COURT ROUND-UP The following defendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: —————— Recent State Prison Commitments • Jose Armando Garcia was sentenced to nine years in state prison for lewd act upon a child, assault with intent to commit a felony-victim under 18, sexual battery by restraint, false imprisonment by violence. Officers received a report of a possible sexual assault upon a child. After a thorough investigation was completed officers determined Garcia had physically restrained the seven year old victim while committing a lewd act. • Robert Anthony Nyholt was sentenced to five years and eight months in state prison for possession of a controlled substance; transportation of a controlled substance with special allegation-prior felony. Nyholt was originally granted formal probation on both cases. He violated his probation when he was arrested for attempting to steal a vehicle. • Jaime Agustin Huer- ta-Sanchez was sentenced to two years in state prison for possession of marijuana for sale. An officer conducted a traffic stop on a vehicle driven by the HuertaSanchez. Upon contacting Huerta-Sanchez the officer observed the odor of marijuana emitting from the vehicle. The officer conducted a search and located plastic trash bags full of marijuana in the bed of the truck. Recent County Jail Commitments • Heather Nicole King was sentenced to 60 days in Tehama County Jail for vandalism:over $400 Damage. King was originally granted formal probation. She violated her probation when she submitted a breath sample that tested positive for alcohol. • Andrew Gilbert Arnn was sentenced to 60 days in Tehama County Jail for second degree commercial burglary. Arnn was originally granted formal probation. He violated his probation when he tested positive for marijuana. Recent Proposition 36 Commitments Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a nondrug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non- compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. • Amanda Sue Holman was sentenced to Prop. 36 probation for possession of a controlled substance. An officer conducted a traffic stop on a vehicle driven by Holman. After contacting Holman the officer was advised she had an outstanding warrant for her arrest. A search was conducted and the officer located methamphetamine and glass pipes in Holman's purse. • Anna Marie Griffin was sentenced to 180 days in Tehama County Jail and Prop. 36 probation for possession of a controlled substance; failure to appear on own recognizance. Griffin was contacted at a motel room in regards to an unrelated incident. Upon speaking with Griffin the officer observed her to be displaying the symptoms of being under the influence of a controlled substance. After Griffin was taken into custody, the officer located methamphetamine in the backseat of the patrol car where Griffin had been sitting. Flood control board seeks nominees The Tehama County Flood Control and Water Conservation District (TCFC&WCD) is accepting nominations for one seat on the 10- member AB3030 Groundwater Technical Advisory Committee (TAC). The open position represents the "Natural Resources" interests of the county on issues related to groundwater management. The term of the appointment is for three years.
