S. C. et seq.) as regulated by 43 CFR Part 3600, is offering for sale, by oral bid, 2,000,000 tons of aggregate from an approximately 135-acre parcel located within: Gila & Salt River Meridian T. 3 N., R. 22 W., Sec. 13, SW¼SW¼, SE¼SW¼, NE¼SW¼, SW¼SE¼, and SE¼SE¼ T. 3 N., R. 22 W., Sec. 24, NE¼NE¼ T. 3 N., R. 21 W., Sec. 18, lot 4 and SE¼SW¼ T. 3 N., R. 21 W., Sec. 19, lot 1 and NE¼NW¼ This sale does not include the existing mineral materials stockpiles on site. Those stockpiles have been sold under a separate contract. Access will be via Ehrenberg Cibola Road off Exit 1, Interstate 10. The material will be sold under contract AZA38582 and have a 10-year, renewable term. Field inspections of the site can be arranged with the BLM before the auction date. Bidders must be authorized to transact business in Arizona. Bids will be by the ton and the minimum acceptable bid is $1.20 per ton. To be eligible to take part in the oral bidding, potential bidders must submit the following: (1) A 5% deposit of the total minimum contract value, $120,000 (2) Reimbursable estimated advertising fee (should range from $200– $400) (3) Reimbursable Cost Recovery fee, $4,300.00 The total amount that must be submitted prior to the bidding is the advertising fee and the cost recovery/process- ing fee of $4,300 (if the applicant is the successful bidder, the total amount due will be $120,000). If the successful bidder is someone other than the applicant, BLM will refund to the applicant the amount paid for the reimbursable estimated advertis- ing and cost recovery fees and the individual or entity will have to pay $4,300 + advertising fees + $120,000. Bid deposits must be submitted no earlier than 9:00 a.m. and no later than 11:15 a.m., Tuesday, December 13, 2022, at the Yuma Field Office, 7341 E 30th Street, Suite A, Yuma, AZ 85365. Oral bidding will begin in the Yuma Field Office at 11:30 a.m. Within 30 days, the winning bidder will be required to make up the difference between their winning bid and the deposit prior to contract execution, such that the total funds deposited are 5% of the winning bid price. Deposits will be returned im- mediately upon conclusion of the sale to unsuccessful bidders. Deposits must be in the form of bank draft, cashier's check or certified check and must be made payable to the "US DOI Bureau of Land Management". The highest bidder will be awarded the contract unless determined to be unqualified, or if all bids are rejected, or the signed contract is not returned within sixty (60) days of receipt, together with a bond and mining and reclamation plan. The Authorized Officer may reject any or all bids and may waive minor deficiencies in the bids if it is in the interest of the United States to do so. The highest bidder may be subject to a 90-day waiting period before contract execu- tion to allow previous operators to vacate the site. A mining and reclamation plan must be approved by the BLM and a performance bond, based on the reclamation plan and actual cost of reclamation, must be in place prior to entering the contract area. The bond may be a bond of corporate surety shown on the approved list of the U.S. Treasury Department, cash, Certificate of Deposit, U.S. Treasury Bonds or Irrevo- cable Letter of Credit; some limitations apply. Processing and segregation of mineral material onsite is authorized. The contract is for in-bank material only. The contract also has an option to have a concrete and/or asphalt batch plant within the contract area as well as use of an existing water well. Renewals will be authorized pursuant to 43 CFR 3602.47. Additional general and site-specific stipulations will be at- tached to the contract. Successful bidders will be required to conform to protective stipulations and all federal, state, county, and local ordinances. All prospective bidders are advised to inspect the contract terms and stipulations and obtain additional information concern- ing this sale at the above address. In addition, all prospective bidders should be fully knowledgeable of 43 CFR 3600 regu- lations, as the sale and administration of the contract will be conducted in accordance with these regulations. This year the judges stand will be located at the corner of N. Plymouth & E. Quail Trail, across from Town Hall.
