RED BLUFF DAILY NEWS: PUBLISH: March 3 and 10, 2017 LEGAL NOTICE ORDINANCE NO. 2036 AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUN- TY OF TEHAMA AUTHORIZING THE DIRECTOR OF PLANNING TO WAIVE APPLICATION FEES FOR CERTAIN TENTATIVE PARCEL MAPS AND TENTATIVE TRACT MAPS WITHIN THE UNINCORPO- RATED AREA OF TEHAMA COUN- TY THE BOARD OF SUPERVISORS OF THE COUNTY OF TEHAMA AND ORDAINS AS FOLLOWS: SECTION 1. The Board of Supervi- sors of the County of Tehama hereby finds: WHEREAS, the application fee for tentative parcel maps, tenta- tive tract maps, and map exten- sions were established by the Tehama County Board of Super- visors on November 7, 2001, by adoption of Ordinance No. 1763. 7, 2001, by adoption of Ordinance No. 1763. WHEREAS, since 2008, the Cali- fornia Legislature has enacted several bills which extended the life of unexpired subdivision approvals, without the require- ment of local review or approval of said extensions. In 2015, the Legislature enacted a bill which codified Government Code sec- tion 66452.25 which automatical- ly extended the life of unexpired subdivision approvals only in counties in the State which demonstrated economic hard- ship as established by the crite- ria set for in that code section. Only ten counties in the State meet the criteria of that code section, and Tehama County does not meet said criteria. As a result of failure of the Legisla- ture to recognize the economic hardships in Tehama County, certain subdivisions approved after January 1, 2002 expired on or after July 15, 2015, due to no fault of the property owner and without the approval of the County of Tehama. WHEREAS, this ordinance serves an important public purpose for the residents of Tehama County, encourages economic develop- ment, and protects the individu- al property rights of the resi- dents of Tehama County SECTION 2. To encourage eco- nomic development and protect the individual property rights of the citizens of Tehama County, the Director of Planning is au- thorized, in his or her sole dis- cretion and on a case by case basis, to waive the entirety of the application fee for new ten- tative parcel maps and or new tentative tract maps, if all of the following conditions are met: (1) The new tentative parcel map or tentative tract map sub- stantially conforms to a previ- ous tentative parcel map or ten- tative tract map that was ap- proved by the County of Tehama for the same property on or af- ter January 1, 2007; (2) The subdivider can demon- strate that they did not submit a final map relating to such previ- ous tentative map, thereby causing such previous tentative map to expire, in reliance upon representations by an officer or employee of the County that such previous tentative map was automatically extended un- der Government Code section 66452.25; and (3) A complete ap- plication for the new tentative map is received by the Tehama County Planning Department no later than August 30, 2017. In the event the Director of Plan- ning denies any request for a fee waiver for a qualifying appli- cation, the applicant may within five (5) calendar days submit a written request for appeal of that denial to the Tehama Coun- ty Board of Supervisors who shall have the final decision making authority. SECTION 3. All ordinances, or parts of ordinance, or resolu- tions in conflict herewith are hereby repealed to the extent of such conflict and no further. SECTION 4. This ordinance shall take effect thirty (30) days from the date of its adoption, and pri- or to the expiration of fifteen (15) days from the adoption thereof shall be published at least one time in the Red Bluff Daily News, a newspaper of gen- eral circulation in Tehama Coun- ty. The Board of Supervi- sors of the County of Tehama hereby finds and declares the following: A. Public agencies, public utilit- ies, and certain private nonprof- it organizations own large amounts of property within Tehama County dedicated to publicly beneficial uses. These properties are often remote, or otherwise especially vulnerable to unlawful marijuana cultiva- tion undertaken by trespassers. B. Removal of such unlawful marijuana cultivation, without charge to the property owner, promotes the publicly beneficial uses to which these properties are dedicated, thereby serving a public purpose of the County of Tehama. SECTION 2. Section 9.06.125 is hereby added to the Tehama County Code to read: 9.06.125 -Unlawful Cultivation Upon Public Benefit Properties. A. The Board of Supervisors or director of environmental health may, in their sole and exclusive discretion, withhold imposition of, or may compromise the amount of, any abatement cost, administrative cost, or adminis- trative civil penalty that would otherwise be imposed under this chapter upon a property owner that meets all of the fol- lowing conditions: 1. The property owner is a pub- lic agency, a public utility, a mu- tual water company, a nonprofit public benefit corporation that company, nonprofit public benefit corporation that has as a principal purpose the conservation of land and water resources, or a nonprofit corpo- ration or unincorporated associ- ation created for the purpose of managing a common interest development; 2. The property owner, or their officers, employees, or agents, did not cause, permit, or other- wise suffer or allow the unlawful marijuana cultivation to exist upon the property; and 3. The property owner has pro- vided the County with any nec- essary consent for the abate- ment of the unlawful marijuana cultivation from the property. B. The withholding or compro- mise of any abatement costs, administrative costs, or admin- istrative civil penalties under this section is not subject to the limitations set forth in Chapter 10.17 of the Tehama County Code. The withholding or compromise of any abatement cost, adminis- trative cost, or administrative civil penalty for any property owner under this section shall not reduce or otherwise affect the amount or enforceability of any abatement cost, administra- tive cost, or administrative civil penalty imposed under this Chapter upon any other person. SECTION 3. This ordinance shall take effect thirty (30) days from the date of its adoption, and pri- or to the expiration of fifteen (15) days from the adoption thereof shall be published at least one time in the Red Bluff Daily News, a newspaper of general circulation in Tehama County.
