This ordinance is enact- 2. 53328 and 53340 of the Code, and in accordance with the Rate and Method of Apportionment of Special Tax (the "Rate and Method of Apportionment") as set forth in Exhibit B to Resolu- tion No. 02-12, entitled "Resolu- tion Declaring Formation of Community Facilities District; Deeming it Necessary to Incur Indebtedness; and Calling Elec- tion" (the "Resolution"), adopt- ed by the this Board on January 11, 2012, a special tax (the "Spe- cial Tax") is hereby levied on all taxable parcels within Commun- ity Facilities District No. 2011-1 (Wastewater System Improve- ment Project") ("CFD No. 2011- 1") for the 2012-2013 fiscal year and for all subsequent fiscal years in the amount of the maxi- mum authorized tax; provided that this amount may be re- duced for 2012-2013 or a subse- quent fiscal year by resolution of this Board, so long as such re- duction can be implemented without reducing the aggregate amount of Annual Special Taxes being levied for such fiscal year below the amount which equals the "Special Tax Requirement" (as said term is defined in the Rate and Method of Apportion- ment) for such fiscal year; and provided further that levy of the Special Tax shall terminate in accordance with the Rate and Method of Apportionment and shall not in any event extend be- yond fiscal year 2055-2056. Pursuant to Sections 3. (the "General Manager") of the District is authorized and direct- ed, as the "Administrator" (as said term is defined in the Rate and Method of Apportionment) and with the aid of the appropri- ate officers, agents and consul- tants of the District, to deter- mine each year, without further action of this Board, the Annual Special Taxes (as said term is defined in the Rate and Method of Apportionment), to determine as necessary the Catch-Up Spe- cial Tax for property to which the Catch-Up Special Tax is ap- plicable, to prepare the annual tax roll for the Annual Special Tax in the amount per taxable parcel determined in accord- ance with the Rate and Method of Apportionment and, without further action of this Board, to provide all necessary and ap- propriate information to the Tehama County Auditor in prop- er form, and in proper time, nec- essary to effect the correct and timely billing and collection of the Annual Special Tax in the same manner and at the same time as ordinary ad valorem property taxes levied by Tehama County (the "County") on each Assessor's Parcel of the Taxable Property (as said terms are defined in the Rate and Method of Apportionment); pro- vided that, as provided in the Resolution and Government Code Section 53340, this Board reserves the right to utilize any method of collecting the Annual Special Tax which it shall, from time to time, determine to be in the best interests of the District, including but not limited to, di- rect billing by the District to the property owners and supple- mental billing. Without limit- ing the generality of the forego- ing proviso, the General Manag- er, as Administrator, shall pro- vide for direct billing and collec- tion of the Catch-Up Special Tax (as said term is defined in the Rate and Method of Apportion- ment), payment to the District of which shall be a condition prec- edent to approval by the District of the application of the owner or owners of the subject proper- ty for wastewater services for the subject property.
