Thursday, April 19, 2012 – Daily News COURT ROUND-UP Recent State Prison Commitments • David Lee Arnette Jr., was sentenced to three years in state prison for attempted second degree robbery, special allegation-prior felony. Victims were standing along the street when Tehama County Superior Court, according to the Tehama County District Attorney's Office: —————— The following defendants were sentenced in they were approached by Arnette. Arnette asked the victims for some information and walked away. Arnette returned and placed one of the vic- tims in a headlock and demanded money. The victim was able to get away and Arnette fled on foot. 120 days in Tehama County Jail for possession of a controlled substance. Shoffner was originally granted formal proba- tion. She violated her probation when she failed to complete her community service and tested positive for methamphetamine and ecstasy. • Scott Edward Daugherty was sentenced to 120 days in Tehama County Jail for possession of marijuana for sale. Deputies served a search warrant at Daugher- • Dewayne Ray Bible was sentenced to two years and eight months in state prison for pos- session of a controlled substance, petty theft with a prior. Witnesses observed Bible and his companions stealing scrap metal from a local business. Offi- cers responded to the reported location and located Bible who failed to comply with the offi- cers commands. Bible was ordered to the ground at gunpoint and taken into custody. The officer conducted a search of Bible's person and located methamphetamine as well as pieces of scrap metal which was located in Bible's vehicle. • Raymond Robert Bell was sentenced to two years and eight months in state prison for van- dalism over $400 damage, special allegation- prior strike. Bell was observed jumping up and down on a parked vehicle causing thousands of dollars in damage. • Abelardo Quezada Caballero was sentenced to one year and four months in state prison for possession of concentrated cannabis. An officer conducted a traffic stop on a vehi- cle in which Caballero was a passenger. The offi- cer observed the odor of marijuana and conduct- ed a search. Inside the vehicle the officer located marijuana and concentrated cannabis. Recent County Jail Commitments • Samuel Adam McDonald was sentenced to 210 days in Tehama County Jail for cultivating marijuana; failure to appear while on bail. Deputies responded to McDonald's residence and observed marijuana growing. Agents from the drug task force responded and obtained a search warrant. A search was then conducted and the agents located several indoor and outdoor marijuana plants. Recent Proposition 36 Commitments Note: All cases wherein a defendant is sen- tenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treat- ment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non- drug related term of probation the court may then elect to sentence defendant to jail or prison. Per the requirements of Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. The Tehama County District Attorney's • Dusty Dee Strobel was sentenced to Prop. 36 probation for possession of a controlled sub- stance. An officer observed Strobel walking along the side of the road and made a consensual contact. The officer received consent to search and locat- ed methamphetamine and a methamphetamine smoking pipe in Strobel's possession. • Robert Franklin Bower was sentenced to Prop. 36 probation for possession of a controlled substance. An officer observed Bower in the Mendocino National Forest and became suspicious as to where his vehicle was parked. The officer then contacted Bower and conducted a search. The officer located methamphetamine and marijuana in Bower's possession.
