SERVICE ANIMALS IN A FOOD ESTABLISHMENT Joyce McCluskey, Director, Environmental Health Division, said in a memo issued January 3, 2018, "We have received several complaints and questions lately about service animals in food establishments. A legiti- mate service animal is allowed in a food establishment. However, the only animals approved as service animals at this time are dogs and miniature horses." The memo is also being attached to a new fl yer (Left) released by the Health Deptment last week. So if the animal is not a dog or miniature horse, it is not a service animal. The customer may have a comfort ani- mal but by law, those animals are not allowed in food establishments. According McCluskey, "Only limited inquiries are allowed regarding service animals. Staff may ask two questions: 1. Is the dog (or miniature horse) a service animal required because of a disability, and 2. What work or task has the dog/horse been trained to perform." It is the food establishment's owner's or operator's responsibility to tell the customer to remove the inappropriate animal from the premises. The Health Department has no authority over the customer. The Health Department has authority over the food establishment, however, and this would constitute a critical violation if an inspector saw an inappropri- ate animal in the restaurant at the time of inspection. A critical violation requires a re-inspection within 14 days with a $100 re-inspection fee assessed against the establishment. Additionally, should an animal bite or cause another customer to become ill, the food establishment could be liable for any pain and suffering caused. A legitimate service animal can be excluded from a restaurant if one or more of the following apply (ARS 11-1024): 1. The animal poses a direct threat to the health or safety of others. 2. The animal fundamentally alters the nature of the place or goods, ser- vices or activities provided. 3. The animal poses an undue burden. 4. The animal is out of control and the animal's handler does not take ef- fective action to control the animal. 5. The animal is not housebroken. In other words, the service animal must be well behaved! If the indi- vidual is asked to remove the service animal, the individual can have the opportunity to return to obtain the goods and services.
