, Red Bluff California. In order to pro- tect the health, safety and wel- fare of the citizens of Red Bluff, Chapter 8: Fire Department, Arti- cle II: FIRE CODE, Section 8.17 of the Code of The City of Red Bluff is amended to read as follows: 8.17 BURNING. Section 307 of the Inter- national Fire Code is amended in the following respects. The Fire Chief, Air Pollu- tion Control Officer, or their au- thorized representative is au- thorized to require that open burning be immediately discon- tinued, if he or she determines that smoke emissions are offen- sive to occupants of surround- ing property, or if the open burn- ing is determined to constitute a hazardous condition. The Fire Chief is author- ized to enforce a ban on all open burning during periods of criti- cal fire danger. (A) Open Burning/Residential. (1) Residential Open burning, including without limitation burn barrels, is pro- hibited within the City of Red Bluff at all times. (2) The follow- ing exceptions apply to the ban on residential open burning: ( a ) Fire used for the cook- ing of food products for human consumption within an appro- priate barbeque on public or pri- vate property. ( b ) Fires permitted in para- graph (B) "Land clearing" or (C) paragraph "Special Events" be- low. ( c ) Portable manufactured outdoor fireplaces may be used in accordance with the manu- facturer's instructions and shall not be operated within 15 feet of a structure or within 15 feet any combustible materials. Only small twigs, sticks, or properly- sized natural wood (approved by the AHJ) shall be used. These portable outdoor fireplaces shall only be used on private property in which the person burning has the burden of proof they have permission to be on the property. Outdoor fireplaces shall be continuously attended until the fire is extinguished. A minimum of one portable fire extinguisher complying with Section 906 of the California Fire Code with a minimum of a 4-A rating or other approved on-site fire extinguishing equipment, such as water barrels of no less than 5 gallons or water hoses, shall be available for immediate utilization. If the fire escapes, that person will be held liable for damages and/or suppres- sion costs. At any time, the Fire Chief and/or their representa- tive reserves the right to deter- mine the fire a nuisance and have the fire extinguished. (B) Land Clearing. (1) A land clear- ing permit must be obtained first from Tehama County Air Pollution Control and then from County Pollution Control and then from Red Bluff Fire Department. (2) A water sup- ply or other approved fire- extinguishing equipment shall be readily available for use at the open burning site. (3) The burning site shall be attended by a per- son knowledgeable in the use of the fire-extinguishing equip- ment required by this section. An attendant shall supervise the burning material until the fire has been extinguished. (C) Special Events. Spe- cial event burning is authorized when a permit is obtained for a warming fire or cooking with the following criteria: (1) Pit location must be inspected prior to dig- ging; (2) Twenty- foot clearance of all vegetation around the pit; (3) There must be at least one adult in actual attendance with water, garden hose, shovel, or other fire extinguishing equipment on hand at all times.; (4) The pit must have a wire-mesh top; (5) Only wood or barbecue charcoal can be burned in the pit. (D) With the prior written approval of the Fire Chief and the Air Pollution Con- trol Officer, or their authorized representative(s), fires set to in- struct or train public or industri- al employees in methods of firefighting are permitted. SECTION 3. Within 15 days from the passage thereof, this ordinance shall be published at least once in the Red Bluff Daily News, a newspaper of general circulation, published and circu- lated in the City of Red Bluff.
