Monday, March 21, 2011 – Daily News – 5B COURT ROUND-UP The following defendants were sentenced in Tehama County Superior Court, according to the Tehama Coun- ty District Attorney’s Office: —————— Recent State Prison Com- mitments: • Albert Joseph Chekan was sentenced to 11 years in state prison for driving under the influence of alcohol or drugs, special allegation-prior felony,-special allegation- prior strikes. An officer conducted a traffic stop on a vehicle driven by Chekan. Upon contacting the defendant the officer observed the odor of alcohol emitting from Chekan’s breath. After failing the field sobriety tests Chekan was taken into custody. • Dickie Wayne Puckett was sentenced to eight years in state prison for driving with a .08 percent blood alco- hol causing injury, special allegation-Over .15 percent Blood Alcohol,-special allega- tion-great bodily injury,-spe- cial allegation-bodily injury to more than one victim. Officers respond to a traffic collision involving injuries. Upon arrival officers contact Puckett who appeared to be under the influence of alco- hol. Upon speaking with Puckett officers observed his speech to be slurred as well as Puckett being very unsteady on his feet. Puckett was then arrested and taken into cus- tody. The victims in the other car all received injuries as a result of this collision and were transported to the hospi- tal. • Ernest Leroy Franklin was sentenced to six years in state prison for failure to reg- ister: initial registration, after address change. Franklin was originally granted formal probation. He violated his probation when he failed to keep in contact with his probation officer. • Christopher Lee Poehler was sentenced to six years in state prison for lewd act upon a child. Poehler was originally granted formal probation. He violated his probation upon being in possession of pornography. • Brett David Norris was sentenced to three years, eighth months in state prison for petty theft with a prior, second degree commercial burglary. Norris was originally granted formal probation. He violated his probation when he was arrested for being under the influence of alco- hol. An employee at a local business observed defendant walk into a store, grab a bottle of alcohol and leave without paying. • Jorge Perez Sandoval Jr., was sentenced to two years in state prison for assault with a firearm, false imprisonment by violence. Deputies were dispatched to Sandoval’s residence regarding a domestic dispute. Upon arrival deputies were advised Sandoval and victim had been arguing. As the vic- tim attempted to leave the res- idence Sandoval grabbed her by the hair and dragged her back into the residence. San- doval then grabbed a shotgun and pointed it at victim’s face. The victim was eventu- ally able to escape and run to a neighbor’s house for help. • Franco Villalobos Corne- jo & Jaime Espinoza Lucatero were each sentenced to 16 months in state prison for possession for sale of a con- trolled substance. An officer conducted a traffic stop on a vehicle occu- pied by both Cornejo and Lucatero. With the use of a canine the officer was able to locate methamphetamine inside the vehicle. Recent County Jail Com- mitments: • Dominic Mackenzie Arnold was sentenced to 180 days in Tehama County Jail for corporal injury to cohabi- tant, battery with serious bod- ily injury. Officers respond to a resi- dence regarding a domestic dispute. Upon arrival officers were advised Arnold had gone to the first victim’s residence and found another man, vic- tim 2, had been staying there. Arnold then grabbed a knife and swung it at victim-2 who was then able to escape to a neighbor’s house. During the altercation with victim-2, vic- tim-1 had been struck above the eye. • Angela Christina Lomic- ka was sentenced to 90 days in Tehama County Jail for grand theft by embezzlement. Lomicka was the payee for her mentally disabled rela- tive’s social security benefits. During the time of receiving these benefits Lomicka would use the money for her own personal use. • Ronald Raymond Williams was sentenced to 30 days in Tehama County Jail for corporal injury to spouse/cohabitant/child’s par- ent. A deputy contacted the vic- tim in regards to a domestic dispute with Williams. The deputy was advised Williams had gotten upset and began punching the victim in the head several times. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. the event the defendant vio- lates a non-drug related term of probation the court may then elect to sentence defen- dant to jail or prison. The Tehama County Dis- trict Attorney’s Office con- tends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a com- bination of drug treatment and jail time. He is facing the charge of possession of matter depict- ing minor engaging in sexual conduct. Vanderveer was being investigated for filming girls at a local gym by mounting a camera under a desk. During the investigation the Van- derveer’s computer was seized and investigators locat- ed several items of child pornography.
