The City Council finds and declares as follows: (A) The northern re- gion of our State has experi- enced a recent increase in ex- plosions caused from the manu- facture of honey oil (also known as hash oil) in clandestine labs using refined butane of 5x and higher. These incidents have caused considerable property damage, personal injury and even incidents of death to those participating in the manufactur- ing process, and to innocent bystanders. (B) The use of re- fined butane 5x or higher is done to dissolve the tetrahydrocannabinol (THC) res- in from marijuana plants, which concentrates into a liquid/oil form as a result of the butane's stripping process. The stripping of the THC through use of re- fined butane of 5x or higher causes flammable butane vapors to accumulate low to the ground and remain exposed to ignition sources. Studies sug- gest that 99.5% of the extracted THC Butane mixture will volatil- ize into the immediate area and remain in a form that is odorless and latent to the human eye and only detected through a com- bustible gas instrument. (C) A honey oil lab using refined butane of 5x and higher presents a serious haz- ard to property and persons, in- cluding first responders and in- nocent bystanders, and such conditions present grave risk of loss where potential ignition sources are present, resulting in an explosion. (D) The resale of re- fined butane 5x and higher oc- curs at levels that are only rele- vant to the manufacture of hon- ey oil. Such sales and posses- sion of butane should be regu- lated to prevent the use of bu- tane in the manufacture of hon- ey oil where such activity pres- ents grave dangers and adverse health risks to the occupants of the City of Red Bluff and the first responders therein. SECTION 2. In order to pro- tect the health, safety and wel- fare of the citizens of Red Bluff, Chapter 8: FIRE DEPARTMENT, Article III: REGULATION OF BU- TANE RESALE, of the Code of the City of Red Bluff is added to read as follows: Article III: REGULATION OF BU- TANE RESALE § 8.30 Authority and Title § 8.31 Definitions. § 8.32 Unlawful Sale, Purchase and Handling Butane § 8.33 Tracking of Butane Sales § 8.34 Penalties, Strict Liabili- ty, and Nuisance. § 8.35 Reserved for Future Use. § 8.36 Cumulative Remedy. § 8.30 Authority and Title Under the authority granted in Article XI, Section 7 of the Cali- fornia Constitution and Govern- ment Code Sections 36900 and 36901, the City of Red Bluff, by and through its Council, does enact this Article of its Munici- pal Code, which shall be known as the Butane Resale Ordinance. § 8.31 Definitions: For the purpose of this Article the following definitions apply: "Butane" means iso-butane, n- butane, and butane of power 5x or greater. "Canister" means a single bu- tane canister of a storage quan- tity of 300 ml (10.6 ounces) or more. "Code" means the Red Bluff Mu- nicipal Code. "Count" means the number of canisters of refined butane. "Customer" means any person who is sold or acquires during a transaction products from any retail store. "Day" means calendar day. "Package" means butane of- fered for sale at quantities of two or more. "Person" means a corporation, co-partnership, or association as well as a natural person. "Reseller" means any business, company, corporation, person, employee or associate selling products to any customer within the City of Red Bluff. It does not include any wholesaler engaged in a wholesale transaction. "Sell" means to furnish, give away, exchange, transfer, deliv- er, surrender, distribute or sup- ply, whether for monetary gain or other consideration. "Transaction" means a pur- chase, sale, trade, loan, pledge, investment, gift, transfer, trans- mission, delivery, deposit, with- drawal, payment, exchange of currency, extension of credit, purchase or sale of any mone- tary instrument, or an electron- ic, magnetic or manual transfer between accounts or any other acquisition or disposition of property by whatever means af- fected. "Wholesaler" means a person whose business is the selling of goods in gross to retail stores for purposes of resale. § 8.32 Unlawful Sale, Pur- chase, And Handling Of Butane A. It is unlawful for any retailer or person to sell to a customer more than 600 ml (21.0 oz) of butane during any single transaction. B. It is unlawful for any person that is not a re- seller to have in their posses- sion, custody or control more than 600 ml (21.0 oz) of butane at any one time. C. It is unlawful any C. It is unlawful for any customer of retailer to purchase or acquire more than 600 ml (21.0 oz) of butane per month, whether sold individual- ly or by the package. § 8.33 Tracking of Butane Sales A. For every sale of butane, Reseller shall prepare a bill of sale that identifies the date of sale, quantity of butane purchased, and the purchaser's identification. Purchaser's iden- tification as used herein shall mean a person's first and last name as verified from a valid driver's license or other official and valid state-issued identifi- cation that contains a photo- graph of the purchaser and a residential or mailing address. Reseller shall retain a copy of the bill of sale in readable form for a period of two years. B. If shall be un- lawful for any retailer to sell bu- tane to any customer without complying with this Section of this Code. C. Any Reseller shall provide the City, upon writ- ten request, copies of the re- cords described in this section. § 8.34 Penalties, Strict Liabili- ty, And Nuisance A. Unless other- wise provided in this chapter or by state law, a violation of any of the provisions of this Article shall be punishable as provided in Chapter 1 of this Code. A vio- lation of this Article is a misde- meanor and subject to a $1,000 penalty, per violation (Govern- ment Code, Section 36901). A separate violation shall exist for every single canister sold, pur- chased or possessed in violation of this Article. B. This Article is a regulatory provision necessary for the protection of the public health, welfare and safety. In any criminal prosecution for a violation of this chapter, it is not necessary to prove knowledge or criminal intent. C. A violation of any provision of this Article con- stitutes a public nuisance. § 8.35 [This section is reserved for future use]. § 8.36 Cumulative remedy . Nothing herein is intended to limit the City from pursuing any other remedy available at law or in equity against any person or entity maintaining, committing, or causing a public nuisance or any other violation of the Code or State or Federal law. Section 3. If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remain- ing portions of this ordinance. The City Council hereby de- clares that it would have passed this ordinance, and each sec- tion, subsection, sentence, clause or phrase hereof, irre- spective of the fact that any one (1) or more sections, subsec- tions, sentences, clauses or phrases be declared, invalid or unconstitutional. Section 4. The City Coun- cil finds the approval of this or- dinance is not subject to the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no po- tential for resulting in physical change to the environment, di- rectly or indirectly. Alternative- ly, the City Council finds the ap- proval of this ordinance is not a project under CEQA Regulation Section 15061(b)(3) because it has no potential for causing a significant effect on the environ- ment. Section 5. Within 15 days from the passage thereof, this ordinance shall be published at least once in the Red Bluff Daily News, a newspaper of general circulation, published and circu- lated in the City of Red Bluff. This Ordinance shall take effect thirty (30) days after the date of its adoption.
