The following defen- dants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: —————— Recent State/Local Prison Commitments: People vs. Jonathan Paul Castro, First Degree Bur- glary, Person Present with Special Allegation -Prior Strike, -First Degree Bur- glary, Person Present with Special Allegation -Prior Strike. Brief history: Defendant had broken into two sepa- rate homes on the same night while the victims were present. Officers were con- tacted and upon arrival they located the defendant inside the residence belonging to the second victim. Defen- dant was found in posses- sion of numerous items belonging to the first victim. Sentenced to 10 years 8 months State Prison. People vs. Daniel Walter Llamas, Child Abuse with Special Allegation Willful Harm or Injury Resulting in Death. Brief history: The 13 month old victim died as a result of injuries sustained while in the custody and care of Llamas and Rios. Sentenced to 10 years State Prison. People vs. Micah Timo- thy Sims, Possession For Sale of a Controlled Sub- stance with Special Allega- tion -Offense While on Bail or O.R., Special Allegation Personally Armed/Firearm Controlled Substances, Pos- session of Ammunition. Brief history: Officers served a search warrant at defendant's residence and located a handgun, digital scales, packaging material and methamphetamine. Sentenced to 8 years State Prison. People vs. Jose Guadalupe Munoz, Sale of a Controlled Substance with Special Allegation Sale Near School. Brief history: Defendant was originally granted for- mal probation. Defendant violated his probation when he drove a vehicle while having a suspended license and was found in possession of methamphetamine. Sentenced to 6 years Local Prison. People vs. Jason Wesley Boyd, Transportation of a Controlled Substance. Brief history: A deputy conducted a traffic stop on a vehicle driven by defendant. The deputy w a s advised the vehicle was stolen and a search was con- ducted. Inside the vehicle the deputy located metham- phetamine, heroin and mar- ijuana. Sentenced to 4 years Local Prison. People vs. Kenneth Wayne Jones, Possession for Sale of a Controlled Substance; Second Degree Commercial Burglary; Sec- ond Degree Commercial Burglary; Second Degree Commercial Burglary. Brief history: Defendant was originally granted for- mal probation on all cases. Defendant violated his pro- bation when he failed to appear for scheduled appointments with proba- tion and upon his violation. Defendant entered a gro- cery store and purchased items with counterfeit money. Officers contacted defendant and conducted a probation search of his resi- dence and located addition- al counterfeit money. Sentenced to 3 years 4 months Local Prison. People vs. Paul Maurice Tuerlings, Driving Under the Influence of Alcohol or Drugs with Special Allega- tion Excess Blood Alcohol. Brief history: Defendant was observed staggering around his residence and then getting into his vehicle and striking a fence. Offi- cers contacted defendant and observed the odor of alcohol emitting from his person. The defendant was arrested and taken into cus- tody. Sentenced to 3 years State Prison. People vs. Robert Lloyd Perozzi, Possession of Firearm by Felon (2 counts), Receiving Stolen Property with Special Alle- gation Prior Felony. Brief history: A witness observed defendant inside a vehicle parked outside of a residence. The defendant and other occupants eventu- ally sped away in the vehi- cle crashing through a fence. Deputies were able to locate the vehicle and found several items that were stolen from the residence defendant was observed parked in front of. Sentenced to 3 years State Prison People vs. Joseph Edward Garibay, Carrying a Dirk or Dagger with Special Allegation Prior Strike. Brief history: Officers contacted defendant and observed him smoking mar- ijuana with an ice pick sticking out of his pocket. The officers pro- ceeded to conduct a search when the defendant began to resist. After a brief strug- gle defendant was taken into custody. Sentenced to 32 months State Prison. People vs. Sergio Manuel Martinez, Petty Theft with Priors with Spe- cial Allegation Prior Felony. Brief history: A witness observed defendant rum- maging through victim's vehicle and contacted the police. Officers contacted defendant who was found in possession of a wrench that was taken from victim's vehicle. Sentenced to 2 years Local Prison. People vs. Edward Ray Robinson, Driving While Having a 0.08% or Higher Blood Alcohol with Special Allegation Prior Felony. Brief history: An officer contacted defendant after he was observed driving his vehicle recklessly on the roadway. The defendant failed a series of field sobri- ety tests and was taken into custody. Sentenced to 16 months State Prison. Recent County Jail Commitments: People vs. Erica Leah Nolen, Failure to Appear While on Bail. Brief history: Defendant was released from custody on bail and failed to appear in court as required. Sentenced to 120 days county jail. People vs. Vanessa Gabrial Hayes, Possession of a Controlled Substance. Brief history: Defendant was originally granted for- mal probation. Defendant violated her probation when she failed to complete her drug and alcohol treatment program, failed to keep pro- bation informed of her cur- rent contact information and tested positive for marijuana and opiates. Sentenced to 90 days county jail. People vs. Steven Cole Pine, Transportation of Marijuana with Special Allegation Armed with a Firearm. Brief history: An under- cover officer responded to an online advertisement posted by the defendant looking to sell marijuana for other items. The defendant agreed to sell marijuana and hash in exchange for firearms. Upon arriving at the arranged location defen- dant was found in posses- sion of a handguns, knives, marijuana and hash. Sentenced to 120 days county jail. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who pos- sesses drugs cannot be sen- tenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Propo- sition 36, only upon a third drug related probation vio- lation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defen- dant to jail or prison. People vs. Jason Thomas Carl Morton, Possession of Concentrated Cannabis; Failure to Appear on Own Recognizance. Brief history: Officers responded to the location of a disturbance and contacted the defendant who was in possession of concentrated cannabis. Defendant was released from custody on his own recognizance and failed to appear in court as required. Defendant sentenced to Prop. 36 probation. Defendant sentenced to 90 days county jail. People vs. Jeffrey Louis Castro, Possession of a Controlled Substance; Pos- session of a Controlled Sub- stance with Special Allega- tion Offense While on Bail or O.R.; Failure to Appear on Own Recognizance with Special Allegation Offense While on Bail or O.R. Brief history: An officer contacted defendant on his bicycle for traffic violations and located methampheta- mine and a methampheta- mine pipe near the defen- dant. An officer contacted defendant regarding an out- standing warrant and found him in possession of methamphetamine and a methamphetamine pipe. Defendant was released from custody on his own recognizance and failed to appear in court as required. Defendant sentenced to Prop. 36 probation. Sentenced to 90 days county jail. Upcoming Court Dates -Trials, Preliminary Hear- ings (PX) & Pre Trial Conferences (PTC): People vs. Quentin Ray Bealer, Murder. Brief history: Defendant was arrested and charged with the murder of a 14 year old victim who had been reported missing when she never returned home from school. Officers located the victim's body two days later. Arraignment on Infor- mation: March 3, at 1:15 p.m. in Department 3. People vs. Roger Sandy Bounnhaseng, Alan Duane Doulphus Jr., Chase Alan Doulphus: Murder, special allegation felony murder, personal and intentional, use of a firearm, assault with a firearm, false impris- onment by violence, trans- portation of marijuana. Brief history: The defen- dants went to a residence that contained a marijuana grow. The defendants con- fronted the victim and two other men who were at the residence and ordered them to the ground at gunpoint. The defendants proceeded to tie up the vic- tim and the two men with zip ties and duct tape. The victim was able to free him- self and attempt to flee the residence but was shot sev- eral times by the armed defendants. The victim eventually succumbed to his injuries. Defendant's vehicle was located a short time later and a vehicle pur- suit followed. Defendant's were eventually apprehend- ed and taken into custody. Inside the vehicle officers located a large amount of marijuana. Preliminary Hearing PTC: March 17, at 10 a.m. in Department 1. Preliminary Hearing: March 18, at 1:30 p.m. in Department 2. People vs. Christopher Hougland, Murder with Special Allegation Use of Deadly Weapon, Assault With a Deadly Weapon with Special Allegation –Great Bodily Injury. Brief history: Officers responded to a residence regarding a disturbance. Upon arrival officers locat- ed the victim who appeared to have several stab wounds and was bleeding profusely. The victim eventually suc- cumbed to his injuries and was pronounced dead at the scene. The defendant was arrested and taken into cus- tody. PTC: March 24, April 21, May 5, at 1:15 p.m. in Department 3. TBJ: May 7, at 1:30 p.m. (Department to be determined) People vs. Brandon Eric- son Branscombe, Murder, Assault on a Child Causing Death.
