The following defend- ants were sentenced in Tehama County Superior Court, according to the Te- hama County District At- torney's Office: RecentState/Local Prison Commitments: People vs. Joseph Nurkiewicz, Arson; Crim- inal Threats, with prior strike. Brief history: Defendant lived with his girlfriend and three sons. During the night, he threatened to burn the house down, and then lit fire to a mattress on which the kids were sleeping. Sentenced to 4 years State Prison People vs. James Lister, Corporal Injury to Spouse/ Cohabitant/Girlfriend Brief history: Defendant punched his girlfriend, knocking out her pros- thetic eye, and forced his fist into her mouth to make her "eat his ring." Sentenced to 4 years State Prison People vs. Richard Haase, Concealed Dirk or Dagger, with prior strike. Brief history: TCSO at- tempted a traffic stop on the defendant for an equipment violation. The defendant fled briefly be- fore stopping, then ran from the car, throwing a fixed-blade knife and some methamphetamine. A po- lice canine finally subdued him. Sentenced to 2 years, 8 months State Prison People vs. Daylan Mc- Donald, Felon in Posses- sion of Firearm Brief history: After an altercation with another person in a parking lot, the defendant left the scene. When RBPD made a traf- fic stop to detain the de- fendant, he threw a hand- gun out of the car. He had prior convictions for drug trafficking. Sentenced to 2 years State Prison Recent County Jail Commitments: People vs. Daniel Tor- rence, Failure to Appear on Felony; Assault by Means of Force Likely to Produce Great Bodily Injury Brief history: On June 3, 2014, the defendant was granted probation for fail- ing to appear on a drug charge. On November 30, 2015, he shot the victim several times with a BB gun, hitting him twice in the face. Sentenced to 3 years 8 months state prison sus- pended with 5 years pro- bation and 120 days jail. People vs. Tracey Foster, Possession of Billy Club; Carrying Loaded Firearm in City Limits Brief history: The de- fendant was one of three people in a car on a traf- fic stop. The car contained three batons, a loaded .22 rifle, and small amounts of heroin and methamphet- amine. The defendant ad- mitted owning one baton and the gun. Sentenced to 3 years probation through Behav- ioral Health Court and 60 days county jail. Brief history: The De- fendant was arrested and charged with the mur- der of a 14 year old vic- tim who had been reported missing when she never re- turned home from school. Officers located the vic- tim's body two days later. First Day of Trial: Rul- ings on Motions-in-Li- mine/Jury Selection, Feb- ruary 8 at 9 am in Depart- ment 27 (Sacramento) First Day of Evidence: February 22 at 9 am in De- partment 27 (Sacramento) People vs. Travis John Kilburger, Solicitation of Murder (2 counts) Brief history: The De- fendant was in custody on domestic violence charges when he solicited another inmate to kill two individ- uals in exchange for cash and a vehicle. TBJ: Vacated. Defendant Plead guilty. SENTENCING: Febru- ary 12 at 1 pm (Department to be determined) People vs. Poly Due- nas Sanchez, Lucio Nene- cia Madera and Gabino Madera, Murder with Special Allegation-Per- sonal and Intentional Dis- charge of a Firearm, GBI, Conspiracy to Commit a Crime with Special Alle- gation-Personal and Inten- tional Discharge of a Fire- arm, GBI. Brief history: The Vic- tim had met up with the three Defendants regard- ing money that was alleg- edly owed to the victim. During this confronta- tion the victim was chased down and shot twice with a shotgun. The victim died as a result of his injuries. TBJ: March 2 at 1:30 pm (Department to be deter- mined) People vs. Alan Duane Doulphus Jr., Chase Alan Doulphus: Murder, special allegation felony murder, personal and intentional, use of a firearm, assault with a firearm, false im- prisonment by violence, transportation of mari- juana. Brief history: The de- fendants went to a res- idence that contained a marijuana grow. The de- fendants confronted the victim and two other men who were at the residence and ordered them to the ground at gunpoint. The defendants proceeded to tie up the victim and the two men with zip ties and duct tape. The victim was able to free himself and at- tempt to flee the residence but was shot several times by the armed defendants. The victim eventually suc- cumbed to his injuries. Defendant's vehicle was located a short time later and a vehicle pursuit fol- lowed. Defendant's were eventually apprehended and taken into custody. Inside the vehicle officers located a large amount of marijuana. Motions In Limine: Feb- ruary 19, in Department 2 TBJ: February 24, at 1:30 pm (Department to be de- termined) People vs. John Noonkester, Willful, De- liberate and Premeditated Murder with Special Alle- gation, Personal and Inten- tional Discharge of a Fire- arm, GBI (2 counts); At- tempt: Willful, Deliberate and Premeditated Mur- der with Special Allega- tion, Personal and Inten- tional Discharge of a Fire- arm, GBI. Brief history: The Defen- dant is charged with shoot- ing and killing his ex-wife and her father, and shoot- ing a bystander. Arraignment on Infor- mation: February 22, at 1:15 pm in Department 3 People vs. William Fos- ter, Derek Hale, Garrett Lenardo, Zachary Thorn- ton and Robert Beaugrand, attempted murder Brief History: What be- gan as a marijuana deal re- sulted in kidnapping, rob- bery and one individual with a gunshot wound. PTC: February 22 at 1:15 pm in Department 3 People vs. Anthony Na- hinu, attempted murder Brief History: The De- fendant is charged with shooting the minor victim. Sentencing: February 1 at 8 am in Department 3 People vs. David Hast- ings, Grand Theft of Per- sonal Property; First De- gree Residential Burglary; Possession of Burglar's Tools; First Degree Resi- dential Burglary, 4 counts; Grand Theft of Personal Property, 3 counts; Grand Theft; Identity Theft, 2 counts; Possession of a Firearm by a Felon; Pos- session of Ammunition; Receiving Stolen Property, 9 counts; Petty Theft. Brief history: The vic- tim's vehicle was broken into and several personal items were stolen includ- ing a wallet. The following day, the victim's bank ac- count was missing $1,300. It was later found the De- fendant's cell phone bill had been paid with the exact same amount by the victim's checking ac- count. The Defendant de- nied. The victim's home was burglarized while on vacation. Neighbors had taken pictures of the vehi- cle and the driver that was at the home. While officers con- tacted the Defendant on other matters, they dis- covered several of the vic- tim's items within the De- fendant's vehicle. The De- fendant was the suspect in various burglaries within the area. Several items of stolen property were found on the Defendant's person while being contacted in regards to other cases. Sentencing: February 1 at 10 am in Department 1 People vs. Roberta Draper (12 counts) Cruelty to an animal Brief history: The Defen- dant is currently on proba- tion for a prior cruelty to animal case. One of the terms of her probation is that she is not to possess any animals. A probation search was conducted at her residence and law en- forcement located dogs, geese, guinea hens and turkeys. One of the dogs was de- ceased, while some of the other animals appeared to be malnourished, dehy- drated, and in poor health. The Defendant admitted that all the animals found belonged to her.
