ByElliotSpagat The Associated Press SAN DIEGO Tarla Makaeff has had enough of Donald Trump after spending six years fighting him in court. The Southern Califor- nia yoga instructor wants to withdraw from a fed- eral class-action lawsuit that says Trump Univer- sity fleeced students with an empty promise to teach them real estate. Her law- yers said the Republican presidential front-runner and his team have put her "through the wringer" and made the prospect of a trial unbearable. A judge will consider the request Friday, four days before Florida and Ohio hold their primaries. Trump's attorneys say the lawsuit should be dismissed if Makaeff is allowed to withdraw, arguing that their trial strategy centers on her. They deposed her four times and identify her as "the criti- cal witness" in a court filing. Makaeff's attorneys say Trump's argument that their client is indispensable to the billionaire's defense "is illogical to the point of being nearly incomprehensi- ble." They note the judge al- lowed two plaintiffs to with- draw last year; three others would remain. The tussle in one of three lawsuits againstTrump Uni- versity comes as the case nears trial, possibly this summer. A trial date has not been set, but a final pretrial conference is scheduled for May 6 and Trump appears on a list of defense witnesses who may testify at trial. The lawsuit has figured prominently in the presi- dential campaign, fueled by legal filings and Trump's statements. In depositions that took place in Decem- ber and January and were released last week, Trump acknowledged that he never met instructors whom his marketing described as hand-picked, and that some unqualified candidates had "slipped through the cracks." The Better Business Bu- reau said Tuesday that it rated Trump University a D- in 2010, which improved to A+ by January 2015 as the business appeared to wind down and older complaints automatically rolled off its books. Makaeff attended a three- day "Fast Track to Foreclo- sure" workshop for $1,495 in 2008 and later enrolled in the "Trump Gold Elite" program for $34,995, spend- ing a total of about $60,000 on seminars in a year, her attorneys say. In April 2010, she sued in San Diego fed- eral court. Trump sued for defa- mation, seeking $1 mil- lion. Makaeff prevailed on appeal, and a judge last year ordered Trump to pay $798,779 in her legal fees. Trump and his attorneys are trying to frame much of their case around Makaeff, saying she gave instructors high marks in surveys after the courses. "Thereasontheywanther out of the case is she is a hor- rible, horrible witness. She's got in writing that she loves it. And I could have settled it and when I saw her doc- umentation ... Why would I give her money? Probably should have settled it, but I just can't do that. Mentally I can't do it. I'd rather spend a lot more money and fight it," Trump said at a rally in Ar- kansas last month, accord- ing to a transcript. In last week's Republican debate, Trump said Makaeff wants to withdraw "because it's so bad for her." "She simply did not put in the time, work, and per- severance necessary to achieve success," Trump's lawyers wrote the judge last month. Makaeff's attorneys say the yoga instructor was un- aware of Trump's "false ad- vertising" when she filled out the surveys and didn't want to risk alienating any- one who might advance her career. Makaeff didn't imagine she would be subjected to criticism under the glare of a presidential campaign, her attorneys say. She has been deposed for a total of nearly 16 hours and suffered anx- iety about finances while Trump sued her for defa- mation. " U n d e r s t a n d a b l y, Makaeff wants her life back without living in fear of be- ing disparaged by Trump on national television," they wrote in a court filing last week. Makaeff declined to com- ment through an attorney. In a statement to the court, she said she was grieving her mother's death. "I am very concerned about the toll that the trial would take on my emo- tional and physical health and well-being," she wrote. Trump has also ad- dressed criticism of the lawsuit by pointing to the judge's ethnic background. Asked on "Fox News Sun- day" last month what U.S. District Judge Gonzalo Curi- el's ethnicity has to do with the case, Trump replied: "I think it has to do perhaps with the fact that I'm very, very strong on the border, very, very strong at the bor- der, and he has been ex- tremely hostile to me." Curiel, who was nomi- nated by President Barack Obama and joined the bench in 2012, declined to comment on Trump's re- marks. Mrs. Reagan's funeral service, preceded by pub- lic viewings on Wednesday and Thursday, was planned down to the smallest de- tails by the former first lady herself, including the flower arrangements, the music to be played by a U.S. Marine Corps band and the people who received invitations to the private memorial at Simi Valley's Ronald Reagan Presiden- tial Library. Among those who had RSVP'd by Tuesday were former President George W. Bush and his wife, for- mer first lady Laura Bush; former first lady Rosalynn Carter; first lady Michelle Obama; and former first lady Hillary Clinton. "No doubt about it, the most important of her spe- cial requests was that she be laid to rest right next to the president, as close as possible," said John Heu- busch, executive direc- tor of the Ronald Reagan Presidential Foundation and Library. "The way the tomb is constructed," he contin- ued, "her casket will lit- erally be set forth in the ground inches from Pres- ident Reagan's." The hour-long service, to which approximately 1,000 people have been invited, is to take place on the li- brary's lawn. On a clear day the gravesite affords visitors ocean views. Others who have said they will attend include President Richard Nix- on's daughter Tricia Nixon Cox and President Lyndon Johnson's daughters Lynda Bird Johnson Robb and Luci Baines Johnson. "One of our saddest situ- ations is we have so many people who have called or written, saying they would like to attend, but unfor- tunately it needs to be by invitation only because we only have so much room on the lawn, Heubusch said. "As a result, Mrs. Reagan was very adamant about having some time where the public could come by and pay last respects." Public viewings are scheduled at the library from 1 to 7 p.m. on Wednes- day and 10 to 2 p.m. on Thursday. First ladies' funerals, once a quiet affair, changed significantly following the death of President Frank- lin D. Roosevelt's widow, Eleanor Roosevelt, in 1962. Mrs. Roosevelt, a United Nations delegate, author and prominent political figure in her own right, tried to keep the event fairly quiet, limiting the guest list to 250 people, although those guests in- cluded President John F. Kennedy, former Presi- dents Harry Truman and Dwight D. Eisenhower, and future President Lyndon Johnson. More than 1,000 mourners jammed the streets outside the church in Hyde Park, N.Y. The most recent first la- dy's funeral was for Presi- dent Gerald Ford's widow, Betty, in 2011. Some 800 people, including Mrs. Reagan, attended a pri- vate memorial service for her in Palm Springs, Cal- ifornia, followed by a sec- ond, smaller service in her hometown of Grand Rap- ids, Michigan.
