PRIMARY El ec ti on s office open Sa tu rd ay f or ea rl y vo ti ng By Margaret Baum Daily News correspondent SACRAMENTO A Sacramento jury heard from the father of a Red Bluff girl murdered in 2013 for the second time Tuesday af- ternoon. Ricky Nichols took the stand as a defense witness in the Quen- tin Bealer murder trial. Bealer is charged with homicide in the strangling death of 14-year-old Marysa Nichols, who was found half a mile behind Red Bluff High School Feb. 28, 2013. Bealer's attorney, Shon Northam asked Nichols about a lawsuit he had filled regard- ing Marysa's death. According to Nichols, he filed a wrongful death lawsuit against Red Bluff High School and Marysa's mother, Di- ane Whitmire, in 2013. "The school didn't keep her safe," Nichols told the jury. Nichols called safety at the high school inadequate, noting that the school could be a model for other schools in the state. "Our children don't need to be in harm's way," Nichols said. "So, you don't care about the money," Northam asked Nichols. "I just want our schools to be safe, so this doesn't happen to someone else," Nichols answered. Nichols will continue his testi- mony Wednesday at 1:30 p.m. According to Deputy Dis- trict Attorney Donna Daly dur- ing opening statements, Bealer strangled Nichols to death with her tank top, which was taken off, turned inside out and wrapped around her neck twice before be- ing tied in a knot. Bealer was seen on high school surveillance footage walking about a minute in front of the vic- tim and looking back in her direc- tion, said Daly. Bealer has asserted his inno- cence over the past few years. He previously testified that he gave Marysa a cigarette, but never touched her. The jury also heard from a De- partment of Justice DNA crimi- nalist for the second time Tues- day morning. Rebecca Gaxiola, a senior crim- inalist, gave testimony regarding the DNA analysis in the case. "It is amazing how many peo- ple do not know this band ex- ists," said Director Jay Thiel. "Though there have been bands in Tehama County since 1863, the band as it is now was formed in 1947. Bands prior to that dis- banded during World War II in the early 1940s." The band was quite popular during its formative years, per- forming at most local public functions, activities and events, Thiel said. "The band was always there offering its up-beat sounds of joy and enthusiasm to events," Thiel said. "It started the grand entry at the Red Bluff Rodeo and we used to play in the grand stands each night of the Tehama fair, entertaining the folks until the main attraction was to start.
