Thefollowingdefendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: RecentState/Local Prison Commitments: People vs. Eric Manuel Castillo, Corporal Injury to a Co-habitant. The defen- dant also admitted having a prior strike offense and ad- mitted violating probation in an earlier case. Brief history: The defen- dant attacked his former girlfriend at her place of work. On two separate oc- casions he strangled her. At the time, the victim was five months pregnant with his child. Sentenced to 11 years State Prison People vs. Miguel Men- doza, Street Terrorism. Brief history: During a gang related bar fight, the defendant held the vic- tim while a co-defendant stabbed him. Sentenced to 16 months State Prison. People vs. Laura Eliza- beth Graham, Second De- gree Burglary, First Degree Burglary, Possession For Sale of a Controlled Sub- stance, Maintaining a Place for Selling Drugs. Brief history: The defen- dant participated in smash- ing the window of Radio Shack and stealing mer- chandise from the business. In a separate incident, the victim came home to find the defendant sleeping in her bed. The defendant ad- mitted selling heroin out of her home. Sentenced to 6 years State Prison. People vs. John Mar- tin Lavelle, Driving Under the Influence Causing In- jury, Resisting an Officer, 2 Counts. Brief history: The defen- dant, while under the influ- ence of alcohol, ran a stop sign and collided with an- other vehicle injuring a pas- senger; when officers ar- rived he fought with them. Sentenced to 2 years State Prison. People vs. Rene Romero Rodriguez and Marcelino Rodriguez, Battery with Serious Bodily Injury, 2 Counts. Brief history: The defen- dants became involved in a dispute with the father of one's former girlfriend, they left his home when he called the police but then returned and beat the fa- ther and another man. Sentenced to Marcelino, 2 years State Prison; Rene, 6 years State Prison. People vs. Susan Lorraine Hess, Battery by Gassing and Battery with a Caustic Chemical Brief history: The De- fendant was in custody in Tehama County Jail. She armed herself with a cup containing a mixture of toi- let water, toilet paper and vomit, then threw the con- tents of the cup in the face of a Correctional Officer, who then fell and injured his finger. In total, two Cor- rectional Officers ended up getting splashed with the vomit mixture. On a sep- arate occasion, the Defen- dant filled up a bottle with bleach and sprayed it on two other individuals. The victims smelled like bleach and it ruined the clothes they were wearing. Sentenced to 4 years in state prison. Recent County Jail Commitments: People vs. Jason Ray Nichols, Evading an Offi- cer and Unlawful Driving of a Vehicle with Priors Brief history: The po- lice were called to a report of a suspicious vehicle and an individual driving away on a motorcycle. As the of- ficers arrived at the scene, the defendant returned rid- ing a motorcycle. He saw the police and tried to flee the scene, running multi- ple stop signs and speeding. The defendant finally was cornered when he mistak- enly turned onto a dead end street. The motorcycle was stolen, as well as the other vehicle associated with the defendant. He had a prior vehicle theft conviction. Sentenced to 5 years of formal probation, 4 years 8 months prison suspended, 363 days in Tehama County Jail, and 80 hours of com- munity service. People vs. Samuel Solo- mon Albertson, Elder Abuse Brief history: The defen- dant was under the influ- ence of methamphetamine and steroids when a fam- ily disturbance broke out. He threw a blender at his grandmother and grabbed his son by the neck and choked him. The family was reluctant to provide state- ments against him, but in- dependent witnesses ob- served the conduct. The defendant had a small quantity of methamphet- amine in his pocket when he was arrested. Sentenced to 5 years formal probation, 4 years prison suspended, 180 days in Tehama County Jail, and 80 hours of community ser- vice. People vs. Joseph An- thony Clopp, Maintaining a Place for Selling or Using Controlled Substances Brief history: The defen- dant was already on pro- bation for other narcotics cases. The narcotics task force conducted a proba- tion search at his residence and located a digital scale, numerous hypodermic sy- ringes, and a can of pepper spray. Officers searched de- fendant's phone and located numerous text messages consistent with the posses- sion and sales of controlled substances. The defendant was interviewed and ad- mitted selling heroin on numerous occasions at his house. Sentenced to 5 years of formal probation, 3 years in prison suspended, and 180 days in Tehama County Jail. People vs. Tony Dale Bar- ron, Terrorist Threats Brief history: The defen- dant was outside the Nu Way Market in Los Molinos. He was acting strangely, and threatening to fight the employees inside. He pulled out a knife and told one of the employees that he was going to tackle him and cut him open with the knife. The defendant then began banging his head on the glass doors. The Sher- iff's Department was called and the defendant resisted the deputy who arrested him. Sentenced to 5 years of formal probation, 210 days in Tehama County Jail and 80 hours of community ser- vice. People vs. Kevin Edward McDonnell, Bringing Illegal Substance into Jail Facility Brief history: The defen- dant was arrested for public intoxication and possession of smoking paraphernalia. When he was taken to the Tehama County Jail he was given the advisement about the consequences of bring- ing contraband into the jail. He denied having any con- traband. During a search at the jail, the Correctional Of- ficer found a small quantity of methamphetamine in his pants pocket. Sentenced to 3 years for- mal probation, 60 days in Tehama County Jail, and 80 hours of community ser- vice. People vs. Jesus Zepeda Farias, Failure to Appear on a Felony Charge. Brief history: The defen- dant failed to appear at a scheduled court hearing on a pending felony charge. Sentenced to 3 years for- mal probation, 180 days County Jail and 80 hours of community service. People vs. Carl Deighton Thayer, Spousal Abuse. Brief history: The defen- dant argued with his wife and then grabbed her by the hair and threw her to the ground. Sentenced to 5 years for- mal probation, 120 days County Jail and 80 hours of community service. People vs. Danny Dale Delay, Possession of Am- munition by a Felon. Brief history: The defen- dant, a convicted felon, was found sleeping in his car in a city park. He was in pos- session of a bag of shotgun shells. Sentenced 3 years formal probation, 90 days County Jail and 80 hours of com- munity service. People vs. Cody Stephens Ball, Evading a Peace Offi- cer. Brief history: Officers were called to a domestic dispute involving the de- fendant who fled in his au- tomobile. A chase ensued which resulted in the defen- dant running off the road and into a telephone pole. Sentenced to 3 years for- mal probation, 90 days County Jail and 80 hours of community service. People vs. Kathy Meyer, Conspiracy to Cultivate Marijuana. Brief history: Agents served a search warrant on the defendant's property and found 150 mature mar- ijuana plants. The co-defen- dants stated that the defen- dant hired them to tend the plants. Sentenced to 3 years for- mal probation and 120 days County Jail. People vs. Kevin Paul Duncan, Corporal Injury to Spouse. Brief history: During an argument with his spouse, the defendant pushed her down stairs and struck her face. Sentenced to 5 years for- mal probation with 4 years State Prison suspended, 90 days County Jail, 80 hours community service and a 52-week Batterer's Treat- ment Program. People vs. Bailey Jane Sis- son, Assault with a Deadly Weapon. Brief history: The Defen- dant was involved in a dis- turbance on the street when a homeowner came out and told her he had called po- lice. The Defendant ad- vanced on the homeowner while brandishing a knife at which time the homeowner shot and wounded her. Sentenced to 5 years for- mal probation with 5 years State Prison suspended, 363 days County Jail and 80 hours of community ser- vice. Brief history: The Vic- tim had met up with the three Defendants regarding money that was allegedly owed to the victim. During this confrontation the vic- tim was chased down and shot twice with a shotgun. The victim died as a result of his injuries. TBJ: October 19, at 9 am (Department to be Deter- mined) People vs. John Noonk- ester, Willful, Deliberate and Premeditated Murder with Special Allegation, Personal and Intentional Discharge of a Firearm, GBI (2 counts); Attempt: Willful, Deliberate and Premedi- tated Murder with Special Allegation, Personal and Intentional Discharge of a Firearm, GBI. Brief history: The De- fendant is charged with shooting and killing his ex-wife and her father, and shooting a bystander.
