The City Council finds and declares as follows: There is a need to periodically update and modify City Building Regulations to reflect changes in California law. SECTION 2. Chapter 5: Construc- tion Regulations, Article II: CODE ADOPTION, of the Code of the City of Red Bluff amended to read as follows: Section 5.20 -1 California Building Code 5.20 -2 California Residential Code 5.20 -3 California Code of Regu- lations 5.21 California Mechanical Code 5.22 California Electrical Code 5.23 California Plumbing Code 5.24 Uniform Sign Code 5.25 Uniform Code for the Abatement of Dangerous Build- ings 5.26 California Energy Code 5.27 California Green Build- ing Code 5.28 California Fire Code § 5.20-1 BUILDING CODE (A) The 2016 Edition of the Cali- fornia Building Code, known as the California Code of Regula- tions, Title 24, Part 1 and Part 2, incorporating the International Building Code, 2015 Edition, pub- lished by the International Code Council, and the non building administrative regulations, are adopted by reference as the Building Code of the City of Red Bluff, including adopted appen- dices from certain Chapters list- ed in this Section, and except as amended with findings in Arti- cles V and VI of this Chapter. A copy of the Code is maintained in the Office of the Community Development Director or Desig- nee for examination and use by the public. (B) (Pool Barriers) California Health and Safety Code §§ 115920 - 115929, also cited as the Swimming Pool Safety Act is adopted into the City Building Code. (C) None of the appendices as printed in Volume No's. 1, 2 and 3 are adopted except as set forth below: (1) Section 3108E MEM- BRANE (AIR-SUPPORTED AND AIR-INFLATED) STRUCTURES is adopted. (2) California Department of Forestry and Fire Protection Very High Fire Hazard Severity Zones In LRA Tehama County (Red Bluff, CA) as it relates to the 2016 California Building Code, Title 24, Part 1, Volume 1 of 2, Chapter 7A {SFM} MATERI- ALS AND CONSTRUCTION METH- ODS FOR EXTERIOR WILDFIRE EX- POSURE, is adopted. (D) None of the appendices printed in Volume III are adopt- ed. (1) The California Building Code, incorporating the Uniform Building Code adopted in this section, may be referred to in the City Code as the "Building Code." (E) The following California De- partment of Forestry and Fire Protection Very High Fire Severi- ty Map for the City of Red Bluff, CA is adopted: (1) California Department of Forestry and Fire Protection Very High Fire Hazard Severity Zones In LRA Tehama Count y ( d l ff ) i l y ( Red Bluff, CA) as it relates to the 2007 California Building Code, Title 24, Part 1, Volume 1 of 2, Chapter 7A {SFM}MATERIALS AND CON- STRUCTION METHODS FOR EXTE- RIOR WILDFIRE EXPOSURE. § 5.20-2 CALIFORNIA RESIDEN- TIAL CODE The 2016 California Residential Code, Title 24, Part 2.5, known as the California Residential Code, is a fully integrated code based on the Building Provisions of the 2016 International Residential Code® (Chapters 2-10). Califor- nia amendments provide consis- tency with model code format, state and federal laws and regu- lations, and unique California conditions with regard to the construction of one- and two- family dwellings and townhouses. This code does not include Energy, Mechanical, Plumbing or Electrical stand- ards, which are found in other parts of Title 24. §5.20-3 CALIFORNIA CODE OF REGULATIONS. (A) California Code of Regu- lations (CCR), Title 24, also known as the California Building Standards Code, is a compila- tion of three types of building standards from three different origins: (1) Building standards that have been adopted by state agencies without change from building standards contained in national model codes; (2) Building standards that have been adopted and adapted from the national model code standards to meet California conditions; and (3) Building standards, au- thorized by the California Legis- lature, that constitute extensive additions not covered by the model codes that have been adopted to address particular California concerns. (B) Notwithstanding, the na- tional model code standards adopted into Title 24 apply to all occupancies in California except for modifications adopted by state agencies and local govern- ing bodies. §5.21 MECHANICAL CODE (A) The 2016 Edition of the California Mechanical Code, known as the California Code of Regulations, Title 24, Part 4, in- corporating the Uniform Me- chanical Code, 2016 Edition, pub- lished by the International Asso- ciation of Plumbing and Me- chanical Officials (IAPMO), and the non-building administrative regulations are adopted by ref- erence as the Mechanical Code of the City, except as amended with findings in Articles V and VI of this Chapter. A copy of the Code is maintained in the Office of the Community Development Director or designee (Communi- ty Development Official (Build- ing Official)) for examination and use by the public. (B) The following appendi- ces are adopted: (1) Appendix A (Residential Plan Examiner Review Form for HVAC System Design); (2) Appendix B (Procedures to be Followed to Place Gas Equipment in Operation); (3) Appendix C (Installation and Testing of Oil (Liquid) Fuel- Fired Equipment); (4) Appendix D (Unit Con- version Tables); (5) Appendix E (Sustainable Practices); (6) Appendix F (Sizing of Venting Systems Serving Appli- ances Equipped with Draft Hoods, Category I Appliances, and Appliances Listed for use with Type B Vents). §5.22 ELECTRICAL CODE (A) The 2016 Edition of the Cali- fornia Electrical Code, known as the California Code of Regula- tions, Title 24, Part 3, incorporat- ing the National Electrical Code, 2015 Edition, published by the National Fire Protection Associa- tion, and the non-building Uni- form Administrative Code Provi- sions for the National Electric Code are adopted by reference as the Electrical Code of the City, except as amended with findings in Articles V and VI of this chapter. A copy of the Code is maintained in the Office of the Community Development Direc- tor or designee (Community De- velopment Official (Building Offi- cial)) for examination and use by the public. (B) The following appendices are adopted: (1) Appendix A (Product Safety Standards); (2) Appendix B (Application Information for Am pacity Calcu- l i ) p y lation); (3) Appendix C (Conduit and Tubing Fill Tables for Con- ductors and Fixture Wires of the Same Size); (4) Appendix E (Type of Construction); (5) Appendix H (Administra- tive and Enforcement). §5.23 PLUMBING CODE (A) The 2016 Edition of the Cali- fornia Plumbing Code, known as the California Code of Regula- tions, Title 24, Part 5, incorporat- ing the Uniform Plumbing Code, 2015 Edition, published by the International Association of Plumbing and Mechanical Offi- cials (IAPMO), and the non- building administrative regula- tions are adopted by reference as the Plumbing Code of the City, except as amended with findings in Articles V and VI of this chapter. A copy of the code is maintained in the Office of the Community Development Direc- tor or designee (Community De- velopment Official (Building Offi- cial)) for examination and use by the public. (B) The following appendices are adopted: (1) Appendix B (Combina- tion Waste and Vent Systems); (2) Appendix D (Rainwater Systems); (3) Appendix H (Recom- mended Procedures for Sizing Commercial Kitchen Grease In- terceptor); (4) Appendix I (Installation Standard); and (5) Appendix J (Reclaimed Water Systems for Nonresiden- tial Buildings). (C) The following California regulation for PEX (Cross linked Polyethylene) is adopted: (1) On August 16, 2010, the California Building Standards Commission certified the final environmental impact report and approved regulations allow- ing the use of PEX tubing as a potable water supply. Use of PEX shall comply with those reg- ulations. § 5.24 UNIFORM SIGN CODE. (A) A certain document being marked and designated as the "Uniform Sign Code," 1997 Edi- tion, published by the Interna- tional Conference of Building Of- ficials is adopted by reference as the sign code of the city, ex- cept as amended in § 5.1 and in Articles V and VI of this chapter. (B) The Uniform Sign Code adopted in this section can be referred to in this code of ordi- nances as the "Sign Code." § 5.25 UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS. A certain document being marked and designated as the "Uniform Code for the Abate- ment of Dangerous Buildings," 1997 Edition, published by the International Conference of Building Officials, is adopted by reference as the "Code for the Abatement of Dangerous Build- ings of the city," except as amended in § 5.1 and in Article VI of this chapter. §5.26 ENERGY CODE The 2016 Edition of the California Energy Code, known as the Cali- fornia Code of Regulations, Title 24, Part 6, incorporating the Cali- fornia Energy Commissions Effi- ciency Standards, published by the International Code Council, Inc., are adopted by reference as the Energy Code of the City, except as amended with find- ings in Articles V and VI of this Chapter. A copy of the Code is maintained in the Office of the Community Development Direc- tor or designee (Community De- velopment Official (Building Offi- cial)) for examination and use by the public. § 5.27 CALIFORNIA GREEN BUILD- ING CODE The 2016 California Green Build- ing Code Standards, Title 24, Part 11, also known as the CALGreen Code and the Califor- nia Green Building Standards Code (CGBSC), is California's first mandatory green building code. It contains regulations for energy efficiency, water effi- ciency and conservation, mate- rial conservation and resource efficiency, environmental quali- ty, and more. It contains man- datory provisions for the follow- ing types of new buildings: com- mercial, low-rise residential, public schools. Appendices, which are not being adopted, in- clude voluntary provisions for all of these occupancies plus hospitals. Tier 1 and 2 and non-mandatory code sections shall not be d d f h f hi adopted for the purposes of this section of the Code for the City of Red Bluff. § 5.28 CALIFORNIA FIRE CODE (A) The 2016 California Fire Code, Title 24, Part 9, known as the California Fire Code, con- tains regulations consistent with nationally recognized ac- cepted practices for safeguarding, to a reasonable degree, life and property from the hazards of Fire and explo- sion, dangerous conditions aris- ing from the storage. Handling and use of hazardous materials and devices, hazardous condi- tions in the use or occupancy of buildings or premises. (B) For the purpose of prescribing regulations govern- ing conditions hazardous to life and property from fire, hazard- ous materials or explosion, cer- tain documents entitled, 2016 Edition of the California Fire Code and Standards with Amendments, Appendices", the "2016 California Building Code Standards with Amendments, Appendices", and the "2015 In- ternational Fire Code with Ap- pendix Chapter 1, and Standards of the International Code Coun- cil" are hereby adopted by the City Council as the Fire Code of the City, and included in and made a part of this code (Chap- ter 5 of the Red Bluff Municipal Code) as though set forth at length herein. SECTION 3. CHAPTER 5: Con- struction Regulations, Article VI: AMENDMENTS TO MODEL CO- DES, Section 5.51 of the Code of the City of Red Bluff is amended to read as follows: § 5.51 AMENDMENTS TO THE BUILDING CODE The 2016 California Building Code adopted in Article II of this Chapter is amended as follows: (A) The adoption of the 2016 California Building Code Volume 2, Appendix J (Grading) is replaced in its entirety with the following amendment to section 109 as follows: General Plan Policies. All grad- ing shall conform to the Grading Drainage and Groundcover Poli- cies in the land use element of the city's general plan, and the policies and implementation measures in the natural environ- ment element of the city's gen- eral plan. SECTION 4. The City Council hereby finds and determines that this Ordinance is exempt from further CEQA review pur- suant to CEQA Guidelines Sec- tion 15061(b)(3). SECTION 5. This ordinance shall take effect thirty (30) days after the date of its adoption. Within fifteen (15) days from the pas- sage thereof, it shall be publish- ed at least once in the Red Bluff Daily News, a newspaper of gen- eral circulation, published and circulated in the City of Red Bluff.
