VISE Tehama County Clerk & Recorder Publish: May 7, 14, 21 & 28, 2016 LEGAL NOTICE ORDINANCE NO. 2023 AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUN- TY OF TEHAMA AMENDING CHAPTER 9.14 OF THE TEHAMA COUNTY CODE RELATING TO FIRE SAFE REGULATIONS THE BOARD OF SUPERVISORS OF THE COUNTY OF TEHAMA OR- DAINS AS FOLLOWS: SECTION 1. Section 9.14.001 of the Tehama County Code is hereby repealed. SECTION 2. Section 9.14.001 is hereby added to the Tehama County Code to read: 9.14.001 Title. These regulations shall be known as the "Tehama County Fire Safe Regulations," and shall constitute the basic wildland fire protection stand- ards of the County of Tehama, which are intended to be equal to the minimum standards of the California Department of Forestry and Fire Protection ("CAL FIRE") in accordance with California Code of Regulations, title 14, section 1270.03. SECTION 3. Section 9.14.005 of the Tehama County Code is hereby repealed. SECTION 4. Section 9.14.005 is hereby added to the Tehama County Code to read: 9.14.005 -Provisions for applica- tion of these regulations. This subchapter shall be applied as follows: A. Each affected County depart- ment shall provide the CAL FIRE Unit Chief with notice of applica- tions for building permits, tenta- tive parcel maps, tentative maps, and use permits for con- struction or development within the County. B. CAL FIRE will review and make fire protection recommenda- tions on applicable construction or development permits or maps provided by the County. C. The County officer or legisla- tive body having approval au- thority shall ensure that the ap- plicable sections of this sub- chapter become a condition of approval of any applicable con- struction or development permit or map. SECTION 5. Section 9.14.006 of the Tehama County Code is hereby repealed. SECTION 6. Section 9.14.006 is hereby added to the Tehama County Code to read. 9.14.006- Inspection authority. Inspection shall be made pur- suant to Section 9.14.007 by the officer or agency designated pursuant to California Code of Regulations, title 14, section 1270.05 SECTION 7. Section 9.14.010 of the Tehama County Code is hereby repealed. SECTION 8. Section 9.14.01 O is hereby added to the Tehama County Code to read: 9.14.010-Appeals. Where an ex- ception is not granted by the in- spection authority, the applicant may appeal such denial to the Tehama County Technical Advi- sory Committee established pursuant to Section 16.08.030 ("TAC"). The TAC shall utilize an appeal process consistent with existing planning department appeal processes. Before the TAC makes a determination on an appeal, the inspection au- thority shall be consulted and shall provide documentation outlining the effects of the re- quested exception on wildland fire protection to the TAC. If an appeal is granted, the TAC, Planning Commission, or Board of Supervisors, as applicable, shall make findings that the de- cision meets the intent of pro- viding defensible space consis- tent with these regulations. Such findings shall include a statement of reasons for the de- cision. A written copy of these findings shall be provided to the CAL FIRE Unit headquarters that administers fire protection in the County. SECTION 9. Section 9.14.011 of the Tehama County Code is hereby repealed. SECTION 10. Section 9.14.011 is hereby added to the Tehama County Code to read. 9.14. 011 - Definitions. "Accessory building" means any building used as an accessory to residential, commercial, recrea- tional, industrial or educational purposes as defined in the Cali- fornia Building Code, 1989 Amendments, Chapter 11, Group M, Division 1, Occupancy that re- quires a building permit. "Building" means any structure used or intended for supporting or sheltering any use or occu- pancy that is defined in the Cali- fornia Building Code, 1989 Amendments, Chapter 11, ex- cept Group M, Division 1, Occu- pancy. For the purposes of this subchapter, building includes mobile homes and manufac- tured homes, churches and day care facilities. "CAL FIRE" means California De- partment of Forestry and Fire Protection. "CAL FIRE Unit Chief' means Chief of the Tehama-Glenn Unit of CAL FIRE, or his/her designee. "County" means the County of Tehama. "Cul-de-sac" means a road which terminates in which terminates in a perma- nent turnaround and which by design is not intended to contin- ue beyond its terminal point. "Dead-end road" means a road that has only one point of vehic- ular ingress/egress, including cul-de-sacs and looped roads. "Defensible space" means the area within the perimeter of a parcel, development, neighbor- hood or community where basic wildland fire protection practi- ces and measures are imple- mented, providing the key point of defense from an approaching wildfire or defense against en- croaching wildfires or escaping structure fires. The perimeter as used in this regulation is the area encompassing the parcel or parcels proposed for con- struction and/or development, excluding the physical structure itself. The area is characterized by the establishment and main- tenance of emergency vehicle access, emergency water re- serves, street names and build- ing identification, and fuel modi- fication area measures. "Development" means as de- fined in Section 66418.1 of the California Government Code. "Driveway" means a vehicular access that serves no more than two buildings, with no more than three (3) dwelling units on a single parcel, and any number of accessory buildings. "Dwelling unit" means any building or portion thereof which contains living facilities, including provisions for sleep- ing, eating, cooking and/or sani- tation for not more than one family. "Exception" means an alterna- tive to the specified standard re- quested by the applicant that may be necessary due to health, safety, environmental condi- tions, physical site limitations or other limiting conditions such as recorded historical sites, that provides mitigation of the prob- lem. "Fuel modification area" means an area where the volume of flammable vegetation has been reduced, providing reduced fire intensity and duration. "Greenbelts" means a facility or land-use, designed for a use oth- er than fire protection, which will slow or resist the spread of a wildfire. Includes parking lots, irrigated or landscaped areas, golf courses, parks, playgrounds, maintained vine- yards, orchards or annual crops that do not cure in the field. "Hammerhead/T" means a roadway that provides a "T" shaped, three-point turnaround space for emergency equip- ment, being no narrower than the road that serves it. "Hydrant" means a valved con- nection on a water supply/storage system, having at least one (1) two and one-half (2 %) inch outlet, with male American National Fire Hose Screw Threads (NH) used to supply fire apparatus and hoses with water. "Occupancy" means the pur- pose for which a building or part thereof, is used or intended to be used. "One-way road" means a mini- mum of one traffic lane width designed for traffic flow in one direction only. "Roads, streets, private lanes" means vehicular access to more than one parcel; access to any industrial or commercial occu- pancy; or vehicular access to a single parcel with more than two buildings or four or more dwelling units. "Roadway" means any surface designed, improved, or ordinari- ly used for vehicle travel. "Roadway structures" means bridges, culverts, and other ap- purtenant structures which sup- plement the roadway bed or shoulders. "Same practical effect," as used in this subchapter, means an ex- ception or alternative with the capability of applying accepted wildland fire suppression strat- egies and tactics, and provi- sions for fire fighter safety, in- cluding: A. Access for emergency wild land fire equipment, B. Safe civilian evacuation, C. Signing that avoids delays in emergency equipment re- sponse, D. Available and accessible wa- ter to effectively attack wildfire or defend a structure from wild- fire, and E. Fuel modification area suffi- cient for civilian and fire fighter safety. "Shoulder" means roadbed or surface adjacent to the traffic lane. "Structure" means that which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined to- gether in some definite manner. "Subdivision" means as defined in Section 66424 of the Govern- ment Code. "Traffic lane" means the portion of a roadway that provides a single line of vehicle travel. "Turnaround" means a roadway, unobstructed by parking, which allows for a safe opposite change of direction for emer- gency equipment. Design of such area may be a hammerhead/T or terminus bulb. "Turnout" means a widening in a roadway to allow vehicles to pass. "Vertical clearance" means the minimum specified height of a bridge or overhead projection above the roadway. "Wildfire" means as defined in Public Resources Code Sections 4103 and 4104. SECTION 11. Section 9.14.021 of the Tehama County Code is hereby repealed. SECTION 12. Section 9.14.021 is hereby added to the Tehama County Code to read. 9.14.021 -Road width . All roads shall be constructed to provide a minimum of two (2) ten foot (1 O') traffic lanes, not including shoulder and striping. These traffic lanes shall provide for two-way traffic flow to sup- port emergency vehicle and ci- vilian egress, unless other standards are provided in this article, or additional require- ments are mandated by the County. SECTION 13. Section 9.14.022 of the Tehama County Code is hereby repealed. SECTION 14. Section 9.14.022 is hereby added to the Tehama County Code to read: 9.14.022-Roadway surface. Road- ways shall be designed and maintained to support the im- posed load of fire apparatus weighing at least 75,000 pounds and provide an aggregate base. Project proponent shall provide engineering specifications to support design, if requested by the support design, requested by CAL FIRE or the County. SECTION 15. Section 9.14.024 of the Tehama County Code is hereby repealed. SECTION 16. Section 9.14.024 is hereby added to the Tehama County Code to read: 9.14.024 -Roadway radius. A. No roadway shall have a hori- zontal inside radius of curvature of less than fifty feet (50'). Roadways with a horizontal in- side radius of curvature greater than fifty feet (50') require the following additional road width: Curve Radius Additional Width to Be Added 50 to 100 Feet 4 Feet 100 to 200 Feet 2 Feet B. The length of vertical curves in roadways, exclusive of gut- ters, ditches and drainage struc- tures designed to hold or divert water, shall be at least one hun- dred feet (100'). SECTION 17. Section 9.14.025 of the Tehama County Code is hereby repealed. SECTION 18. Section 9.14.025 is hereby added to the Tehama County Code to read: 9.14.025 -Roadway turnarounds. Turnarounds are required on driveways and dead-end roads. The minimum turning radius for a turnaround shall be forty feet (40'), not including parking. If a hammerhead/Tis used, the top of the "T" shall be a minimum of sixty feet (60') in length. SECTION 19. Section 9.14.026 of the Tehama County Code is hereby repealed. SECTION 20. Section 9.14.026 is hereby added to the Tehama County Code to read: 9.14.026 -Roadway turnouts. Turnouts shall be a minimum of twelve feet wide (12') and thirty feet (30') long with a minimum twenty-five (25) foot taper on each end. SECTION 21. Section 9.14.027 of the Tehama County Code is hereby repealed. SECTION 22. Section 9.14.027 is hereby added to the Tehama County Code to read: 9.14.027 -Roadway structures. A. All driveway, road, street and private lane roadway structures shall be constructed to carry at least the maximum load and provide the minimum vertical clearance as required by Vehicle Code Sections 35250, 35550 and 35750. B. Appropriate signing, including but not limited to weight or ver- tical clearance limitations, one- way road or single lane condi- tions, shall reflect the capability of each bridge. C. Where a bridge or an elevated surface is part of a fire appara- tus road, the bridge shall be constructed and maintained in accordance with the American Association of State and High- way Transportation Officials Standard Specifications for Highway Bridges, 1 ih Edition, published 2002 (known as AASHTO HB-17), hereby incorpo- rated by reference. Bridges and elevated surfaces shall be de- signed for a live load sufficient to carry the imposed loads of fire apparatus. Vehicle load lim- its shall be posted at both en- trances to bridges when re- quired by the County officer or legislative body having approval authority. Where elevated surfa- ces designed for emergency ve- hicle use are adjacent to surfa- ces which are not designed for such use, barriers, or signs, or both, as approved by Tehama County Public Works, shall be in- stalled and maintained. A bridge with only one traffic lane may be authorized by the County of- ficer or legislative body having approval authority however, it shall provide for unobstructed visibility from one end to the other and turnouts at both ends. SECTION 23. Section 9.14.028 of the Tehama County Code is hereby repealed. SECTION 24. Section 9.14.028 is hereby added to the Tehama County Code to read: 9.14.028 -One-way roads. The County officer or legislative body having approval authority may approve one-way roads. All one-way roads shall: A. Provide a minimum, not in- cluding shoulders, of one (1) twelve foot (12') traffic lane; B. Connect to a two-lane road- way at both ends; C. Provide access to an area cur- rently zoned for no more than ten (10) dwelling units; D. Not exceed two-thousand six hundred forty feet (2,640') in length; and E. Have a turnout placed and constructed at approximately the midpoint of each one-way road. SECTION 25. Section 9.14.029 of the Tehama County Code is hereby repealed. SECTION 26. Section 9.14.029 is hereby added to the Tehama County Code to read: 9.14.029 - Dead-end roads. A. The maximum length of a dead-end road, including all dead-end roads accessed from that dead-end road, shall not ex- ceed the following cumulative lengths, regardless of the num- ber of parcels served: Number of Acres Maximum Parcel Zoned For Length of Dead- End Road Less than 1 acre 800 Feet 1 acre to 4.99 acres 1,320 Feet 5 acres to 19.99 acres 2,640 Feet 20 acres or larger 5,280 Feet All lengths shall be measured from the edge of the roadway surface at the intersection that begins the road to the end of the road surface at its farthest point. Where a dead-end road crosses areas of differing zoned parcel sizes, requiring different length limits, the shortest allow- able length shall apply. B. Where parcels are zoned five (5) acres or larger, turnarounds shall be provided at a maximum of one-thousand three hundred twenty (1,320) foot intervals. C. Each dead-end road shall have a turnaround constructed at its terminus. SECTION 27. Section 9.14.030 of the Tehama County Code is hereby repealed. SECTION 28. Section 9.14.030 is hereby added to the Tehama County Code to read: 9.14.030 - Driveways. All drive- ways shall be constructed to provide a minimum of one (1) ten foot (1 O') traffic lane and fourteen feet (14') of unob- structed horizontal clearance and unobstructed vertical clear- ance of fifteen feet (15'). A. Driveways exceeding one hundred fifty feet (150') in length, but Jess than eight hun- dred feet (800') in length, shall provide a turnout near the mid- point of the driveway. Where the provide point of the driveway. Where the driveway exceeds eight hundred feet (800'), turnouts shall be pro- vided no more than four hun- dred feet (400') apart. B. A turnaround shall be provid- ed at all building sites on drive- ways over three hundred feet (300') in length, and shall be within fifty feet (50') of the building. SECTION 29. Section 9.14.031 of the Tehama County Code is hereby repealed. SECTION 30. Section 9.14.031 is hereby added to the Tehama County Code to read: 9.14.031 -Gate entrances. A. Gate entrances shall: 1. Be at least two feet (2') wider than the width of the traffic lane(s) serving that gate; and 2. Have a minimum of fourteen feet (14') unobstructed horizon- tal clearance and unobstructed vertical clearance of fifteen feet (15'). B. All gates providing access from a road to a driveway shall: 1. Be located at least thirty feet (30') from the roadway; and 2. Open to allow a vehicle to stop without obstructing traffic on that road. C. Where a one-way road with a single traffic lane provides ac- cess to a gated entrance, a forty foot (40') turning radius shall be used. Security gates shall not be in- stalled without approval and where security gates are instal- led, they shall have an approved means of emergency operation. Approval shall be by CAL FIRE. The security gates and emer- gency operation shall be main- tained at all times. SECTION 31. Section 9.14.041 of the Tehama County Code is hereby repealed. SECTION 32. Section 9.14.041 is hereby added to the Tehama County Code to read: 9.14.041 -Size of letters, numbers and symbols for street and road signs. Size of letters, numbers, and symbols for street and road signs shall be: A. At least four inch (4") letter height and half-inch (0.5") stroke; B. Reflectorized; and C. Contrasting with the back- ground color of the sign. SECTION 33. Section 9.14.047 of the Tehama County Code is hereby repealed. SECTION 34. Section 9.14.047 is hereby added to the Tehama County Code to read: 9.14.047 -Installation of road, street and private lane signs. Road, street and private lane signs required by this article shall be installed prior to final acceptance by the County. SECTION 35. Section 9.14.048 of the Tehama County Code is hereby repealed. SECTION 36. Section 9.14.048 is hereby added to the Tehama County Code to read: 9.14.048 -Addresses of buildings. All buildings shall be issued an address by the Tehama County Planning Department. Accessory buildings will not be required to have a separate address; how- ever, each dwelling unit within a building shall be separately identified. SECTION 37. Section 9.14.049 of the Tehama County Code is hereby repealed. SECTION 38. Section 9.14.049 is hereby added to the Tehama County Code to read: 9.14.049 -Size of letters, numbers and symbols for addresses. Size of letters, numbers, and sym- bols for addresses shall be: A. At least four inch (4") letter height and half-inch (0.5") stroke; B. Reflectorized; and C. Contrasting with the back- ground color of the sign. Address identification shall be plainly legible and visible from the street or road fronting the property. Addresses shall be Arabic numbers or alphabetical letters. Where access is by means of a private road and the address identification cannot be viewed from the public way, a monument, pole, or other sign or means shall be used to identify the address. SECTION 39. Section 9.14.061 of the Tehama County Code is hereby repealed. SECTION 40. Section 9.14.061 is hereby added to the Tehama County Code to read: 9.14.061 -Application. The provi- sions of this article shall apply only when new parcels are ap- proved by the County. The emer- gency water system shall be available on-site prior to the completion of road construction, where a community water sys- tem is approved, or prior to the completion of building construc- tion, where an individual system is approved. SECTION 41. Section 9.14.062 of the Tehama County Code is hereby repealed. SECTION 42. Section 9.14.062 is hereby added to the Tehama County Code to read: 9.14.062-General standards . Wa- ter systems that comply with the below standard(s) meet or exceed the intent of these regulations. Water sys- tems equaling or exceeding the National Fire Protection Associa- tion (NFPA) 1142, "Standard on Water Supplies for Suburban and Rural Fire Fighting, "2012 Ed- ition", hereby incorporated by reference, and California Fire Code, California Code of Regula- tions title 24, part 9, shall be ac- cepted as meeting the require- ments of this article. Such emer- gency water may be provided in a fire agency mobile water ten- der, or naturally occurring or manmade containment struc- ture, as long as the specified quantity is immediately availa- ble. Nothing in this article pro- hibits the combined storage of emergency wildfire and struc- ture firefighting water supplies unless so prohibited by local or- dinance or specified by CAL FIRE. Where freeze protection is required by CAL FIRE, such pro- tection measures shall be pro- vided. SECTION 43. Section 9.14.063 of the Tehama County Code is hereby repealed. SECTION 44. Section 9.14.063 is hereby added to the Tehama County Code to read: 9.14.063 Hydrant. A. The hydrant shall be: 1. Eighteen inches (18") above grade; 2. At least eight feet (8') from flammable vegetation; 3. At least four feet (4'}, but no more than twelve feet (12') from a roadway; and 4. Located where fire apparatus using it will not block the road- way. B. The hydrant serving any building shall be: 1. At least fifty feet (50'}, but not more than one-half (%) mile by road from the building it is (%) by road from the building it is to serve; and 2. Located at a turnout or turn- around, along the driveway to that building or along the road that intersects with that drive- way. C. The hydrant head shall be: 1. Two and one-half inch (2 %") and/or four and one-half inch (4 %") National Hose male thread with cap for pressure and gravity flow systems; or 2. Four and one-half inch (4 %") draft systems. Such hydrants shall be wet or dry barrel as required by the de- livery system. They shall have suitable crash protection as re- quired by CAL FIRE. SECTION 45. Section 9.14.064 of the Tehama County Code is hereby repealed. SECTION 46. Section 9.14.064 is hereby added to the Tehama County Code to read: 9.14.064-Signing of water sour- ces. Each hydrant or access to water shall be identified as fol- lows; A. If located along a driveway, shall be identified with: 1. At least a three (3) inch reflectorized blue marker on the driveway address sign; and 2. Mounted on a fire retardant post. B. If located along a street or road, shall be identified with: 1. At least a three inch (3") reflectorized blue marker on the sign in a horizontal position; 2. Mounted on a fire retardant post at least three (3) feet, but not greater than five (5) feet above ground; 3. Located within three (3) feet of said hydrant; and 4. Visible from the driveway; or 5. As specified in the State Fire Marshall's Guidelines for Fire Hydrant Markings Along State Highways and Freeways, May 1988. SECTION 47. Section 9.14.070 of the Tehama County Code is hereby repealed. SECTION 48. Section 9.14.070 is hereby added to the Tehama County Code to read: 9.14.070 -Intent . To reduce the intensity of a wildfire by reduc- ing the volume and density of flammable vegetation, the stra- tegic siting of fuel modification areas and greenbelts shall pro- vide: A. Increased safety for emergen- cy fire equipment and evacuating civilians by utiliza- tion around structures and road, including driveways; and B. A point of attack or defense from a wildfire. SECTION 49. Section 9.14.071 of the Tehama County Code is hereby repealed. SECTION 50. Section 9.14.071 is hereby added to the Tehama County Code to read: 9.14.071 -Setback for structure defensible space. A. All parcels one (1) acre and larger within the County shall provide a minimum thirty foot (30') setback for buildings and accessory buildings from all property lines and/or the center of a road. B. For parcels less than one (1) acre within the County, TAC shall provide for the same prac- tical effect. SECTION 51. Section 9.14.072 of the Tehama County Code is hereby repealed. SECTION 52. Section 9.14.072 is hereby added to the Tehama County Code to read: 9.14.072 -Disposal of flammable vegetation and fuels. Disposal, including chipping, burying, burning or removal to a landfill site approved by CAL FIRE, of flammable vegetation and fuels caused by site development and construction, road and driveway construction, and fuel modifica- tion areas shall be completed prior to completion of road con- struction or final inspection of a building permit. SECTION 53. Section 9.14.073 of the Tehama County Code is hereby repealed. SECTION 54. Section 9.14.073 is hereby added to the Tehama County Code to read: 9.14.073 -Greenbelts. Subdivi- sions and other developments, which propose greenbelts as a part of the development plan, shall locate said greenbelts strategically, as a separation between wildland fuels and structures. The locations shall be approved by the County offi- cer or legislative body having approval authority, in consulta- tion with CAL FIRE, and may be consistent with the CAL FIRE Unit Fire Management Plan. SECTION 55. This ordinance shall take effect thirty (30) days from the date of its adoption, and pri- or to the expiration of fifteen (15) days from the adoption thereof shall be published at least one time in the Red Bluff Daily News, a newspaper of gen- eral circulation in Tehama Coun- ty.
