COURT ROUND-UP The following defendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: —————— Recent State Prison Commitments • Ronald Maurice Anderson was sentenced to three years in state prison and Prop. 36 probation for possession of a controlled substance; possession of a controlled substance. Hosler is a convicted sex offender and failed to update his registration upon moving to a new location. • John Anthony Ables Jr. was sentenced to two years in state prison for first degree residential burglary. Ables had broken into victim's residence and stole numerous items from inside the home. • Michael Vernon Carter Sr. was sentenced to 16 months in state prison for possession of marijuana for sale. Carter was a passenger in a vehicle that was stopped for a traffic violation. During a search of the vehicle the officer located several bags of marijuana. Recent County Jail Commitments • Clifford Clayton Rhoads was sentenced to 180 days in Tehama County Jail for carrying a dirk or dagger with special allegation prior felonies; transportation of a controlled substance. A deputy contacted Rhoads and observed an odor of alcohol emitting from his person. The deputy conducted a search and located two fixed blade knifes in Rhoad's pockets. (NCR86316)-A deputy observed a suspicious vehicle parked in a driveway and contacted Rhoads inside the vehicle. The deputy observed the odor of alcohol and conducted a search of the vehicle and located methamphetamine, a syringe and marijuana. • Daryl Burton Rose was sentenced to 120 days in Tehama County Jail for possession of a controlled substance; possession of a controlled substance. NCR81888Rose was originally granted formal probation. He violated his terms of probation when he was found in possession of methamphetamine. (NCR86030)-Officers conducted a probation search at Rose's residence and located methamphetamine, glass smoking pipes and hypodermic syringes. • Robert Glenn McClure was sentenced to 120 days in Tehama County Jail for post release community supervision. McClure was released from prison to post release community supervision. He violated his terms of supervision when he tested positive for methamphetamine, failed to complete his drug and alcohol treatment program and failed to keep in contact with probation. • Edward Ralph Thompson was sentenced to 128 days in Tehama County Jail for failure to update registration annually. Thompson is a convicted sex offender and failed to update his annual registration. Recent Proposition 36 Commitments Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a nondrug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. • Jack Wayne Colon was sentenced to Prop. 36 probation and 180 days in Tehama County Jail for possession of a controlled substance; post release community supervision. An officer located Colon standing near a business and had knowledge that he was on post release community supervision. The officer then observed Colon throw an object over a nearby fence. A search of the area was conducted and the officer located methamphetamine. Colon was released from prison to post release community supervision. Colon violated his terms of supervision when he failed to keep in contact with probation, failed to complete his drug and alcohol treatment program and was arrested for his violations in SCR33210. • Timothy Carl Putnam was sentenced to Prop. 36 probation for possession of a controlled substance. A deputy conducted a traffic stop on a vehicle in which Putnam was a passenger. Inside the vehicle the deputy located marijuana as well as methamphetamine in Putnam's pocket.
