ByElliotSpagat TheAssociatedPress SAN DIEGO U.S. Customs and Border Protection found that employees acted properly when they fired guns in four incidents dat- ing back to 2012 — includ- ing two that left two peo- ple dead. The findings were re- leased Thursday by the agency's National Use of Force Review Board, which was established in Decem- ber 2014 amid widespread criticism that the nation's largest law enforcement agency was slow to inves- tigate such incidents and lacked transparency. The cases involve a Bor- der Patrol agent who fired from Texas at rock-throw- ers in Mexico, a heavily armed murder suspect who was fatally shot as he fled a Texas house when a Border Patrol agent and other law enforcement of- ficers opened fire, a Bor- der Patrol agent who fired at rock-throwers in Ari- zona and an Office of Air and Marine crew that fired warning shots and crashed into a vessel off the South- ern California coast car- rying immigrants, one of whom died. The reviews are the board's first under its man- date to review uses of le- thal force and other seri- ous incidents once federal, state and local prosecutors decline to pursue criminal charges. It has opened in- vestigations into 14 other cases. Customs and Border Protection says officials have fired their guns in 223 incidents from the 2011 to 2015 fiscal years, including 28 last year. Rock attacks on agents have been among the most controversial, with critics saying agents have overreacted and de- fenders saying stones can be deadly weapons. SOUTHERN CALIFORNIA Borderagencyclearsemployees in 4 shooting incidents By David Koenig The Associated Press The California attorney general has issued sub- poenas to several oil refin- ers to learn how they set gasoline prices, which are consistently higher in Cal- ifornia than in most other states. Chevron Corp., Exxon Mobil Corp., Valero En- ergy Corp. and Tesoro Corp. confirmed on Thurs- day that they have received subpoenas in recent weeks. The attorney general is making a sweeping request for information about gas- oline supplies, pricing, and maintenance shutdowns that can temporarily cre- ate shortages and increase prices, according to people familiar with the investi- gation. The people spoke on condition of anonym- ity because they were not authorized to discuss de- tails of the subpoenas. The requests came from Attorney General Kamala Harris, a Democrat who is running for the U.S. Senate. Kristin Ford, a spokeswoman for Harris, declined to comment on whether her office was in- vestigating. The investigation was first reported by The Wall Street Journal. Chevron spokesman Braden Reddall said the company received a sub- poena from the attorney general's office and would cooperate with the inves- tigation. Valero received a sub- poena "and we will re- spond accordingly," said spokeswoman Lillian Rio- jas. Spokesmen for Exxon and Tesoro also confirmed the requests for informa- tion. None of the compa- nies would discuss the matter further. California perennially has among the nation's highest prices for gaso- line. On Thursday, the av- erage for a gallon of reg- ular was $2.90 compared with the national average of $2.29, according to the auto club AAA. Some consumer advo- cates have charged that re- finers drive prices higher by tactics such as frequent or overly long plant shut- downs. Refineries are routinely taken offline for main- tenance, and there have been longer-lasting out- ages after disasters such as the explosion in Febru- ary 2015 at an Exxon refin- ery in Torrance, California, near Los Angeles. Gordon Schremp, senior fuels specialist with the California Energy Com- mission, said 2015 saw an "extraordinary price spike in magnitude and dura- tion in California," which a commission advisory com- mittee has been investigat- ing. "We are aware that they were doing this," Schremp said of the attorney gen- eral's investigation, "be- cause off and on they've talked to us about what was going on with the 2015 market, important factors that can cause spikes in the markets." Industry officials blame high prices on California's stricter clean-air require- ments, which they say add costs and make it more dif- ficult to import gasoline from other states when there is a price spike. Rebecca Adler, a spokes- woman for the American Fuel & Petrochemical Man- ufacturers, called the alle- gations in the subpoenas baseless. "We are confident that nothing will come of this," she said. The group Consumer Watchdog has repeatedly called on Harris to inves- tigate oil companies over California gas prices and welcomed news of the in- vestigation. "It's great that we have a law enforcement official asking questions about both supplying the mar- ket and equitable pricing within the market," said the group's president, Ja- mie Court.
