The Dow Jones industri- al average closed with a loss of 7.36 points at 13,164.78. The broader Standard & Poor's 500 index was up 1.60 points at 1,405.53 and the Nasdaq composite rose 13.95 points to 3,030.93. Stocks mostly higher on signs of economic growth Wall Street growth and hiring stays weak. U.S. industrial produc- tion increased last month as factories made more cars, computers and airplanes, according to the Federal Reserve. It was a sign that manu- facturing is recovering after a weak spring. Also, con- sumer prices were unchanged in July from June, as a small drop in energy costs offset slightly higher food prices. The consumer price index has- n't changed since March, which means that inflation is in check. Lower inflation gives the Federal Reserve more lee- way to launch new pro- grams intended to rekindle the economy. The Fed sig- naled at a meeting in late July that it is ready to act if Recent reports have sug- gested that the economy improved somewhat in July. Employers created the most jobs in five months, while consumers spent a lit- tle more at stores after three months of declines. Many investors wonder if the economy is fragile enough to create the sense of urgency for policy mak- ers to act proactively. The slightly better outlook for the economy could prompt the Fed to hold off on tak- ing action when its policy committee next meets in September. ''We're in a period of RED TAG ITEMS 1/2 off reported earnings that beat analysts' expectations and raised its profit forecast for the year. Deere plummeted $5.03 to $75.10 after the agricul- ture machinery maker reported results that were well below Wall Street's expectations. (AP) — A federal judge has again ordered a New York man who's suing for part ownership of Facebook to turn over a letter from a previous lawyer to the social media company's attorneys. The judge in Buffalo also fined Paul Ceglia (SEHG'- lee-uh) and his current lawyer, Dean Boland, $1,000 each for not producing the letter when told to twice before. Facebook's lawyers believe the so-called Kasowitz let- ter supports the company's claim the contract on which Ceglia's 2010 lawsuit is based is fake. The letter is from the law firm Kasowitz, Benson, Torres & Friedman to another law firm that once represented Ceglia. Ceglia claims a 2003 document signed by Facebook founder Mark Zuckerberg entitles him to half-ownership of the Menlo Park, Calif.-based company.
