The court's order in the case of teenager Gavin Grimm means that atten- tion now will turn to lower courts around the coun- try that are grappling with rights of transgender stu- dents to use school bath- rooms that correspond to their chosen gender, not the one assigned at birth. The appeals court in Richmond, Virginia, and other appellate panels han- dling similar cases around the country will have the first chance to decide whether federal anti-dis- crimination law or the Con- stitution protects transgen- der students' rights. Monday's action by a court that has been short- handed for more than a year comes after the Trump administration pulled back federal guidance advising schools to let students use the bathroom of their cho- sen gender, not the one as- signed at birth. The justices rejected a call from both sides to de- cide the issue in a case that was dramatically altered by the election of President Donald Trump. Grimm's case had been scheduled for argument in late March. Instead, a lower court in Virginia will be tasked with evaluating the federal law known as Title IX and the extent to which itappliestotransgenderstu- dents. Lawsuits involving transgender students are making their way through the courts in at least five other states: Illinois, North Carolina, Ohio, Pennsylva- nia and Wisconsin. For Grimm, the order means that he probably will graduate with the is- sue unresolved. Now, his wish to use the boys' bath- room is blocked by a policy of the Gloucester County school board. Although he won a court order allowing him to use the boys' bath- room at Gloucester High School, the Supreme Court put it on hold last August, before the school year be- gan. "This is disappointing for trans kids across the country and for Gavin, who are now going to be held in limbo for another year or two," said Joshua Block, the American Civil Liberties Union attorney who repre- sents Grimm. "But Title IX means the same thing to- day as it meant yesterday. Lower courts already have held that it protects trans kids." In a statement relayed by school board lawyer Kyle Duncan, the board said it "looks forward to explain- ing why its commonsense restroom and locker room policy is legal under the Constitution and federal law." The high court action follows the administra- tion's recent decision to withdraw a directive issued during Barack Obama's presidency that said which bathroom to use should be based on students' gender identity. The administration ac- tion triggered legal wran- gling that ended with Mon- day's order. In essence, the federal appeals court in Richmond, Virginia, had relied on the Obama ad- ministration's interpreta- tion of Title IX to side with Grimm. The appeals court accepted the administra- tion's reading of the law without deciding for it- self what the law and a re- lated regulation on same- sex bathrooms and locker rooms mean. Another possible expla- nation for Monday's or- der is that the court might want more of a societal consensus to develop be- fore it issues a ruling in fa- vor of transgender rights, said John Neiman, an Al- abama lawyer who served as a law clerk to Justice An- thony Kennedy. House committees planned to begin voting on the 123-page legislation Wednesday, launching what could be the year's defining battle in Congress. GOP success is by no means a slam dunk. In per- haps their riskiest politi- cal gamble, the plan is ex- pected to cover fewer than the 20 million people in- sured under Obama's over- haul, including many resi- dents of states carried by President Donald Trump in November's election. Republicans said they don't have official estimates on those figures ye. The plan would repeal the statute's unpopular fines on people who don't carry health insurance. It would replace income- based premium subsidies in the law with age-based ones that may not provide as much assistance to peo- ple with low incomes. The payments would phase out for higher-earning people. The proposal would con- tinue the expansion of Med- icaid to additional low- earning Americans un- til 2020. After that, states adding Medicaid recipients would no longer receive the additional federal funds Obama's law has provided. More significantly, Re- publicans would overhaul the federal-state Medic- aid program, changing its open-ended federal financ- ing to a limit based on en- rollment and costs in each state.
